PUBLIC BEARINGS: A public hearing was held on the proposed rezoning of property at 219 Sohumate Chapel Road from RS-2, Single Family Residential to C-1, Neighborhood I Commercial. (Bill 93-74) No one spoke in favor or in opposition to the proposed rezoning. 11 A public hearing was held on the proposed rezoning of property at 1750 Tanner Bridge Road from RA-2, Multi-Family Residential, to PUD, Planned Unit Development. (Bill 93-76) No one spoke in favor or in opposition to the proposed rezoning. A public hearing was held on the proposed 1993 Property Tax Levy. (Bill 93-79) Mr. Marion Miller, 1700 Overlook Drive, appeared before the Council to object to certain properties being classified as "residential" instead of"commercial." He cited 11 , the Southwest DeVille Apartments and the Jefferson City Country Club as examples. No one else spoke in favor or in opposition to the proposed tax levy. Doerhoff, Alternate, term expires 9/94 g) Request by Councilman Halsey for a City key to present to a member of the Black Caucus Councilman Nilges commented on Bid 1418 Vehicle Hoist which resulted in a negative amount of $14,893 in the budget account. Acting Public Works Director Marty Brose stated that the equipment would be purchased from a grant and a transfer is planned to cover the negative amount. Councilman Nilges objected to this practice and Councilman Bernskoetter agreed. City Administrator Dave Johnston stated that in the future a thorough explanation would be given. Councilman Green moved for approval of the Consent Agenda Items, second by Councilman Halsey and !I approved, i! 144 REGULAR COUNCIL MEETING, AUGUST 16, 1993 APPROVAL OF BIDS OVER $26,000 Councilman Nilges commented on Bid 1411 - Heavy Duty Truck for Public Works, Wastewater Division, which resulted in a negative balance in the budget account for purchase of vehicles. He requested in the future that a better explanation be given for the expenditure and why it was not included in the annual budget. Councilman Halsey moved to table Bid 1411 until more information is given to Council, second by Councilman Wrigley and approved. Councilman Bernskoetter moved for approval of Bid 1274 - Renewal of Bid for Hydrated Lime from Mississippi Lime Co., for Public Works Department, second by Councilman Green and approved. MINUTES/REPORTS RECEIVED AND FILED: Mayor Gardner announced the following minutes/reports had been received and were on file in the office of the City Clerk. ANNOUNCEMENTS BY MAYOR: Mayor Gardner announced that a photo session is planned for 7:15 p.m. on September 7, prior to the Council meeting. Mayor Gardner announced that copies of the proposed 1993-94 Budget had been distributed to Council members. She thanked staff for their assistance in preparation of the proposed budget. Councilman Nilges asked how many neighbors had requested this residential permit parking. Acting Public Works Director Marty Brose stated that the majority of residents had signed the petition. He estimated 30 parking spaces were involved and 12 households. Councilman Nilges asked if some of the parking spaces could remain available to non-residents. Councilman Haake asked that the residents be contacted regarding a compromise. Councilman Bertel is in favor of granting the residents their request to protect the quality of the neighborhood. Councilman Haake requested Bill 93-64 be placed on the Informal Calendar. Councilman Nilges requested Bill 93-50 remain on the Informal Calendar. 151 REGULAR COUNCIL MEETING, AUGUST 16, 1993 RESOLUTIONS: Councilman Bernskoetter moved for approval of Resolution 98.17, authorizing a Section 18 grant application with the Missouri Highway & Transportation Department, second by Councilman Byrd and approved. Councilman Byrd moved for approval of Resolution 93-18, recognizing the Post 6 Junior American Legion Baseball Team, ages 16 and under, for winning the 1993 Regional/National Junior American Legion Baseball Championship, second by Councilman Haake and approved. Mayor Gardner presented each member of the team and their coaches with a copy of the resolution and congratulated them on their achievement. Councilman Nilges moved for approval of Resolution 93-19,recognizing Phil Jones, a world record holder in Taekwondo, for his participation in the Grandmaster H. U. Lee Scholarship Foundation, second by Councilman Bertel and approved. Mayor Gardner presented Mr. Jones with a copy of the resolution. UNFINISHED BUSINESS: Riverfront Development Contract City Counselor Allen Garner appeared before the Council to discuss a draft of the Riverfront Development Agreement with Becker Gaming Group which had been distributed to all Council members for their review. A longhty review and discussion followed. A Special Council Meeting is schedule for August 17 for further review and discussion of the contract. Flood Information It was announced that the Becker Gaming Group had donated $5,000 to the City's flood expenditures fund. Councilman Green asked that an ordinance be drafted to waive the fee for flood damaged property for six months. Councilman Halsey asked for the fiscal impact of such a policy. }MART Trailer Councilman Green moved to rescind the previous motion and to allow the Police Department to utilize the SMART Trailer at their discretion, second by Councilman Byrd and approved with Councilman Halsey voting nay. Vieth Drive Councilman Nilges asked Allen Garner for the status of the neighborhood improvement program that he had requested for Vieth Drive. Mr. Garner stated he • 152 REGULAR COUNCIL MEETING, AUGUST 16, 1993 had requested material from other cities and had not yet developed a program for Jefferson City. Sick Leave Policy, Councilman Wrigley asked that an ordinance be drafted removing the restriction of requiring a physician's statement for absences immediately before or after a paid vacation or holiday. NEW BUSINESS: Moreau Drive Petition Councilman Haake stated he would deliver the petition from Moreau Drive residents '1 for sidewalks, curb and gutter work to the City Clerk. Gas Leak, Councilman Byrd commended Union Electric, the Fire Department, the Police Department and the National Guard for their efforts during a gas leak in the 1300 a block of Dunklin Street on August 6. Finance Committee Councilman Bertel announced that the Finance Sub-Committee meeting scheduled for August 17 is cancelled and rescheduled for Monday, August 30 at 7:30 p.m. ?i CITIZEN PARTICIPATION NON-AGENDA ITEMS Richard S. Groner, 1301 E. High St., distributed a position paper on the recent flood and asked to discuss it with the Council at a later date.
