The following Council Members were present: Present: Gordon,Haake,Halsey,Owens,Scheulen,Vincent,Woodman and Wrigley. Absent: Feldman, Mason. Councilman Haake moved the Council go into Executive Session to discuss personnel as provided for in RSMo. 610.025 (3), and to waive the requirements of Sec. 2-69 (c) of the City Code. Councilman Owens seconded the motion and it was approved by the following roll call vote: Aye: Feldman, Gordon, Haake, Halsey, Mason, Owens, Schouten, Vincent, Woodman and Wrigley. Nay: None. #### A Regular Council Meeting of December 16, 1991, was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by City Clerk Brenda Cirtin. The Pledge of Allegiance was led by City Administrator Dave Johnston. The following Council Members were present: Present: Gordon, Haake, Halsey, Owens, Schouten, Vincent, Wrigley and Woodman. Absent: Feldman, Mason. A quorum was declared present. Mayor Gardner introduced Boy Scout Troop 11 from First Baptist Church that was present in the meeting. Mr. Larry Dority, Scout Master; Mr. Steve Weber, Mr. Rich Shulz and Mr. Donnie Terry,Assistant Scout Masters, accompanied the troop to the meeting. PUBLIC HEARING: The first item on the Agenda was a public hearing on the rezoning of property at 722 Mulberry Street from RA-2,Multiple Family Residential,to C-2,General Commercial. There was no one present to speak either for or against the proposed rezoning. 244 REGULAR COUNCIL MEETING, DECEMBER 16, 1991 ! The next item was a public hearing on the annexation of property in Fainwood j; Subdivision, First Addition, except Lots 14 thru 21, Second Addition and Third Addition, and a 32.06 acre tract owned by Stadium West Properties; and a 1.73 acre tract owned by Charles J. Fain; and a 6.4 acre tract owned by Stadium West Properties. Mr. John Howland, 2726 Kenwood, representing the Fainwood • Homeowners Association spoke in favor of the proposed annexation. • • There was no one present to speak in opposition to the annexation. The Public Hearings concluded at approximately 7:40 p.m. PRESENTATIONS FROM THE GALLERY: Mr. Richard Cranford, Chairman of the Board of Directors for the Convention and Visitors Bureau, stated he was there to respond to any questions the Council might have rego,d.'ng the proposed budget. There were no questions from the Council and Councilman Wrigley moved adoption of the proposed budget. Councilman Halsey seconded the motion and it was approved. • CONSENT AGENDA: The Consent Agenda consisted of the following items: a) Council Minutes of 12/2/91 b) Monthly Financial Statement - October c) Appointments to Boards and Commissions Cable Quality Commission - Grayson Peters (reappointment); Term to expire 6194 d) Approve termination of Air Service Study Agreement with Greater Lake of the Ozark Convention and Visitor Bureau, Inc. • • City Administrator Dave Johnston requested item (d) be removed from the Consent Agenda and discussed later in the meeting. City Councilman Jim Woodman stated the Appointments Review Committee had met and discussed the reappointments and appointments and was recommending approval. Councilman Halsey questioned what Councilman Haake was trying to accomplish with this bill. After some discussion as to the purpose of this bill and who would make the determination as to who should serve on the committee, Councilman Wrigley moved to amend Bill 91-121 to name the senior council member as the committee member, with the junior council member serving as the alternate. Councilman Haake seconded the motion. After further discussion on the amendment and the reasons for keeping the Public Works Committee as a committee of the whole, the motion was defeated. Councilman Vincent stated he believed it was important, to have the Council involved its this issue as it ban to be dealt with. After further discussion on the problem of Solid Waste and the need for both citizen input and Council influence, Councilman Schouten called for the question. Councilman I-lalsey seconded the call and it was approved. Bill 91-127 was defeated by the following vote: Aye: Gordon, Vincent, and Wrigley. Nay: Bunke, Halsey, Owens, Scheulen and Woodman. Councilman Henke stated he would like to see the Solid Waste Committee appointed in the same manner as other Committees with a Council representative on the Committee and the rest citizens from the community. After further discussion, Councilman Scheulen moved to have a Committee of the Whole serve as the Solid Waste Committee. Councilman Vincent seconded the motion and it was approved with Councilmen Haake and Woodman casting the dissenting votes. City Counselor Allen Garner reminded the Council this would take an ordinance to implement the change and this would be drafted for introduction at the next Council meeting. Councilman Wrigley spoke against the motion stating this was economic development and would promote tourism in Jefferson City. After discussion on the need to clean up the riverfront, Councilman Halsey moved to amend the motion to include Adrian's Island as a separate ballot issue for Economic Development. Councilman Haake seconded the motion. Councilman Owens requested a legal opinion from City Counselor Allen Garner as to whether or not they could proceed in this manner. Mr. Garner stated that this would be possible, but would require passage of an additional ordinance, the amendment of a bill passed at this meeting. Mr. Garner stated that under the Hancock Amendment, the City could not exceed the total percent of the tax (1/2 of one percent). After much discussion which included the dates for filing the ballot with the County, the need for additional ordinances and resolutions, and the possibility of placing these monies in a land development fund, Councilman Halsey withdrew his amendment. and Councilman Haake withdrew his second. The motion was defeated by the following vote: Aye: Haake, Halsey, Owens, and Scheulen. Nay: Gordon, Vincent, Woodman and Wrigley. Councilman Wrigley moved approval of Resolution 91.118. Councilman Owens seconded the motion and it was approved. UNFINISHED NEW BUSINESS: Marty lirose, Director of Transportation, reminded the City Council there was a ribbon cutting ceremony at the Municipal Parking Garage at 10:00 a.m. on Wednesday, December 18, 1991. Councilman Gordon requested City Administrator, Dave Johnston, contact San Joaquin, California, to obtain information about their auxiliary persons that assist the police force in mundane tasks, Councilman Gordon also requested Mr. Johnston to contact Washington, D.C, to obtain information regarding their innovative shoplifting laws. Councilman Gordon moved to amend the property recognition awards program be expanded to include the following three categories: 1) Single family rehabilitation i 2) Multi-family rehabilitation(above duplexes) !i 3) Commercial rehabilitation • and that the Planning & Code Enforcement Department recommend some type of an award or recognition that could be presented to these individuals so their efforts do 1 I not go unnoticed. Councilman Halsey seconded the amendment and it was approved. The motion as amended was approved. ### Mayor Gardner requested Police Chief Gary Kempker report to the Council on the two groups that assist the Jefferson City Police Department. ### (; Councilman Scheulen stated he continually receives calls from his constituents requesting that the media and the Council not refer to that area of town as the near east side and the cast side. Councilman Scheulen requested that when an incident occurs on a specific street that be reported, not generalized. Councilman Scheulen cited an incident that had occurred on the west side, however, the media cited the street the incident had occurred on and did not refer to it as the "near west side". Councilman Scheulen requested this policy be adopted by the media in all areas of the City. NEW BUSINESS: Councilman Vincent stated he would like to address the Capital Improvements Sales Tax issue by reminding the citizens that only 50% to 60% would be paid by the City residents and the remainder would be paid by other individuals doing business in our City. 111111 City Administrator Dave Johnston reported to the Council on the request from the Lake Ozark Chamber of Commerce to terminate the contract for the Air Service Study. After a review of the process and the request from the Lake Ozark Chamber of Commerce, Mr, Johnston stated his recommendation was to approve termination of the contract and to refund one-third of the cost, which is a total of $1.665.00. Councilman Halsey moved to accept the City Administrator's recommendation to terminate the contract and refund $1,665.00 to the Lake Ozarks Chamber of Commerce. Councilman Woodman seconded the motion and it was approved. ### President Pro Tempore Judy Owens presented to Brenda Cirtin, City Clerk, a gift on behalf of the City Council for her service to the City during the last six years. Mayor Gardner presented to Ms. Cirtin a Key to the City and wished her well in her future endeavors. The Council meeting adjourned at approximately 9:30 p.m. ACTION TAKEN IN EXECUTIVE SESSION: • Councilman Scheulen moved the City Administrator Dave Johnston be given the one ;t percent cost of living raise that is to be given to all City employees effective in January and also a bonus of$500.00, in keeping with the personnel policy for those employees that have reached the top of their salary range.
