HomeMy Public PortalAbout19930920 170 REGULAR COUNCIL MEETING,SEPTEMBER 20, 1993 The Regular Council Meeting of September 20, 1993, was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by Councilman Bemskoetter followed by the Pledge of Allegiance. The following Council Members were present: Present: Benton, Bemskoetter, Bertel, Byrd, Estes, Green, Haake, Halsey, { Nilges and Wrigley Absent: None A quorum was declared present. SPECIAL PRESENTATIONS: Mayor Gardner presented Willard Relne and Mrs. Michael O'Rourke (accepting for Michael O'Rourke, deceased) with plaques and proclamations commending them for their service to the Fire Pension Board. PUBLIC HEARING: A public hearing was held regarding the proposed Zoning Code amendment by the addition of a new Conditional Use subsection e to Section 35-20(A)(2) and the re-lettering of the balance of the section. The new subsection will read as follows: e. Casino riverboat complex which may include casino riverboat dock, ticket sales and administrative office, restaurant, kitchen, bar or tavern, retail store, signage, amusement center, automobile and bus parking areas, and storage and maintenance building provided that the storage and maintenance uses are solely for the maintenance and storage of goods which are directly with the casino riverboat complex. David Brydon, Attorney, 312 E. Capitol, appeared before the Council as a representative for the Becker Gaming Group and to speak in favor of the proposed Zoning Code amendment. He announced that the Becker Gaming Group had filed their riverboat gambling application with the Missouri State Gaming Commission at 2:00 p.m. today. 171 REGULAR COUNCIL MEETING,SEPTEMBER 20, 1993 PRESENTATIONS FROM GALLERY: Pending Flood Lenislatiort Bob Shook, 2708 Wesley, appeared before the Council to oppose Bill 93-80 which would amend the Code to require building at the 500 year flood elevation. Councilman Green asked that Bill 93-90 be brought forward at this time for discussion. There were no objections. Councilman Green requested Bill 93-90 be placed on the Informal Calendar. Mr. Shook raised the following issues: 1. Not being able to obtain building permits to fix his flood damaged home. He is worried that the cold weather will set in before he has a new furnace installed. 2. Ordinance 10796 (Bill 86-192), approved March 16, 1987, pertaining to Flood Hazard Regulations, not being enforced by the City. 3. City employee stating the City could have his house bulldozed. Councilman Green asked that Mr. Shook be patient until the October 4 Council meeting when the issues will be resolved. Mayor Gardner asked Mr. Shook to attend the October 4, 1993 Council meeting, he agreed. Councilman Green gave a status report on Federal legislation proposed by Rep. Volkmer for flood assistance. Jim Kolb, Executive Deputy Secretary of State, appeared before the Council to oppose Bill 93-64, which allows Residential Permit Parking on Cliff Street. He stated that the Secretary of State employees objected to giving up 39 public parking spaces for 12 homes. Councilman Green moved for approval of Bid 0309 1' which was considered separately, second by Councilman Byrd and approved. i BIDS OVER$25,000 11 Councilman Wrigley moved for approval of the emergency change order to the Sewer District #8 Relocation contract with Don Schnieders Excavating Inc., authorization up to $30,000, second by Councilman Green and approved. The award will be presented to Lynne Bateman, Manager and Don lttner, Groundskeeper. The Commercial Landscape Design Award is sponsored by the Commission on Environmental Quality and selected by the Hawthorn Garden Club. Councilman Haake requested Bill 93-64 remain on the Informal Calendar to allow input from Public Works Director Marty Brose who was absent. UNFINISHED BUSINESS: City Plagues and City Keys Councilman Benton asked Councilman Wrigley, as President Pro Tempore, that a policy be developed for the granting of commemorative plaques and City keys. Councilman Nilges stated that a request had been made by the Finance Committee for staff to develop a policy for Council to award City keys in FY94. Councilman Wrigley stated that his position as President Pro Tempera did not give him responsibility for the awarding of City keys and plaques. He further stated that this responsibility currently rests solely on the Mayor. NEW BUSINESS: Special Tax Bilk 14387, Mr. Stephen Williams, representing the Bibleway Church of Our Lord Jesus Christ of the Apostolic Faith, inc., requested that the interest accrued on Special Tax Bill 14387 be waived. He paid $50.00 on September 20 and intends to pay $25.00 per month until completely paid off. He also commented that the improvements to Monroe Street had adversely affected the church property located at 900 Monroe Street. Councilman Wrigley moved to halt the accrual of interest until the dispute could be resolved, second by Councilman Byrd and approved with Councilman Benton voting nay. Councilman Wrigley requested that Mr. Williams attend the October 4, 1993 Council meeting, so that Public Works Director Marty Brose and Wastewaster Superintendent Tom Wallace could respond 178 REGULAR COUNCIL MEETING,SEPTEMBER 20, 1993 to the allegations. Mayor Gardner pointed out that the file regarding this case can be viewed in the City Cleric's office prior to the next Council meeting. Finance Committee Councilman Nilges announced that the next Finance Committee meeting is sceduled for ii October 12 at 7:00 p.m. APPROVAL OF EXECUTIVE SESSION MINUTES: Councilman Wrigley moved for approval of the August 16, 1993 Executive Session r Minutes, second by Councilman Byrd and approved. • N 1 Councilman Green moved for approval of the September 7, 1993 Executive Session I Minutes, second by Councilman Byrd and approved. a '-`, CITIZEN PARTICIPATION -NON-AGENDA ITEMS r Herbert Ault, 2111 Dalton Drive, Apt. G, appeared before the Council to discuss flood t disaster assistance. He previously lived in North Jefferson City. He stated that he had r. recently received $10,000 from FEMA for home repairs. He further stated he had contacted FEMA, District 7 in Kansas City, and asked if the money could be used for a I down payment on another home instead of repairing the flood damaged house. FEMA told him this would be allowed. Mr. Ault wanted the Council members to be aware of this assistance program in view of the pending flood plain clearance and hazard mitigation 1 program being considered by Council. Mr. Ault stated he did not have flood insurance. o' ADJOURN: There being no further business to come before the Council, meeting adjourned at approximately 9:00 p.m.
