Prayer was offered by Father Frank Westhoff, St. Peters Church. The Pledge of Allegiance was led by City Administrator Dave Johnston. i II The following Council Members were present: I Present: Feldman, Gordon, Haake, Halsey, Mason, Owens, • IScheulen, Vincent, Woodman and Wrigley. Absent: None. A quorum was declared present. . . it PUBLIC HEARING: The first item on the Agenda was a public hearing to discuss rozoning of a .967 acre tract of land at 1121 Southwest Boulevard from RS-2 , kjfg,i.Q_ ujiy.... .Q.1-. ,-n.U, to RA-2 , MIll..thltalMilidllg• Mr. Nathan Nickolaun spoke to the Council on behalf of the current owners requesting the approval of the rezoning. Mr. Nickolaus stated that 99% of the neighbors approved the rozoning and that ° Planning and Zoning had also approved the rezoning. There was no one to speak in opposition to the proposed rozoning and the public hearing on this issue ended at approximately 7 : 34 p.m. # # # 1 The second public hearing was to amend the zoning Code of the City M of Jefferson, Missouri, as it pertains to radio communication towers. Mr. Tom Hammonds, 707 Ihler Road spoke to the Council i; regarding the proposed amendments to the bill. Mr. Hammonds stated I; the amateur radio club supported the measurements of 70 feet in 11j height with the base of the tower not to exceed 3 feet in width. Mr. Hammonds requested the antenna being placed on top of the tower 11 I1 be limited to no more than 50 feet. (( After some discussion dealing with technical reasons for not . approving the limits set forth in the bill, Councilman Feldman . questioned if the amateur radio operators in Jefferson City have a significant impact on interfering with cable television. Mr. :i Hammonds stated there is no significant impact on television in ?! Jefferson City. I I c' it 211 REGULAR COUNCIL MEETING, NOVEMBER 4, 1991 Mr. Tom Benton, Director of Planning and Code, spoke in opposition to the measurements requested by the amateur club. Mr. Benton stated he believed the bill proposed measurements that could not be exceeded without prior approval of the Board of Adjustment. Mr. Benton stated that this allowed neighbors in the area of the proposed tower to voice their objections to its erection. Councilman Scheulen stated he believed neighbors would voice some objections to having seventy foot towers erected in their neighborhoods. After further discussion, Councilman Woodman stated it was his intent to place this bill on the Informal Calendar. He also informed the Council there were two or three such towers in his neighborhood and there had not been any complaints from the neighbors. Councilman Vincent requested a suspension of the rules for this bill to allow for the burning of leaves. There was no objection to the suspension of the rules. Bill 91-100 was read third time by title and placed on final passage. Councilman Feldman moved Bill 91-100 be amended to allow burning for an additional twenty weeks from November to April . Councilman Scheulen seconded the motion. After some discussion on the effect this amendment would have on the original ordinance and on the ballot issue for April, the motion was approved. Bill 91-100 was read third time by title, placed on final passage, and passed as amended, by the following vote as Ordinance No. 11655. Aye: Feldman, Gordon, Haake, Mason, Owens, Scheulen, Vincent, and Wrigley. Nay: Halsey. After some discussion on what the time allowed for burning as per { the amendment, Councilman Wrigley moved to reconsider Bill 91-100. Councilman Scheulen seconded the motion and it was approved. With j the Ordinance as amended back on the Council floor, City Counselor Allen Garner explained what the bill as passed would allow. Councilman Scheulen seconded the motion and it was approved. Councilman Vincent moved to amend Bill 91-92 by amending Section 30-29, Line 20, to change from one year to two years and on line 44 to change from one year to two years. Councilman Feldman seconded the motion and it was approved. Councilman Vincent moved to further amend Bill 91-92 by amending ,1 .' Section 30-30, Insurance, to require the same requirements in the current contract with Laidlaw, requiring $250, 000 per person; $500, 000 per accident; $100, 000 property damage and a $1, 000, 000 umbrella with a $25, 000 self-insured retention. Councilman Feldman seconded the motion and it was approved. Councilman I-Iaake moved to further amend Bill 91-92 by amending Section 30-20, Definitions, by amending the definition for Recyclable Materials, to allow the City to choose what materials are to be recycled, as opposed to the Collector. Councilman Feldman seconded the motion. After some discussion, City Counselor 219 REGULAR COUNCIL MEETING, NOVEMBER 4 , 1991 Allen Garner explained what the amendment would accomplish and informed the Council if it became necessary to amend the bill by adding to the list of recyclables, they could do this at some future date. Councilman Haake withdrew his motion and Councilman Feldman withdrew his second. Bill 91-92 was read third time by title, placed on final passage, and passed as amended by the following vote as Ordinance No. 11658. Aye: Feldman, Mason, Scheulen, Vincent, and Wrigley. Nay: Gordon, Haake, Halsey, Owens, and Woodman. Mayor Gardner voted "Aye" , breaking the tie. # # # Bill 91-93 , sponsored by Councilman Feldman, Scheulen, Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH LAIDLAW WASTE SYSTEMS, INC. , To ALLOW FOR ONCE A WEEK PICKUP AND CURBSIDE RECYCLING. Councilman Feldman requested this bill be removed from the Informal Calendar. Councilman Hoak° stated ho did not approve of going to the once--a--week pickup. Councilman Feldman stated that Cole County has had once-a-weak pickup for several yearn and it has worked very wall . After further discussion on this issue, City Administrator Dave Johnston stated the Council needed to make a policy decision as to which provision of the Contract they would choose if the burn ban was repealed. Mr. Johnston distributed to the Mayor and Council copies of the two versions of paragraph 51 of the proposed contract and requested the Council choose which paragraph they wished to adopt. After some discussion, Councilman Feldman moved to adopt Section A. Councilman Haake seconded the motion and it was approved by the following vote: Aye: Feldman, Haake, Halsey, Mason, Owens, Vincent, Woodman and Wrigley. Nay: Gordon, Halsey and Scheulen. Nay: Gordon, Haake, Halsey, Owens, Woodman, and Wrigley. # # # 220 REGULAR COUNCIL MEETING, NOVEMBER 4, 1991 Councilman Owens questioned Mr. Dick Sieburg regarding the possibility of Laidlaw instituting a recycling program inspite of the ordinance not being passed. Mr. Sieburg stated that Laidlaw would offer a recycling program if they could get a firm commitment from 3,000 of its customers. Mr. Sieburg stated the cost would be $2 . 62 per month and that a portion of that would have to be paid in advance. Councilman Halsey moved this bill be removed from the Table and placed on the Informal Calendar until Wednesday, November 6, at 7:00 p.m. when a Finance Committee Meeting will be conducted to review the proposals suggested by Mr. Johnston, The Finance Committee Meeting will be followed at 8:00 p.m. by a Special Council Session to consider approval of Bill 91-68 . Councilman Haake seconded the motion and it was approved by the following roll call vote: Aye: Feldman, Gordon, Hooke, Halsey, Mason, Owens, and Woodman. Nay: Sch©ulen, Vincent and Wrigley. RESOLUTIONS: Councilman Haake requested RS91-16 Capital Improvement Sales Tax Projects be placed on the Agenda for discussion at the Finance Committee Meeting. Councilman Wrigley questioned the appointment of the Search Committee for the City Clerk's position. Mayor Gardner stated she had not been able to contact a fifth Councilman and was not ready to appoint this committee at this time. ' NEW BUBINEBB: Councilman Halsey questioned where the City was in their lawsuit against the Department of Natural Resources regarding Senate Bill 530. After a brief review from City Counselor Allen Garner, Councilman Halsey moved to request the City Counselor to request a temporary restraining order in the case of Senate Bill 530. Hawke seconded the motion and it was approved. EXECUTIVE SESSION: Councilman Owens moved the Council go into Executive Session to discuss Real Estate as provided for in RSMo. 610. 025 (1) .
