4, A Regular Council Meeting of October 28, 1991, was called to order
at 7 : 30 P.M. with Mayor Louise Gardner presiding. This meeting was
due to the agenda having been tabled at the October 21, 1991,

Prayer was offered by City Clerk Brenda Cirtin.
The Pledge of Allegiance was led by City Administrator Dave
Johnston.
The following Council. Members were present:
Present: Feldman, Gordon, Haake, Halsey, Owens, Scheulen,
Vincent, Woodman and Wrigley.
Abse.;t: Mason.
A quorum was declared present.
PRESENTATIONS FROM GALLERY:
Mr. . ;Jack West, Chairman, Committee to Preserve Reprersenttative.
Government, react a letter, to the Council that contained a number of
mo:►r►altzr: from citizens who had circulated ated the i n i t i a t i v e to ropoa 1 '� <
the burn ban. Mr. West nt.tated that citizens did not feel that they
had been properly repr.e►%Ont:c'a.t and would like to have the bur ban
repealed immediately. Mr. West stated it was the desire of the
Committee to have a positive influence with the Council. and not -.
continue in an adversarial. role.
Councilman Feldman stated he believed the Committee's attitude of
their side is the only right side is irresponsible.
Councilman Vincent stated he believed the Committee had overlooked
the fact that these problems are going to be facing the Council
with or without burning. Not everyone is going to want to burn
their trash and leaves and recycling is still going to be needed.
Councilman Scheulen stated he did not have a problem with the
initiative petition process, but would like to see this Committee
take on the whole issue of solid waste with the same diligence,
complications and problems the Council has had to deal with, and
not just the one issue of burning.
Councilman Haake stated he did not believe the Council would be
fiscally responsible to all of the citizens if they spent money for
a special election for this one issue. Councilman Haake stated
this issue would be on the ballot, but not as a special election.

Mr. Bob Weber 2304 Yorktown Drive, spoke to the Council as a
representative of the Jefferson City Area Chamber of Commerce. Mr.
Weber informed the Council of the changes that had been made in the
selection of the City Employee of the Year and encouraged all of
the Council, staff and City employees to be in attendance at the
dinner on Tuesday, November 12, 1991.

Councilman Halsey questioned what the task of the Pro-Active
Prevention Committee would be and how long it was anticipated they
would be in existence. Mayor Gardner stated the Committee had not
met and been charged with their duties as it had not been approved
by the Council.
Councilman Gordon reviewed for the Council the areas of concern he
had suggested this Committee review and recommend policy changes.
Councilman Halsey stated he would be pleased to serve on this
Committee, but requested the City Administrator and the Police
Chief meet and set out timetables and guidelines for the work of
the Committee.
Councilman Haake moved approval of the Consent Agenda. Councilman
Woodman seconded the motion and it was approved.

ANNOUNCEMENTS BY MAYOR;
Mayor Gardner announced her intent to appoint Councilman Vincent,
Councilman Gordon, and Councilman Wrigley to the Search Committee
for the City Clerk. Mayor Gardner stated that if a motion was made
to approve a fourth member being added, she would appoint
Councilman Feldman.
Councilman Wrigley stated he did not have a problem with adding an
additional member to the Committee. Councilman Wrigley moved to
include one additional Council member in the Search Committee.
Councilman Haake seconded the motion.
it Councilman Halsey stated he believed it should be noted that
Councilman Wrigley and Councilman Gordon were from the same ward
and also that with a four member committee, there could be the

Councilman Haake seconded the motion. The amendment was approved fr

Councilman Owens moved the issue of the City Clerk selection review -k
process be sent to the Council of the whole, who will then select
a sub-committee of five members. Councilman Halsey seconded the
motion.
Councilman Vincent suggested to Mayor Gardner that since it was
known who the two additional members were that wanted to serve on
this committee, that she appoint these members to this committee
and circumvent this process.
After reviewing for the Council the history of this issue,
Councilman Feldman moved to amend the amendment to reduce the t .
number of persons on the Committee to three. Councilman Scheulen
seconded the motion. After some discussion, the Chair ruled the
amendment proposed by Councilman Feldman was an amendment to the
third degree and was an incorrect amendment.
Councilman Halsey called for the question, Councilman Gordon
seconded the call and it was approved.
The amendment to the motion to make it n Committee of the whole was
defeated by the following vote:
Aye: Halsey, Owens, Schoulon, and Wrigley.
Nay: Gordon, Haake, Vincent and Woodman.
Conflict: Feldman
The motion as amended was approved with Councilman Owens casting
the only dissenting vote.
Mayor Gardner called for a five minute recess. The meeting
reconvened at approximately 8:45 p.m.

Councilman Vincent stated he did not intend to place Bill 91-86 on
the Informal Calendar. Councilman Vincent stated the Redistrict
Committee had consisted of five republicans and five democrats and
that it had been a unanimous decision. Councilman Vincent stated
a public hearing on this map had been conducted and the Council had
had opportunity to review this map.
After further discussion about delaying action on Bills 91-85 and
91-86, Councilman Scheulen requested the opportunity to review the

City Planner Dick Preston presented the map representing this
redistricting plan to the Council and reviewed how the Committee
had arrived at its conclusion. After much discussion on the number
of individuals moved from the fourth ward into the fifth ward,
Councilman Vincent stated he was in favor of this plan as the
fourth ward was the fastest growing ward in the City. Councilman
Halsey stated that redistricting is not done for future growth, but
for present population. After further discussion, Councilman
Halsey called for the question. Councilman Gordon seconded the
call and it was approved. Bill 91-85 was read third time by title,

Bill 91-93, sponsored by Councilman Feldman, Scheulen, Vincent,
entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH LAIDLAW WASTE
SYSTEMS, INC. , TO ALLOW FOR ONCE A WEEK PICKUP AND CURBSIDE
RECYCLING.
Councilman Feldman requested this bill be placed on the Informal
Calendar.
Councilman Scheulen stated he would like to stress once again that
those two issues are not connected with the burn ban and whether or
not it in repealed. Councilman Scheulen stated these two issues
stand on their own merit .
Bill 91-94 , sponsored by councilman Feldman, Scheulen, Vincent,
entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE RECYCLING
COMPANY FOR THE DISPOSAL OF NEWSPRINT.
Bill 91-94 was read third time by title and placed on final
passage. Councilman Owens stated she supported this bill and
encouraged the Council to approve its passage. Councilman Haake
stated he believed the Council needed to give some consideration to
how this bill might affect the fire stations. Councilman Haake
stated they could begin to look like "city dumps" . Councilman
Haake moved to amend the time for leaving newspapers to every
weekend from 8: 00 a.m. to 4 : 00 p.m. Councilman Woodman seconded
the motion.
There was much discussion about the use of civic groups to assist ,'
in monitoring the items brought to the fire station and how the
City planned to educate the public on this issue. Councilman

Halsey called for the question, but the call was defeated.
Councilman Gordon questioned the need to involve the fire station
in this issue and if the public couldn't take their newspapers
directly to the vendor. Mr. Dick Sieburg, representative of
Laidlaw, stated the facility was too small and would not be able to
handle the volume of traffic this project could possibly produce.
Councilman Haake questioned if this covered magazines and
corrugated cardboard. Mr. Siegburg answered in the negative, � .
y stating the processing for these types of items was very costly.
After further discussion, the amendment was approved. Bill 91-94
was passed as amended by the following vote as Ordinance No. 11653 .
Aye: Feldman, Gordon Haake, Halsey, Owens, Scheulen, Vincent,
Woodman, and Wrigley.

Bill 91-60, sponsored by Councilman Halsey, entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , ADOPTING A BUDGET
AND PERSONNEL CLASSIFICATION PLAN FOR THE CITY FOR THE PERIOD OF
NOVEMBER 1, 1991, TO OCTOBER 31, 1992, AND APPROPRIATING MONEY IN
THE CITY TREASURY TO PAY THE COST OF OPERATING THE CITY GOVERNMENT
DURING THAT PERIOD IN ACCORDANCE WITH THE BUDGET.
Bill 91.-60 was road third time by title and placed on final
passage. Councilman Halsey moved Bill 91-68 be amended as follows:
1. Add $25, 000 to Police regular salary account.
2 . Add $25, 000 to special house demolition account in
Planning and Code Enforcement.
3 . Add $13 , 000 to professional services in the General
Fund's Non-departmental account for the public access
channel.
4 . Add $5, 000 to Parks capital for land acquisition from
Jefferson City Community Center.
5. Add $4 , 000 to equipment purchases in Engineering for
additional traffic counter.
6. Reduce $50, 000 in economic development in Non-
• departmental General Fund and identify the $50, 000 in the
MoDAG fund for the Chamber of Commerce economic
development contract.
' 7. Increase the revenue estimate from the cable television
franchise fee by $13 , 000.
8. Reduce the part-time without benefits salary in Public
Buildings by $4, 000.
9. Reduce the amount in professional services in Planning

and Code Enforcement by $5, 000.
10. Transfer $2, 000 from the City Administrator's budget to
the City Council's budget for National League of Cities
membership dues.
11. Amend Bill 91-68 by the adding a new Section 3 which
shall read as follows:
The personnel classification pay plan for the City of
Jefferson, Missouri, as contained in the budget shall.
become effective January 5, 1992 .
Councilman Owens seconded the amendment. Councilman Feldman
apologized to the Council for bringing this item up at this late
date, but expressed his concerns about supporting on-going expenses
with one-time monies. Councilman Feldman moved to amend the
amendment by removing the $25, 000 for Police regular salaries and
reduce the reduction of $50, 000 from MoDAG to $25, 000. Councilman
Scheulen seconded the motion.
Councilman Vincent spoke against the amendment stating the City
does have a problem in the f'oI _i.ce Department with keeping and
maintaining the officers and the council is not sure they are going
to need the economic development: monies.
Councilman Wrigley ;:gated he echoed the concerns of Councilman
Feldman and Councilman Wrigley, however, he would De voting against
the motion of Councilman Feldman stating he believed the more
proper approach would he to remove the $50, 000 MoDAG money but to
find the money some place else. Councilman Feldman withdrew his
amendment and Councilman Owens withdrew the second. After, further
discussion as to what this action would do to the budget approval
process and the end of the City's fiscal year, Councilman Wrigley
moved to amend the amendment by removing the MoDAG monies as a
revenue source to the proposed amended budget and instruct the City
Administrator to find another $50, 000, not using the MoDAG monies.
After further discussion of the need for the Council to review the
proposed changes, and the need to fund the additional officer in
the long range, Councilman Feldman asked what would happen if
action was delayed on this item until the next Council meeting.
Mayor Gardner stated the City would continue to operate in the
current budget. After further discussion on the need for staffing
in the Police Department so that the officers can be trained by
next summer, Councilman Wrigley moved to table all discussion on
the budget until the next Council meeting. Councilman Feldman
seconded the motion and it was approved with Councilman Halsey and
Councilman Owens casting the dissenting votes.

Bill 51-58, sponsored by Councilmen Halsey and Vincent, entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, LEVYING AND
ASSESSING A SPECIAL TAX BILL AGAINST THE LOTS AND TRACTS OF LAND
FRONTING AND ABUTTING CHESTNUT STREET IN THE CITY OF JEFFERSON, ,
MISSOURI, FOR THE IMPROVEMENT OF SAID ROADWAY.
Councilman Halsey requested this bill be removed from the Informal .

Councilman Halsey stated he had obtained some information that
indicated the individual assessed had not been notified of the
proposed improvements.
Councilman Vincent stated the City had given the required legal
notification required by the City and believed it should be
approved .
Councilman Halsey stated that in the future the Public Works
Department would notify the property owners that work was going to
be done on the property and that they would be assessed for the

Councilman Feldman questioned what would happen with the part of
the project that was annonned. city Adminintrator Dave Johnston
stated the City would pay the costs. Councilman Feldman questioned
• if anyone on the winning side would consider changing their vote
due to the tight budget constraints of this year. =
After some discussion with Bonnie Hubert, City Engineer, Councilman
Scheulen stated the City might have fulfilled their legal
obligation, but he was not sure they had met the moral and ethical 4
requirements. Councilman Scheulen stated he did not believe anyone
would want to be notified in the middle of the project or after the
project had been completed, they were going to be assessed for the
improvements.
After further discussion on the ramifications of the action the
Council took on this issue, Councilman Scheulen stated he would be
II willing to sponsor a bill to collect the monies from the Parks and
Recreation Commission as they received proper notification. ,.
Councilman Wrigley stated he believed this would set a precedent

for future projects. After further discussion on the notification,
the type of street this property is located on, the way other
property owners have been treated in the past, Councilman Scheulen
stated that he believed the individuals should have been notified
prior to the project. Councilman Haake stated that individuals on
other projects had not wanted their streets improved in this way,
but they had been done anyway and the individuals had paid for the
improvements. Councilman Scheulen stated that if they property
owners had been notified and given an opportunity to speak to this
issue, the Council might not have continued with the project and
the property owners should have been given the right to address the
issue.
UNFINISHED BUSINESS:
Mayor Gardner announced the Council had received the progress
report on the parking facilities construction in their packets.
Councilman Halsey questioned the amount of liquidated damages to
date. Director of Transportation Marty Arose stated the amount of
liquidated damages is $40, 600. 00 and will be deducted from final
payment.

Councilman Hanks asked if any investigation had boon done regarding
the suggestion for alternatives for paying the parking tickets.
Marty Bros ), Director of Transportation, stated that alternatives
have boon investigated and Mr. Drone will possibly be making a
suggestion to the Transportation Commission.

Councilman Vincent moved to amend Bill 91-42 to change the hours
for allowable burning to from sun up to sun down" . The motion was
seconded by Councilman Wrigley, but Mayor Gardner ruled this type
of amendment would require the introduction of an ordinance.
Councilman Vincent requested an amendment be prepared to amend the
bill restricting the hours for burning, changing them to "from sun
up to sun down", and the motion and second were withdrawn.
{ NEW BUSINESS:
Councilman Feldman moved to conduct a Public Hearing prior to the
next Council meeting on Monday, November 4, 1991, to discuss Bill
91-92 and Bill 91-93 , with a three minute time limit per speaker.
Councilman Vincent seconded the motion. Councilman Owens suggested
that those in favor of the bills and those opposed to the bills
might wish to choose five speakers to represent to two sides. The

Councilman Gordon moved Director of Finance Chuck Pierce be elected
the Employer's Representative to LAGERS Annual Meeting to represent
the City of Jefferson. Councilman Wrigley seconded the motion and P
it was approved.

City Administrator Dave Johnston reviewed for the Council his
memorandum recommending the delaying of the Ellis-Tanner Bridge
Intersection improvements. Councilman Wrigley moved to accept the
City Administrator's recommendation. Councilman Gordon seconded
the motion. Councilman Haake stated he would prefer to see this
referred to the Public Works Committee. After some discussion,
Councilman Gordon withdrew his second and Councilman Wrigley
withdrew his motion. Councilman Hooke moved to refer to the Public
Works Committee the recommendation of Mr. Johnston to delay the
Ellis-Tanner Bridge Intersection Improvements. Councilman Wrigley
seconded the motion and it was approved.
APPROVAL OF EXECUTIVE 8E8BION MINUTES:
Councilman Gordon moved approval of the Executive Session Minutes
of October 7, 1991. Councilman Schoulon seconded the motion and it
was approved.
ADJOURN:
As there was no further business to come before the Council,
Councilman Feldman moved the meeting be adjourned. Councilman
Wrigley seconded the motion and it was approved. The Council
meeting adjourned at approximately 11: 15 p.m. •
