HomeMy Public PortalAbout19910520 92 REGULAR COUNCIL MEETING, MAY 20, 1991 A Regular Council Meeting of May 20, 1991, was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. { Prayer was offered by Councilman Kyle Mason. 1 The Pledge of Allegiance was led by City Administrator Dave 111 Johnston. The following Council Members were present: Present: Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, Vincent, Woodman and Wrigley. • Absent: None. A quorum was declared present. PRESENTATIONS FROM GALLERY: Officers Mike Dean and Mike Struttman, with the D.A.R.E. Program were present with fifteen students acting as representatives of the D.A.R.E. graduates from the Jefferson City public schools. Officer Dean introduced Ms. Rachel Stewart from East School who road her essay on what she had learned through the D.A.R.E. program. Such employees shall receive credit for four (4) hours worked on any holiday for purposes of computing overtime compensation under Section 8-13. Councilman Owens seconded the motion. Councilman Halsey questioned how this would effect the current policy. City Administrator Dave Johnston informed the Council this change will bring all of the departments under one policy. Councilman Wrigley questioned Councilman Mason as to whether or not this addressed the issues in the Police Department in which Councilman Mason had expressed some concern. Councilman Mason stated that at the present time, this would address those concerns. After further discussion regarding the possible need for further changes in the personnel policies of the City, the motion to amend Bill 91-14 was approved. RESOLUTIONS: Councilman Feldman moved approval of RS91-5 concerning the possible participation of City employees in a group membership in the Jefferson City Family YMCA. Councilman Wrigley seconded the motion and it was approved. Councilman Haake moved approval of RS91-6 concerning the continued participation of the Jefferson Community Betterment Association in the Neighborhood Assistance Program. Councilman Mason seconded the motion and it was approved. UNFINISHED DUBXNESB: Mayor Gardner announced there was a possible need to reconsider Bill 91-13 for amendment. Councilman Woodman requested Ron Davenport, Supervisor for the Inspection Department of the Planning & Code Enforcement Department, explain to the Council the changes staff requested. Mr. Davenport informed the Council of the need to amend Bill 91-13, stating this would allow us to continue to be compatible with Columbia, Missouri. Councilman Mason moved Bill 91-13 be reconsidered at this time. Councilman Vincent seconded the motion and it was approved. councilman Woodman moved Bill 91- 13 be amended as follows: 1. The first sentence of Section 4 .2 of Bill 91-13 shall be amended by changing the number of minimum hours an apprentice shall complete before applying for a journeyman electrician license, from 4 ,000 hours to 8, 000 hours. 2 . Section 6.0 of Bill 91-13 shall be amended by changing the phrase "Electrical Contractor" to "Master ;f Electrician" . This change shall be made throughout the entire ordinance. Councilman Haake seconded the amendment and it was approved. Nay: None. NEW BUSINESS: City Administrator Dave Johnston distributed to the Council the brochure on composting that was being considered fer distribution to the citizens of Jefferson City. Councilman Feld reviewed for the Council the process that has brought the Solid waste Committee to this point and stated the majority of the cost of this brochure to the Council would be born by EIERA, however, the cost to the City for this mailing would be approximately $2,000. 00. Councilman Feldman moved the Council support mailing this brochure to the community to begin the educational process. Councilman Scheulen seconded the motion. After some discussion as to the need to inform the public about the public hearing and also the need to keep the service open to any vendors who might be interested, Councilman Wrigley questioned who had written the brochure on burning to be included with the composting brochure. Charlie Lansford, Supervisor of the Sanitation Department, stated the information was a combination of data collected from Planning & Coda Enforcement, the Fire Department and the Environmental Quality Commission. Councilman Wrigley stated he had a problem with some of the statements made in the brochure and felt it was very slanted against leaf burning. After some discussion as to what language would be more acceptable, Councilman Mason stated that he supported Councilman Wrigley's position and that if tha Council was going to be giving out information to the public, they needed to make sure it was accurate and could be substantiated. Councilman Scheulen stated that it was important that the Council keep an open mind on the issue of solid waste. Councilman Scheulen stated the biggest challenge the solid waste committee has had is to study the entire problem, not just deal with one aspect of the problem. Councilman Scheulen stated solid waste is such a complex issue that it is difficult to grasp the entire situation, but that the Council needs to begin to study the entire process. After some discussion as to the time constraints on the Council and the Solid Waste Committee to implement certain aspects of Senate Bill 530, Councilman Vincent offered some changes in the wording on the brochure on burning. Councilman Wrigley moved to amend the brochure on burning as per Councilman Vincent's suggestions and to generalize the portion that discussed the burning of leaves. Councilman Haake seconded the motion. Councilman Feldman withdrew his original motion and Councilman Scheulen withdrew his second. Councilman Wrigley seconded the motion. =-=' Councilman Halsey stated he believed the Council needed a work _{'' session to discuss this issue in detail. '- :=• .ry Councilman Haake stated he believed the brochure was a good idea, _`; however, he felt the public needed some background information as ta to why the Council was even considering the steps being presented. Councilman Gordon stated he concurred with Councilman Haake and that the public should be educated as to why the Council is taking the steps that are being presented and also that the Council needed ` a work session prior to the public hearing to discuss this issue in more detail . Councilman Gordon moved to amend the motion to schedule a work '4 session at the earliest possible time, to f=ormulate a policy and :%' ' educational plan that will be mailed out with the brochure and to et.a' reschedule the public hearing scheduled for ;Hine 11. . Councilman Halsey seconded the amendment. After some discussion as to the appropriateness of thin amendment, Mayor Gardner announced that the chair ruled the amendment out of '' order as an improper amendment not relevant to the original motion. There followed further discussion on the time constraints facing the Council, the need for the Council as a whole to be informed as to the entire issue of solid waste and the inability to focus on all aspects of the problem at one time. Councilman Halsey moved to table this discussion at this time. Councilman Gordon seconded the motion. The motion to table was defeated by the following vote: Aye: Gordon, Haake, Halsey, Mason and Woodman. Nay: Feldman, Owens, Scheulen, Vincent and Wrigley. Mayor Gardner voted "no" , thereby breaking the tie, stating she saw r1 the urgency of situation. H Councilman Scheulen stated he believed it time the Council as a whole became informed on the issues facing the Solid Waste Committee. Councilman Scheulen stated it might be necessary to change the makeup of the committee to a committee of the whole to accomplish this, but it needed to be done. ...5 '»,.., .: Sr'i.. .tt r. After further discussion on the need to further educate the public, the motion was approved by the following vote: Aye: Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, Vincent, Woodman and Wrigley. Nay: None. Councilman Gordon moved to schedule a work session on Tuesday, June 11, and that the Solid Waste Committee and those not on the committee formulate an educational brochure that will be incorporated with the composting brochure, and that the public hearing be postponed. Councilman Haake seconded the motion. Councilman Vincent moved to amend the motion to have the educational brochure drafted and mailed with the composting brochure prior to June 11. Councilman Owens seconded the amendment. The amendment was approved. The motion as amended was approved. Councilman Schoulon stated he believed the medics could be of assistance in the education process of the public. Councilman Scheulen stated he had read a newspaper from another city in Missouri that deals with every aspect of Senate Bill 530 on a daily basis. Councilman Schoulon requested that the media of this community take the lead in assisting the City in the educational process. # # # Councilman Vincent stated that at the request of the Cable Quality Commission, he moved the City move forward with negotiations with TCI for the provision of cable service to north Jefferson City. Councilman Feldman seconded the motion and it was approved. # # # Mayor Gardner announced the Chamber of Commerce was inviting the City Council to meeting for their quarterly report on June 13, 1991, at 7:30 a.m. # # # Mayor Gardner distributed copies of the Jefferson City Visitors guide.
