AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA ADOPTING A COMPREHENSIVE PLAN FOR THE TOWN OF GULF STREAM
IN ACCORDANCE WITH THE "LOCAL GOVERNMENT COMPREHENSIVE PLANNING
AND LAND DEVELOPMENT REGULATION ACT", AS AMENDED, BEING SECTIONS
163.3161 ET. SEQ., FLORIDA STATUTES; ADOPTING A COMPREHENSIVE
PLAN TO CONSIST OF A FUTURE LAND USE ELEMENT, TRAFFIC
CIRCULATION ELEMENT, HOUSING ELEMENT, SANITARY SEWER, SOLID
WASTE, DRAINAGE, POTABLE WATER, AND NATURAL GROUNDWATER AQUIFER
RECHARGE ELEMENT, COASTAL MANAGEMENT ELEMENT, CONSERVATION
ELEMENT, RECREATION AND OPEN SPACE ELEMENT, INTERGOVERNMENTAL
COORDINATION ELEMENT, AND A CAPITAL IMPROVEMENTS ELEMENT;
PROVIDING A SEVERABILITY CLAUSE AND A CONFLICTS CLAUSE; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the .Local Planning Agency has held a public hearing
with due public notice on the proposed Comprehensive Plan and has
forwarded,its recommendation to the Town Commission; and
WHEREAS; the Town Commission has held two public hearings in
accordance with Section 163.3184(15), Florida Statutes; and
WHEREAS; the Town Commission has reviewed the written
comments submitted to it by the state land planning agency in
accordance with Section 163.3184(7), Florida Statutes;
NOW, THEREFORE, THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA HEREBY ORDAINS that:
Section 1. Pursuant to the provisions of the "Local
Government Comprehensive Planning and Land Development
Regulation Act ", Sec. 163.3161 et. seq., Florida Statutes,
the Town Commission of the Town of Gulf Stream, Florida
hereby adopts the Comprehensive Plan of the Town of Gulf
Stream, Florida, consisting of a Future Land Use Element,
Traffic Circulation Element, Housing Element, Sanitary
Sewer, Solid Waste, Drainage, Potable Water, and Natural
Groundwater Aquifer Recharge Element, Coastal Management
Element, Conservation Element, Recreation and Open Space
Element, Intergovernmental Coordination Element, and a
Capital Improvements Element. A copy of each of the
aforesaid elements is attached hereto and made a part hereof
as Exhibit "A."
Section 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 3. Should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder
hereof.
Section 4. This ordinance phall take effect immediately upon
second reading.
