HomeMy Public PortalAbout19900305 :f. 243 REGULAR COUNCIL MEETING, MARCH 5, 1990 II- Regular Council Meeting of March 5, 1990, was called to order at '0:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by Reverend Spencer Roberts, Pastor; Second Baptist Church. the Pledge of Allegiance was led by City Administrator Dave Johnston. The following Council Members were present: Present: Davis, Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, Veile, and Woodman. Absent: None. A quorum was declared present. PRESENTATX0N8 FROM GALLERY: Mr. Paul Pederson, 1915 Seven Hills Road had requested to address the Council concerning Bill 89-185, changing the name of Seven Hills goad to Eastland Drive. Mr. Pederson stated that he would like to address the following four areas: 1. Reason of continuity 2. Loss than ton families live on this street. 3 . Backers are business community, not residents. 4 . Object to the renaming. After addressing these four items in detail, Mr. Pederson requested the Council vote against the proposed name change. # # # )Jr. Joe Kroeger, 1434 Sunset Lake Road, requested to address the Council regarding Bill 89-185, changing the name of Seven Hills Road to Eastland Drive. Mr. Kroeger stated he was opposed to this name ;i change. Mr. Kroeger stated he had lived in this town for seventy tyears and had seen many changes. Mr. Kroeger informed the Council hat he has had nine address changes in that seventy years, and has rived in the same house all that time. Councilman Gordon seconded the motion and it was approved. MINUTES/REPORTS RECEIVED AND FILED: No minutes had been received in the office of the City Clerk. • ANNOUNCEMENTS BY MAYOR: Mayor Gardner introduced Boy Scout Troop II from the Presbyterian Church that was present in the meeting. Mayor Gardner announced that Good Morning America and ABC News were interested in doing a program regarding the problems Jefferson City has had with cable television. Mayor Gardner stated that Good Morning America and ABC News would be in Jefferson City and would like to talk with individuals who would like to express their problems with TCI. Mayor Gardner informed those wishing to speak with the media to please notify her office. DILLS INTRODUCED: Bill 09-191, sponsored by Councilman Feldman, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY ENACTING SECTION 17-212 ENTITLED GROSS RECEIPTS UTILITY LEVY ROLLBACK. Bill 89-191 was read first and second time by title and ordered distributed to members of the Council. Councilman Feldman informed the Council that it was his intent to place this bill on the Informal Calendar at the next meeting and to have a public hearing so anyone interested in expressing their opinion on this issue could be heard by the Council. # # # Bill 89-192, sponsored by Councilman Halsey, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE BUDGET OF THE CITY OF JEFFERSON, MISSOURI, BY APPROPRIATING FUNDS FROM THE GENERAL FUND TO THE LEGAL DEPARTMENT. Bill 89-192 was read first and second time by title and ordered distributed to members of the Council. ' Councilman Scheulen stated he would like to comment on bill 89-191, I and that he felt it would be appropriate for this bill to be placed 1: before the Finance Committee for discussion. Bill 89-193 was read first and second time by title and ordered distributed to members of the Council . # # # Bill 89-194, sponsored by Councilman Scheulen, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, GRANTING THE CITY COUNSELOR AND CITY ADMINISTRATOR AUTHORITY TO SIGN RELEASES ON BEHALF OF THE CITY FOR CLAIMS UP TO TEN THOUSAND DOLLARS. Bill 89-194 was read first and second time by title and ordered distributed to members of the Council . # # # Councilman Scheulen moved that bills 09-191, 89-192, 89-193 , and 89- 194 be assigned to the Finance Committee as per City ordinances. Councilman Owens seconded the motion. Councilman Feldman moved to amend the motion to exclude 89-191 from the original motion and it be dealt with separately. Councilman Halsey seconded the motion. Councilman Owens stated she felt this bill was a part of the budget and a public hearing should be held in the Finance Committee. Councilman Feldman stated this bill does not change the budget for this year and he would like to deal with it in Council Chambers. Councilman Owens stated that she felt responsible government required looking at the long range effect. Councilman Owens stated she would like to know what effect this bill would have years down the road and needs more information. Councilman Scheulen stated that this bill does effect the budget and is a very serious item. Councilman Scheulen stated that it would effect the budget in future years and it should be referred to the Committee that is set up to deal with this bill. Councilman Haake stated his agreement that this bill does effect the budget and the need to study this bill to see the impact it would have on the City in the future. , Councilman Veile called for the question on the amendment. A voice vote proved inconclusive and a roll call vote was requested. The motion to send the four bills that had been introduced to the Finance Committee was approved by the following roll call vote: Aye: Gordon, Haake, Mason, Owens, Scheulen and Woodman. Nay: None. # # # Bill 89-185, sponsored by Councilman Scheulen, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING THE NAME OF SEVEN HILLS ROAD TO EASTLAND) DRIVE. Bill 89-185 was read third time by title, placed on final passage. Councilman Scheulen stated he felt there might be a misconception that the Eastside Betterment Association was the driving force behind changing the name of Seven Hills Road to Eastland Drive. Councilman Scheulen stated this was not the case and that the Association had simply endorsed the proposal to make the name change Eastland Drive. Director of Planning and Code Enforcement Tom Benton reviewed for the Council the history behind the bill being considered at this time. Director of Public Works Mike Bates stated that as a general rule the Public Works Department supports the continuous name of a street. Councilman Halsey stated that there are a number of streets in Jefferson City with the same problem and if the majority of the 1 people involved would sanction name changes to make all of the streets contiguous, this could be done. Councilman Owens stated that she agreed that the City does have a very confusing set of streets and would like to ask the Mayor's Long Range Planning Committee to investigate the feasibility of changing all of the names of the streets that are continuous. Councilman Scheulen stated that the bill would be voted on tonight and did not wish to drag the issue out. Councilman Mason stated that he felt it was time to atop and take into consideration what the residents want and the Council representatives for this ward want and then get on with Council business. Bill 89-185 was defeated by the following vote: Aye: Owens and Scheulen. Nay: Davis, Feldman, Gordon, Haake, Halsey, Mason, Veile and Woodman. # # # Bill 89-186, sponsored by Councilman Owens, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING AN OFFICIAL FLAG OF THE CITY OF JEFFERSON, MISSOURI, AND AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY ENACTING SECTION 2-2 ENTITLED CITY FLAG. Bill 89-186 was read third time by title, placed on final pannago. Councilman Voile moved to amend the flag to delete the words . "Jefferson City, Missouri" from the flag. Councilman Voile stated that only two flags of the various states have a name on them and that the flag as a symbol did not need a name on it. Councilman Feldman seconded the motion. Councilman Owens informed the Council that the Flag Committee had discussed the issue of not putting a name on the flag, but felt that the purpose for having a flag was for people to know where we were located. Ms. Owens stated that the original design had been submitted without a name but the Committee had requested the artist to add the name to the flag. The motion was defeated by the following roll call vote: Aye: Davis, Feldman, Halsey, and Voile. Nay: Gordon, Haake, Mason, Owens, Scheulen and Woodman. Councilman Voile moved to amend Bill 89-186 to have the flag say "City of Jefferson, Missouri" which is the official name of the City. Councilman Feldman seconded the motion. Councilman Owens informed the Council that the Committee had also discussed this possibility, but that in light of the fact that all of the maps say Jefferson City, Missouri, and the mailing address is Jefferson City, Missouri. Councilman Owens informed the Council she was opposed to the amendment. After further discussion Councilman Haake called for the question. Councilman Veile seconded the call and it was approved. RESOLUTIONS: Councilman Haake moved approval of Resolution 89-32 regarding street improvements to Chestnut Street from Leslie Blvd. to Lincoln University Stadium, Councilman Mason seconded the motion and it was approved. Councilman Mason moved approval of Resolution 89-33 regarding street improvements to Fairmount Boulevard from Chestnut to Moreau Drive. Councilman Halsey seconded the motion and it was approved. UNFINISHED BUSINESS/NEW BUSINESS: Councilman Gordon asked if the City had received any official word from TCI regarding the request to put alternate programming on the channels that are currently "blacked out". Mayor Gardner stated she had not received an official response. Councilman Feldman stated x II that TCI had informed the Cable Quality Commission that under no circumstances would this be changed. Councilman Gordon stated he felt the only recourse the citizens had was to begin to put "heat on" the local office. Councilman Gordon also requested that City Counselor Allen Garner review the syndication rules to see if anything can be done from a legal standpoint. Councilman Feldman stated that the cable company feels that they are going to put pressure on the local broadcasters and the people of Jefferson City until they can got the duplicate channels removed. Councilman Feldman stated that the only time TCI responds is when enough pressure is brought to bear on them. Councilman Halsey informed the Council ho was no longer in favor of changing the name of a portion of Chestnut Street to Martin Luther " King Drive. Councilman Halsey stated that studies indicated that a majority of the residents were opposed to this change. After relating an incident involving a pedestrian being hit by a motor vehicle while crossing in the cross walk, Councilman Halsey requested Public Works Director Mike Bates to check for accidents and to have traffic counts taken for the intersections of High & Madison, High & Jefferson and High & Monroe and to make recommendations to the Council as to what changes if any, should be made. After further discussion, Councilman Haake stated this was a matter which should be referred to the Traffic Safety Commission for their review and recommendation. Councilman Haake stated he would place this item on the Agenda for the Traffic Safety Commission' s meeting in April. Councilman Owens requested the Long Range Planning Committee look at the number of continuous streets in Jefferson City which have many 250 REGULAR COUNCIL MEETING, MARCH 5, 1990 names and to recommend ordinances for future use. + Councilman Mason stated he would like to commend Jackie Johnson, her ;; i1 crew and Tom Benton for their efforts in alleviating the problem of CI dogs running at large in Cedar City. °{ Councilman Veile asked if a date for the public forum for political candidates had been set.
