The following Council Members were present: Present: Feldman, Gordon, Haake, Halsey, Mason, Owens, • Scheulen, Veile, Vincent, and Woodman. Absent: None Councilman Woodman moved the Council go into Executive Session to discuss Personnel as provided for in RSMo. 610. 025 (3) , and to discuss Litigation as provided for in RSMo. 610.025 (1) , and to waive the requirements of Sec. 2-69 (c) of the city Code. Councilman Gordon seconded the motion and it was approved by the following roll call vote: Aye: Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, jj Voile, Vincent, and Woodman. Nay: None. # # # A Regular Council. Meeting of March 4 , 1991, was called to order at 7 : 30 P.M. with Mayor Louise Gardner presiding. Prayer wary offered by Father Greg Meystrik, Associate; Immaculate i. Conception. The Pledge of Allegiance was led by City Administrator Dave Johnston. The following Council Members were present: Present: Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, Veile, Vincent, and Woodman. it Absent: None. A quorum was declared present. PRESENTATIONS FROM GALLERY: The first presentation was by Mr. 1 p y Reg Turnbull, 135 Forest Hill, ,: representative of the Parks and Recreation Commission. Mr. ,j Turnbull reviewed for the Council some of the history of the Hough Park property. Mr. Turnbull stated that a packet of information had been prepared for the Council and distributed at their places IJ prior to the meeting. Mr. Turnbull stated that several conditions of the will had been violated. Mr. Turnbull stated that the Commission believed that there were two issues involved in this property. One was the selling of alcohol and the secona was 3 7 ,. REGULAR COUNCIL MEETING, MARCH 4, 1991 clearing of title. Mr. Turnbull stated that the Commission might choose or not choose to sell alcohol at a later time, and the Council has the authority to pass ordinances regarding the sell of alcohol. Mr. Turnbull urged the Council to proceed with the clearing of title to this property and settle the issue of alcohol at a later time. Councilman Scheulen questioned the continued violation of the original will and what had prompted the quit claim dead that had been signed by seven of the heirs in the 1960s. City Counselor Allen Garner stated that there had been a search for records in private firms, but the City had not been able to find any background on the quick claim deed. Councilman Haake stated he did not believe that having violated the will in the past was any excuse for continuing to violate the will. Councilman Mason stated he believed it was an ethical issue at this time and that the City needed to abide by the terms of the will. Mr. Dennis Morriaey, 1222 Amity, npoke to the Council as a member of Hough Park. Mr. Morr,iscy stated this issue had been around for long time and he found it curious that it was becoming such a controversy at election time. Mr. Morrissey stated he thought the Council might wont to delay any action on this issue until after the election. Mr. Morr.isoy also stated the City could not utilize selective enforcement. if they wore going to adhere to one condition of the will , they must adhere to all the conditions. Ma. Janet Ousley, 1018 Mississippi Street, informed the Council she represented u number of residents that were opposed to the sale of alcohol at Hough Park. Ms. Ousley stated that Mr. Hough was a very intelligent man who knew what ho was doing when he gave the City this property and imposed the conditions on this property. Ms. Ousley requested Dr. Joseph Sommers, 2313 W. Main, come and give the Council a brief history on Mr. Hough. Dr. Sommers briefly described the background of Mr. Hough, who was an attorney and had served as a judge in this area. Ms. Ousley informed the Council she had petitions that had been signed by several individuals requesting the condemnation suit against Hough Park be withdrawn. Councilman Veile stated he had indicated he would call for Council action to withdraw the lawsuit, however, after further study of the matter, had determined the best way to proceed was with the introduction of an ordinance repealing the condemnation ordinance. Councilman Veile stated he would not be requesting suspension of the rules for this bill, as he felt the Council and public should be given the two weeks to further study this issue. Councilman Feldman questioned if the Council repeals the condemnation ordinance, if they are in fact then committed to fulfill all the conditions of the will. City Counselor Allen Garner reviewed for the Council some of the other alternatives s 38 REGULAR COUNCIL MEETING, MARCH 4, 1991 available. Councilman Scheulen stated he believed it would be very hypocritical on the part of the Council to withdraw the lawsuit and then not fulfill the conditions of the will. Councilman Scheulen suggested an alternative might be the possibility of condemnation with damages. This would allow the City to take the monies awarded in damages and find a like piece of property and fulfill all the conditions of the will on this parcel. Councilman Scheulen stated he did not think the City could realistically fulfill all the conditions of the will at Hough Park. Mr. Todd Morris, 3900 Rustic Lane, spoke '- , the Council representing Youth to Youth. Mr. Morris stated that the hope for the future is in our children. Mr. Morris stated that this area is heavily populated by adolescents and that alcohol should not be available in this area. Mr. Morris stated the leading causes of death in teenagers are alcohol-related. # # # Mr. Kevin Ihrig of Columbia, Missouri, spoke to the Council concerning a curbside recycling program he will be starting in Jefferson City. Mr. Ihrig distributed to the Council a map outlining the area whore the pilot program will begin and reviewed for the Council the types of items that will be recycled. Councilman Feldman stated the Solid Waste Committee had met and discussed this issue with Mr. Ihrig and were very excited about the prospect of this program. Councilman Feldman moved the Council support in principle this concept. Councilman Owens seconded the motion. After some discussion as to the types of equipment to be used, the items to be taken and where the recycled goods will be processed, the motion was approved. # # # Mr. Kevin Wansing, 328 Bolivar, spoke to the Council representing commuter students against the residential permit parking ordinance. Mr. Wansing stated this was unfair to the commuter students and he believed the residents in this area should be pleased at the progress Lincoln University is making. Mr. Wansing presented the City Clerk with petitions that had been signed by individuals 1F stating the proposition regarding parking around Lincoln University was unfair. Councilman Vincent questioned Mr. Wansing as to whether or not the ! students were looking at alternatives to help alleviate the parking problem. Mr. Wansing stated that many are participating in a ride- sharing program and they are also investigating the possibility of a shuttle service. �j 3 9 REGULAR COUNCIL MEETING, MARCH 4, 1991 Councilman Halsey stated that there was a safety factor that was s involved in this issue and that the residents were having problems getting in and out of their property. Councilman Mason stated that he appreciated the comments Mr. Wansing made, however, the Council had an obligation to protect the integrity of the neighborhoods in this area. Mr. Eric Knoll, 5219 Old Lohman Road, spoke to the Council on behalf of the students at Jefferson City High School. Mr. Knoll stated that the students need to be able to park on Jackson Street. # if # Mayor Gardner stated there were a number of residents present that were interested in Hough Park. Mayor Gardner stated she believed the Council should deal with this issue at this time and requested Councilman Voile suspend the rules on Bill 90-166. Councilman Voile stated there were a number of questions rained that the Council needed to consider, however, he would bow to the wishes of the Council. Councilman Voile stated ho would suspend the rules if x the Council so desired. Councilman Scheulen stated he objected to the suspension of the rules as the Council had boon given a lot of material at this meeting and they needed time to study this material. Councilman Halsey also objected to the suspension of the rules. # # # Councilman Feldman moved for a five minute recess. Councilman Halsey seconded the motion and it was approved. The Council recessed at approximately 9: 00 p.m. and reconvened at approximately 9: 10 p.m. CONSENT AGENDA: The Consent Agenda consisted of the following items: a) Council Minutes of 2/18/91 b) Monthly Financial Statement -- January c) Appointment of Ed Rackers as Acting Director of Public Works d) Approval of travel request to U.S. Conference of Mayors, San Diego, CA, June 14-June 19 Councilman Scheulen asked Director of Finance, Bob cox, where the City stood on revenue projections for this year. Mr. Cox stated that so far the only revenue that is low is the February sales tax. Mr. Cox stated this is below last years. Councilman Scheulen requested Mr. Cox keep the Council informed of any deficits in projected revenue. Councilman Owens moved approval of the Consent Agenda. Councilman Woodman moved approval 1 of the appointments. Councilman Vincent seconded the motion. The motion was defeated by the following roll call vote: Aye: Hawke, Vincent and Woodman. 1 Nay: Feldman, Gordon, Halsey, Mason, Owens, Scheulen, and Veile. Councilman Scheulen stated he had tried to stay out of the 1 discussions on the appointments, however, he believed the public i1 should be aware that the Council was not the only entity that had `I political concerns over appointments. Councilman Scheulen stated that a term for a member of the Housing Authority's board had expired in November, 1990, and as yet this member had not been ,� i 41 ',:,: REGULAR COUNCIL MEETING, MARCH 4, 1991 reappointed nor had anyone been appointed to replace this member. Councilman Scheulen stated this individual, as the owner of the local newspaper, had the ability to endorse or not endorse political candidates. Councilman Scheulen stated the appointments issue is not political on just one side. Mayor Gardner stated there were times when members were not being replaced due to a project they were involved in at the time and cited a member of the Senior Citizens Advisory Ccmmission who • served beyond his term, due to a specific project he was very , involved in. Councilman Scheulen stated this gentleman was not the owner of the local newspaper and did not have the power to publicly endorse or not endorse candidates. After further discussion on the question of appointments to . committees, Councilman Halsey stated that most of the individuals were not new appointees, but reappointments and could continue to serve until they are officially reappointed. UNFINISHED BUSINESS: Councilman Vincent questioned City Counselor Allen Garner on the possibility of addressing one board or commission apart from the entire list. Mr. Garner stated it was possible, but would require a motion to reconsider from a member of the Council voting on the E prevailing side. Councilman Halsey questioned Acting Police Chief Steve Welch, as to 1 the status of the foot patrol in the east end of town. Councilman 1 Halsey also questioned the possibility of meeting with the Police Department in Executive Session to learn of certain activities that are being conducted, so the Council is in a better position to defend the police department. City Counselor Allen Garner was asked if this would be allowable li 7 / , REGULAR COUNCIL MEETING, MARCH 4, 1991 under the open meetings law and stated that the items to be discussed would need to be submitted to determine if they fall under the criteria available for this discussion. NEW BUSINESS: Councilman Vincent informed the Council that approximately 3, 000 of the surveys that had been distributed by TCI had been returned from the public and would be studied at the next Cable Quality Commission. Councilman Vincent stated that in the near future requests for proposals for cable television to North Jefferson City would be distributed. Director of Transportation Marty Bross reviewed for the Council the memorandum he had distributed in their packets regarding the request from JCI to reduce the retainage fee from 10% to 5%. Councilman Haake moved to honor JCI 's request and cut the retainage percentage from 10% to 5% . Councilman Owens seconded the motion. After some discussion an to the legalities of doing this and the purpose for this action, Councilman Halsey called for the question. Councilman Mason seconded the call and it was approved. The motion was defeated by the following roll cell vote: Aye: Repko, Owenss, Schaulen and Woodman. Nay: Feldman, Gordon, Halsey, Mason, Voile and Vincent. Councilman Haake moved the Council grant the request of JCI to begin construction on the cant garage earlier than May 15. Councilman Woodman seconded the motion. Councilman Vincent stated that the Council had discussed this issue extensively several months ago with the Downtown Business Association and had agreed to the May 15 start date and he believed the Council should stick to this date. After further discussion, the motion was defeated by the following vote: Aye: Haake, Owens, Scheulen and Woodman. Nay: Feldman, Gordon, Halsey, Mason, Voile and Vincent.
