The following Council Members were present: f! Present: Feldman, Haake, Halsey, Owens, Scheulen, Vincent, and Wrigley. Absent: Gordon*, Mason and Woodman. }' Councilman Haake moved the Council go into Executive Session to discuss Litigation as provided for in RSMo. 610. 025 (1) , and to waive the requirements of Sec. 2-69 (c) of the City Code. Councilman Vincent seconded the motion and it was approved by the :t} following roll call vote: Aye: Feldman, Haake, Halsey, Owens, Scheulen, Vincent, and Wrigley. Councilman Halsey moved that Bill 91-33 that was distributed to the Council prior to the Council Meeting be substituted for Bill 91-33 that was distributed in their packets of May 30. Councilman Wrigley seconded the motion. Councilman Feldman requested that City Administrator Dave Johnston highlight the significant changes between the two bills. Mr. Johnston stated the new version contained more specific information regarding the establishment of the insurance fund and the acceptance of the Safety Mutual Insurance Company. As there was no further discussion, the motion to substitute was approved and Bill 91-33 was read third time by title, placed on final passage, and passed as amended by the following vote as Ordinance No. 11598. President Pro Tempore Owens announced that Councilman Woodman had '1! requested Councilman Haake act as co-sponsor on this bill. 1 Councilman Haake requested this bill be removed from the Informal H; Calendar for passage and approval at this time. Councilman Vincent requested Marty Brose, Director of Transportation, report to the Council on how the construction on - , -4.40 A.46 A 1 1 9 REGULAR COUNCIL MEETING, JUNE 24, 1991 the Riley Parking Lot is progressing and the quality of the work at this time Mr. Brose reported that the work is progressing very well and that the quality of the work is good. Mr. Brose stated that the work should be completed by the end of July or the first of August. Councilman Vincent questioned whether or not the time allotted for tc; 4 r the Jefferson Street parking garage has enough time allotted for construction. Mr. Bross stated that there were 150 days and that '7,WA all the contractors who were bidding on the project believed this to be an acceptable amount of time Councilman Halsey stated he did not feel comfortable voting on this bill tonight as the Council had not been given any information regarding the estimated revenues on the Riley Lot and the revenue received from the parking garage. Councilman Halsey stated the Council had requested this information at the last meeting and it should have been included in the Council packets. Councilman Halsey stated he believed the Council needed to proceed with care on this issue. Councilman Feldman questioned how much of the liquidated damages has boon received from JCT for the parking garage on Madison Street. Mr• Brouc stated that no money has boon received, but that the City would wait until the completion of the project and then settle the balance. Councilman Feldman stated he was concerned about the City's continuing to do business with a contractor which the City continually has problems. Councilman Schoulen stated ho believed it unfortunate that the Council continues to bring up the issue with JCI . Councilman Scheulen stated that the Council had recently passed a debarment bill and that if they feel it in warranted, they should begin proceedings against JCI and nettle the issue. Councilman Scheulen stated that the Jefferson Street parking lot has been promised to the businesses in this area for several years and that it was needed and there was no reason to keep putting it off. After further discussion as to the need for the garage and the current income from the Madison Street parking garage, City Administrator Dave Johnston stated that there was sufficient money left from the bond coverage to proceed with the Jefferson Street garage. Mr. Johnston stated that there should be a balance left at the end of the construction period of one million dollars. Councilman Haalce seconded the motion and it was approved. , vc Councilman Mason moved approval of RS91-9 regarding c;mtinued } participation in the Narcotics Control Assistance Program by the is Police Department. Councilman Halsey seconded tha motion and it `'3= was approved. � `' ' rt� Councilman Wrigley moved approval of RS91-10 regarding the y declaration of July and the Recreation and Parks Month. Councilman .1 Halsey seconded the motion and it was approved. ` `l UNFINISHED BUSINESS: ',;i `ti Councilman Halsey stated he wanted to caution the redistricting -`';;`-'`1 committee about the possibility of potential problems in ° " considering the issue of counting prisoners for boundary purposes. ,;;` Councilman Halsey stated the committee needed to investigate this issue closely so that the City would not loose revenue. ri:; Councilman Halsey stated that hr.- had received a number of complaints regarding the lack of regulation of utility linemen for TCI. Councilman Halsey rcxiuested an ordinance be drafted for introduction at the next Council meeting establishing guidelines r,, for the regulation of utility linemen. . Councilman Halsey stated he would like to see an evaluation done of JCTV - Channel 3 . Councilman Halsey stated he believed there was a lot of repetition in programming and believed the public would like to see more versatility. Councilman Vincent stated that part of the problem is that JCTV operates on volunteers and that the , ' type of programming that many individuals want will require a lot more participation from organizations. Councilman Vincent stated these organizations would need to send persons to JCTV for training on the operation of the cameras and equipment. After some discussion on the reports the City receives from TCI, Councilman Halsey moved that the City receive a certified audit for T income in the Jefferson City area from TCI . Councilman Gordon seconded the motion. Councilman Vincent spoke against the motion stating he believed the Council to be duplicating the work of the III Cable Quality Commission. Councilman Vincent stated that the sub- committee of the Cable Quality Commission responsible for joverseeing franchise compliance has been actively pursuing this ` endeavor and monitoring all reports that TCI is required to provide. Councilman Halsey withdrew his motion and Councilman Gordon withdrew his second. 121 REGULAR COUNCIL MEETING, JUNE 24, 1991 # # # President Pro Tempore Owens announced that the Redistricting . Committee would be meeting on Wednesday, June 26, 1991, at 5: 30 p.m. in the Main Conference Room at City Hall. # # # Councilman Vincent requested that the financial information available on the construction of the parking garage be placed in the Council packets in the future for their perusal prior to the Council meeting. # # # President Pro Tempore Owens reminded the Council of the Public Hearing on July 8, 1991, at 7: 00 p.m. to discuss the "burning ban". # # # Councilman Feldman stated that he had received a number of phone calls from constituents regarding the problems with the Library. Councilman Feldman stated the he as a Councilman does not have enough information to know what is going on to be able to answer the questions. Councilman Feldman stated he would like to have representatives from both sides of the issue to come and address the Council so they are able to answer questions asked them by the constituents. Councilman Wrigley stated ho agreed with Councilman Feldman and asked City Administrator Dave Johnston if it would be possible for him to invite representatives from both aides of the issue to come to the next Council meeting. After further discussion, Councilman Feldman moved to have the Chairman of the Jefferson City Library Board and the President of the Regional Board to come and make a presentation to the Council at the next meeting. Councilman Wrigley seconded the motion. After discussion as to whether or not the Council will be able to obtain the desired information and who should be invited to attend the meeting to provide an overview of the two sides, the motion was approved with Councilman Halsey casting the only dissenting vote. NEW BUBINEBO: Councilman Feldman moved that the Council Meeting of July 1 be canceled and the only Council meeting for July be July 15, 1991. Councilman Haake seconded the motion and it was approved.
