SPECIAL COUNCIL MEETING, APRIL 22, 1991
A Special Council Meeting of April 22, 1991, was called to order at
6:30 P.M. with Mayor Louise Gardner presiding.
The following Council Members were present:
Present: Feldman, Haake, Halsey, Mason, Owens, Scheulen,
Vincent, Woodman and Wrigley.
Absent: Gordon. *
A quorum was declared present.
Mayor Gardner announced the purpose of this Special Meeting was for
the purpose of discussion of the East addition to the main garage
and modifications to JC Industries' contract for renovations and
improvements to City parking garage.

City Administrator Dave Johnston reviewed for the Council the
reasons for this Special Meeting and discussed the report that had
been distributed to diem in their packets. Mr. Johnston informed
the Council that as directed ho and the City counselor had met with
the contractor and at this time the Contractor was willing to
cancel the contract with no damages assessed against the City at
this time, however, the city would have to pay for the materials
that had been purchased for the extension. The cost for these
materials is approximately $b0, 000. 00 and the City would also have
to store the materials until the project was completed. Mr.
Johnston reviewed a table that had been prepared listing the pros
and cons of both proceeding with the project and also for delaying
the project.
Mr. Johnston informed the Council it was staff's recommendation
that the Council move forward with the contract.
Councilman Gordon entered the meeting at approximately 6: 35 p.m.
Councilman Halsey moved the City proceed, as recommended, with the
Riley Lot. Councilman Mason seconded the motion.
Councilman Haake questioned if there was a time limit on the bonds
that dictated when the garage had to be completed. Mr. Johnston
stated there was no legal obligations for a time limit, but might
perhaps be a moral obligation.
Councilman Haake stated he did not want to see the Jefferson Street
project delayed again.
Councilman Wrigley questioned how the City had arrived at the
original figures for developing the information for the bonds and
what rationale had been used in establishing the rate increase.

-i, 4 for the Jefferson Street Lot, Councilman Scheulen stated he could s`q{

the Jefferson Street lot, as there was more of a need for parking

Councilman Feldman questioned which would cost more, to proceed 11?:;,

with the Riley Lot or to delay the Riley Lot. Mr. Johnston stated e:,

it would cost approximately $439, 000 to proceed with the lot. if ,,,,i ,
the project was delayed, it would cost the City the $50, 000. 00 for
the materials already purchased. Considering the projected =:' z

increase in construction costs, it could cost: an additional
$500, 000 on top of the materials.
After further discussion on the costs for proceeding with. the e
project or delaying the project, Councilman Mason stated he f6 ::%
believed the City should proceed with the project, and complete it. :;,',k!
Councilman Mason stated he believed the downtown area had boon
disrupted enough over this project and the project should be i.`'`",.
completed as soon as possible.
Councilman Scheulen stated he did not want to see the Jefferson
', Street lot canceled. Councilman Scheulen stated the City has been
promising to build this lot for eight to ten years .
Councilman Feldman questioned if there was the potential for the
City to default on the bonds if they proceeded with the Riley Lot.
City Administrator Dave Johnston stated he did not think the City .•
would default. Councilman Feldman questioned if there was the
potential for the City to default on the bonds if they built the
Jefferson Street garage. Mr. Johnston stated he did not think the
City would default.
Councilman Halsey called for the question and it was approved.

The motion to proceed with the Riley Lot was approved by the
following vote:
Aye: Feldman, Halsey, Mason, Scheulen, Vincent and Wrigley.
Nay: Gordon, Haake, Owens and Woodman.

As there was no further business to come before the Council,
Councilman Halsey moved the meeting be adjourned. Councilman Mason
seconded the motion and it was approved. The meeting adjourned at
approximately 7:15 p.m.
