A Council Meeting of August 19, 1991, was called to order at 7 : 00
P.M. with Mayor Louise Gardner presiding. a
The following Council Members were present:
, Present: Feldman, Gordon, Haake, Halsey, Owens, Scheulen,
Vincent, Woodman and Wrigley.
Absent: Mason. ? _
Councilman Vincent moved the Council go into Executive Session to
discuss Litigation as provided for in RSMo. 610. 025 (1) , and to
waive the requirements of Sec. 2-69 (c) of the city Code.
Councilman Wrigley seconded the motion and it was approved by the
following roll call vote:
Aye: Feldman, Gordon, Haake, Halsey, Owens, Scheulen, Vincent,
Woodman and Wrigley.
Nay: None.

A Regular Council Meeting of August 19, 1991 , wan coiled to order
at 7: 30 P.M. with Mayor Louise Gardner presiding.
Prayer was offered by Reverend John Blonde, Associate Pastor: First
Assembly of God.
The Pledge of Allegiance was led by City Administrator Dave
Johnston.
The following Council Members were present:
Present: Feldman, Gordon, Haake, Halsey, Owens, Scheulen,
Vincent, Woodman and Wrigley.
Absent: Mason.
A quorum was declared present.
RESOLUTIONS:
Mayor Gardner announced that if there were no objections from the
Council, she would like to consider Resolution 91-15 at this time.
Mayor Gardner read RS91-15 regarding the erection of a monument in
honor of those who served in Project Desert Shield and Desert Storm
and introduced Mr. Donald C. Otto, Jr. , who distributed to the
Council a drawing of how the monument would look and also a sample
of the granite that would be used in the construction of the
monument. Mr. Otto informed the Council that the funds had already
been raised for this monument and that all the City needed to do
was to provide the land for its construction. Mr. Otto stated that

Councilman Owens moved approval of RS91-15 and urged the Council to
adopt this Resolution and donate the land in front of the Police

PUBLIC HEARING:
There was a public hearing to establish the taxation rate for the , ; ,,
fiscal year 1991--92 . There was no one present to speak to this 4 : '
issue and the public hearing was concluded at 7 : 39 p.m. , ;

PRESENTATIONS FROM GALLERY: s.`!J
Mr. Daryl Glasscock, 1000 Country Ridge Drive, spoke to the Council 1
regarding the proposed sidewalks on South Country Club. Mr. i, 41
Clascock stated he felt the construction of the sidewalks on South M;r.
country Club Dt t.ve were for the greater good of the community. Mr. ,
Glarcock stated that an alternate route had been proposed, but that ' ` >1
the City had investigated this route and determined it was not an ,,i
accepted alternative. Mr. Ciaacoc;k :stated hu hoped the Council
would approve the construction of sidewalks on South Country Club ��$y i
Drive. -

Mr, Thomas berry, 1204 Moreland Avenue, spoke to the Council
regarding the proposed reappointments to the Jefferson City Library
Board. Mr. Berry encouraged the Council to approve those
reappointments stating this wou'd show the Hoard has a sense of
unity and purpose. ;
Mr. Herman Veith, South Country Club Drive, spoke against the
proposed construction of the sidewalks on South Country Club Drive. f
Mr. Veith stated he did not believe the proposed route was the
safest for the children.
Councilman Halsey requested the Mayor establish a policy of some
type of time limit for speakers in the future, especially those who
have addressed the Council regarding one issue on more than one
f`' occasion.

Councilman Woodman informed the Council the Appointments Review
Committee had met and had approved the appointments of Mr. Robuck
to the Cable Quality Commission and Mr. Asel to the Parks &
Recreation Commission. Councilman Wrigley moved item (d) 1269 -
Curb and Gutter Phase 1 , be removed from the Consent Agenda and
considered later in the meeting. Councilman Haake seconded the
motion and it was approved.
Councilman Gordon moved approval of the Consent Agenda with the
exception of item (d) 1269 - Curb and Gutter Phase 1 . Councilman
Vincent seconded the motion and it was approved.
BIDS/PROPOSALS OVER TWENTY-FIVE THOUSAND DOLLARS:
Councilman Halsey moved approval of Bid 1263 - Concrete and
Concrete Products, All City. Councilman Wrigley seconded the
motion and it was approved.

, i Councilman Gordon informed the Council that the Departmental Report
'1 for the Public Works Department indicated a recommendation that
Schumate Chapel Road and the Chesebrough-Ponds driveway be combined
, had been received. Councilman Gordon asked how the City went about 6n:.

s' Administrator, stated that at this time there were no monies
,, budgeted for this project and that negotiations could begin with

Project list at some future time. Councilman Gordon moved that the
4. City pursue this issue and begin negotiations with Chesebrough-
Ponds and see if the City can work this into the Capital
Improvements Projects. Councilman Wrigley seconded the motion and
it was approved.

Councilman Wrigley stated he would like to consider Bid 1269 - Curb
and Gutter Phase I, at this time. Councilman Wrigley stated there
was a math error in the calculation of the bid and that if the '
project were broken down into separate pieces, the City could save
$3 , 000 on one project.

particular project had boon bid as a total pr-ojcct, and that tsha
did not believe the City had reserved the right to break up the
project into separate entities. Mu. Ru;:s::;oll briefly explained to
the Council the bidding process and how sometimes contractors; will
include certain mobilization costs into one project bid a:; opposed
to charging each separate project.
Councilman Wrigley stated he understood the bid process and how
contractors bid projects, however, he did not believe it was right
for the City to bid several projects as one project without
' maintaining the right to award separate bids for each piece.
Councilman Wrigley stated he would not vote in favor of any bid of
this type in the future.
After further discussion on the bid process and the need for
sidewalks in this area and also in other school areas in the City,
Councilman Wrigley moved approval of the Consent Agenda (d) 1269 -
I Curb and Gutter, Phase I . Councilman Gordon seconded the motion
and it was approved.

Councilman Haake requested Bill 91-63 be reconsidered at this time
and requested a suspension of the rules. There was no objection , ,

NEW DIMNESS:
Councilman Wrigley questioned Tom Benton, Director of Planning and
Code Enforcement regarding a house on Frances Street that has
received considerable complaints. Mr. Benton informed the Council
the owner of the property had stated he would be residing in the
residence, however, there were several improvements that would need
to be made to bring the residence into compliance with City Codes.
Mr. Benton informed the Council the owner had thirty days in which
to make the improvements or further action would be taken against
the property.

Councilman Feldman questioned Mr. Benton regarding the gentleman
who is currently collecting recyclable items in the first, third
and fourth wards. Councilman Feldman stated the current procedures
are unacceptable and questioned whether or not the gentleman was
still in business. Mr. Denton did state he believed he was still
in business and that Planning and Code had spoken with him
regarding the situation. Mr. Benton stated the individual had been
informed if he did not improve his cervices, his business license
would be withdrawn. Mr. Denton stated that Planning and Code
Enforcement had not contracted with this individual to perform this
service and had very little control over him.
Councilman Vincent stated he believed the situation was
unacceptable. Councilman Vincent stated thin service should be
made available to all of Jefferson City, not just a portion of the
City.
Councilman Feldman stated the Solid Waste Committee would be
meeting on Wednesday, August 21, at 6: 30 p.m. , perhaps they could
discuss this situation at that meeting.

Councilman Halsey stated he had received a number of requests
regarding the process for recalling the burn ban that was passed by
the Council at the Council Meeting of August 5, 1991. Councilman
Halsey stated that those interested in this process should contact
Allen Garner, City Counselor, for his assistance in drafting the
petition.

Councilman Halsey stated that a meeting had been held to discuss
certain problems facing businesses and residents on the east side

. of the City. Councilman Halsey stated that there were some actions a
I the City could take, however, some of the businesses that operate
+I in that area might want to do certain things to ensure the safety
of their patrons, such as better lighting and tighter security.

Councilman Scheulen stated this is not an "east end" problem, but
a city problem. Councilman Scheulen stated referring to this as an 4
1 "east end" problem has had an adverse affect on property in that i
it area and that the problems being experienced are not located near ;i
the majority of the east end.
ICouncilman Halsey stated he agreed with Councilman Scheulen and '.i
f desired to see the problem treated as a problem for all of ',14 :
,1 Jefferson City, not just a portion of the City.

After further discussion on this issue, Mayor Gardner stated that '_
these issues could be discussed in more detail at the meeting for j
I? the housing concerns which would be scheduled in the future. j'
