Absent: Feldman, Haake, Mason, and Owens. Councilman Gordon moved the Council to go into Executive Session to discuss Personnel as provided for in RSMo. 610.025 (3) , to discuss Litigation as provided for in RSMo. 610. 025 (1) , and to waive the requirements of Sec. 2-69 (c) of the City Code. Councilman Woodman seconded the motion and it was approved by the following roll call vote: Aye: Gordon, Halsey, Scheulen, Veile, Vincent, and Woodman. Nay: None. III A Regular Council Meeting of January 7, 1991, was called to order at 7: 30 P.M. with Mayor Louise Gardner presiding. Prayer wan offered by Reverend Joseph Blair; First Presbyterian Church. The Pledge of Allegiance was led by City Administrator Dave Johnston. The following Council Members were present: Present: Gordon, Halsey, Mason, Scheulen, Voile, Vincent, and Woodman. Absent: Feldman, Haake, and Owens. A quorum was declared present. { Mayor Gardner introduced Mr. Eric Chism, Executive Director of the Jefferson Community Betterment Association to the Council. Mayor Gardner announced that Assistant Scout Master Steve Price and IIIBoy Scout Troop 5 of the Central United Church of Christ were present at the meeting. PUBLIC HEARING: The first public hearing was to discuss the rezoning of lots 5, 6, 1' st,Yr fi. REGULAR COUNCIL MEETING, JANUARY 7, 1991 jj 7 and 8 of Chula Vista Hills from RS-2 (Single Family Residential) !; to RD (Two Family Residential) . There was no one present to speak ii either for or against the rezoning. The second public hearing was to discuss the proposed amendments to the zoning ordinance for definition of Substance Abuse Treatment Facility and appropriate zoning district classifications (Senate Bill 728) . Director of Planning and Code Enforcement Tom Benton reviewed for the Council amendments that have been proposed for Bill 90-139 and stated that Dr. Andrew Homer from the Missouri Department of Mental Health was present to address these amendments. Dr. Andrew Homer, Missouri Department of Mental Health, stated that several amendments had been proposed to make it easier for drug and alcohol abuse treatment centers to operate. Dr. Homer stated that these facilities are health care facilities and should be treated as such. Mr. Banton informed the Council that the proposed amendments would be referred to the Planning and Zoning Commission for their review and approval. The public heari.nqu concluded at 7 : 35 p.m. PRESENTATIONS FROM GALLERY: Mr. Dan Sthni.odoru, Prosident of Don Schnieders Excavating Company, Inc. , spoke to the' Council regarding till 90--118. Mr. Schnieders stated he believed the idea was good, but questioned the need for an ordinance. Mr. Schnieders stated that he believed the bid specifications that were distributed for the various projects clearly stated that the Council had the right to reject any and all bids and to take only the lowest and best bid. Mr. Schnieders stated he believed these could be adhered to and would accomplish the same thing passage of an ordinance would accomplish. Mr. Schnieders stated he believed certain stipulations of this bill should be incorporated into the specifications. Councilman Veile thanked Mr. Schnieders for coming to address this issue and stated that due to the absence of Councilman Feldman, Bill 90-117 would remain on the Informal Calendar. CONSENT AGENDA: The Consent Agenda consisted of the following items: a) Council Minutes of 12/10/90 b) Approval of the following bids: 1213 - Manhole Rehabilitation Machine; Public Works 3 REGULAR COUNCIL MEETING, JANUARY 7, 1991 1218 - 1990 Stormwater Project, Phase I; Public Works (Bill 90-141) c) Approval of Mayor's travel expense for NLC Conference • d) Appointment to Jefferson City Police Department Data Processing & Telecommunications Operator - Pam Little Councilman Mason moved approval of the Consent Agenda. Councilman Gordon seconded the motion and it was approved. MINUTES/REPORTS RECEIVED AND FILED: • Mayor Gardner announced the following minutes/reports had been received and were on file in the office of the City Clerk. Police Personnel Board 11/1/90; City Cemetery Board Meeting 11/13/90; Board of Adjustment 11/13/90; Housing Authority Board of Commissioners 11/13/90; Transportation Commission 11/20/90; Solid Waste Committee 12/3/90; Solid Waste Committee 12/14/90 Reports: Mayor's report on NLC trip to Houston ANNOUNCEMENTS BY MAYOR: Mayor Gardner stated she had received a letter from TCI stating their desire to provide cable service to north Jefferson City (former Cedar City) via Holts Summit. Mayor Gardner requested the Cable Quality Commission meet with representatives of TCI and City e staff to determine what can be worked out to provide service to the citizens in this area. Mayor Gardner announced that there were several vacancies on various Boards and Commissions and requested the Council assist her in filing these vacancies by notifying her of persons that might be qualified to serve. Councilman Voile stated he would like to propose some amendments to this bill. Councilman Voile stated he believe the lees for the permits were too expensive and moved that Section 9 be amended to read as follows: 9. Fees, The annual fees for residential parking permits shall be as set out below, but may be pro-rated on a monthly basis, based on an October 31 expiration: Residential - $5. 00 for first registered vehicle, $2.00 for every vehicle thereafter, not to exceed 3 permits, unless hardship can be proven Visitors - $2 .00 per permit Councilman Vincent seconded the motion. City Counselor Allen Garner stated that he would recommend that the Council further amend the amendment to delete the phrase, "but may he pro-rated on a monthly basis" . Mr. Garner stated that as the fees were so drastically reduced, he did not believe the Council would want to take the time to administer a pro-rated program. Councilman Veile amended his amendment to delete the phrase "but may be pro-rated on a monthly basis, " from Section 9. Councilman Halsey seconded the amendment. Councilman Woodman seconded the motion and it was approved. �' s: Councilman Halsey stated that thin hill had received a lot of diucunsion in terms of parking, however, there wan also a safety factor that was involved. Councilman Hanley stated that there in a safety problem for those who live in the area and those who drive through the area to other. locations. REBOLUTIONBZ Councilman Gordon moved R890-17 be amended to Kidd the Director of Planning and Code Enforcement to the committee to act as an ex-- officio member. Section 1 of RS90-17 will read as follows: 1. The Mayor, with the approval of the Council shall appoint a three member nominating committee composed of ( 1) an architect, (2) a real estate appraiser, and (3) a realtor. The Director of Planning & Code Enforcement shall act as an ex- officio member of the committee. This committee shall function without regard to friendship and/or notoriety. Councilman Halsey seconded the amendment and it was approved. Councilman Gordon moved approval of RS90-17 as amended. Councilman Halsey seconded the motion and it was approved. UNFINISHED BUSINEBB: Councilman Veile stated that at the December 10, 1990, Council Meeting the Final Report of the Cable TV Task Force had been distributed for the Council 's review. Councilman Veile stated that a number of recommendations had been made by the Task Force and { ‘ 9 REGULAR COUNCIL MEETING, JANUARY 7 , 1991 move adoption of those recommendations at this time. Councilman Vincent seconded the motion and it was approved. NEW BUSINESS: Councilman Gordon questioned City Counselor Allen Garner as to how the violations of parking in handicapped spaces were being controlled. Mr. Garner explained the process and the procedure for clearly marking a space as "handicapped" . Councilman Gordon questioned Captain Steve Welch as to how the Police were monitoring this issue. Captain Welch stated that if his officers were patrolling and spotted offenders, they were ticketed, and that also the Police responded to complaints of violations. Councilman Halsey commented on the performance of the Department Directors for this past year stating that his purpose in doing so was to clarify the fact that the City had not undergone an assessment of its operation for a number of years. Councilman Halsey moved that the City Administrator seek out either retired individuals qualified to assess the City or a firm that could do a feasibility study of the City and its various departments and operations, and that his recommendation be brought back to the •� Council for further action in February. Councilman Mason seconded the motion and after clarification that this was just a motion to request alternates be brought to the Council for action, the motion wan approved. Mayor Gardner informed the Council that she had instructed City Administrator Dave Johnston to do an assessment of the budget process, the current budget and a contingency plan in case of budget deficits. Councilman Gordon moved that Marty Brose explore the possibility of extending bus service to north Jefferson City (formerly Cedar City) , and report back to the Council in two weeks. Councilman Mason seconded the motion and it was approved. Councilman Voile stated that the City Council had adopted the recommendations made by the Cable TV Task Force and that one of those recommendations had been the seeking of competition into the area. Councilman Veile encouraged the Cable Quality Commission to look closely at the proposal made by TCI to provide cable service to the north Jefferson City (former Cedar City) and not do anything that might provide them an opportunity for a further monopoly in this area. Councilman Veile stated his intent to introduce legislation to the Council that would help alleviate some of the barriers currently in existence that might prohibit competition. Councilman Vincent stated that the Cable Quality Commission had already stated that any service extended to north Jefferson City (formerly Cedar City) would have to be the same system as that in other areas in Jefferson City. Councilman Vincent stated that the 10 REGULAR COUNCIL MEETING, JANUARY 7, 1991 I Commission would be looking very closely at the proposal from TCI 11 before any action would be taken. is Councilman Voile stated that he had noticed several problems during " the holiday season with exiting the Mall, especially by City National and Hy Vee. Councilman Voile moved that the Public Works Department and the Police Department look into this problem and make a recommendation as to any action the Council might take to alleviate this problem. Councilman Halsey seconded the motion and it was approved. APPROVAL OF EXECUTIVE SESSION MINUTES: Councilman Vincent moved approval of the Executive Session Minutes ' of December 10, 1990. Councilman Halsey seconded the motion and the meeting was adjourned at, approximately 8 :30 p.m. ACTION TAKEN IN EXECUTIVE SESSION: Councilman Gordon moved approval of the City Administrator's recommendation of a 2% meritorious increase for Fire Chief Robert Ronnick.
