REGULAR COUNCIL MEETING, JANUARY 10, 1994
The Regular Council Meeting of January 10, 1994, was called to order at 7:30 P.M.

;f Mayor Gardner expressed a welcome back to Councilman Tom Benton following his
recent surgery.
PRESENTATIONS FROM THE GALLERY: i
Mr. Brad Hutchinson, 3200 Pembroke Square, Jefferson City, MO, Chairman of the Ad
Hoc City Council/Parks & Recreation Committee, presented the Committee's report and ;!
thanked all the people involved in compiling the information that went into the report:
City Councilmen Dan Bemskoetter, Randy Halsey, and Rick Nilges, and Commission
members Anne Lock and Gene Bushmann. Mayor Gardner complimented the i
Committee on the thoroughness of the report. Councilman Byrd moved to accept the
report, second by Councilman Bartel, and approved.
Mr. Johnny Richardson, 131 Douglas Drive, Jefferson City, MO, President of the
Jefferson City Library Board, made a presentation on behalf of the City and County '!
Library Boards in their efforts to merge the two boards. He introduced members of both
boards who were present at the meeting: Jefferson City Library Board members Shirley
Powers, Mozelle Blelski, Ann Exon, Larry Rushing and Deborah Buckner; Cale County
Library Board members Jay Steppleman and Kay Coleman. After questions by
members of the Council regarding projected revenue, working relationships between
the Boards, and continuation of service to the public, Mayor Gardner commended Mr.
Richardson and members of the Board who were present for their hard work and the
ti informative materials provided to the Council for its consideration of the merger.

Mayor Gardner asked that Resolutions 93-30 and 93-32 be moved up on the agenda it
due to the fact that there were citizens present to accept the presentations of the

Resolutions. Councilman Green moved to consider the two resolutions out of order,
second by Councilman Bertel, and approved.

Resolution RS93-30 recognizing honors bestowed on the Jefferson City Jays Marching
Band. Councilman Wrigley moved for approval, second by Councilman Halsey,
approved, and presented by Mayor Gardner to Director Gene Kirkham, Drum Major
Matthew Dority, and other representatives of the Band. Councilman Green spoke as
sponsor of the Resolution, and offered his personal congratulations to the Band.

Resolution RS93-32, recognizing Navy Recruiter Bill Feller. Councilman Byrd moved
for approval, second by Councilman Halsey, approved, and presented by Mayor
Gardner to Mr. Feller.
CONSENT AGENDA:

Councilman Wrigley moved to remove Item (c) from the Consent Agenda for separate
consideration since the amount of bid Is over $25,000, second by Councilman Halsey,
and approved.
Councilman Wrigley moved io approve Items (a) and (b), second by Councilman
Halsey, and approved.
Councilman Wrigley moved that Council members be advised of any bids over $25,000 ;_
as soon as the City Administrator can make that Information available to the Council
but at least five (6) working days prior to any Council meeting. Second by Councilman
Halsey, and approved,
Councilman Wrigley moved to approve Item (c), bid for fire hose, second by
Councilman Nilges, and approved.

Ii ANNOUNCEMENTS BY MAYOR: �+
Mayor Gardner announced that since the seven-member First Responders 1!

} Subcommittee was approved at the February 22, 1983, meeting, one half of the citizens
have had to resign due to position requirements, leaving only two citizens. Councilman �!
1 Nilges moved to go ahead and appoint two more citizens, and the deadline be
i extended, seconded by Councilman Haake, and approved.
!+ Mayor Gardner reminded the Council of the following upcoming events : a) "A Taste of
!I Jefferson City" on January 12, b) City Hall will be closed on January 17 for Martin
Luther King Holiday, and c) January 20 Planning & Zoning Commission meeting to
explain the new"belt zoning" law. Mr. Green stated that, as Council's representative to
it the Planning & Zoning Commission, he would not be able to attend that meeting, and (�
requested that Mr. Nilges attend since he is the alternate Council representative. ;

Councilman Wrigley stated he would also like to invite Council members to attend the i!
jJanuary 18 meeting regarding the Main Street curb & gutter program, Boonville Road
project, and Industrial Drive asphalt overlay project at 7:30 p.m. at City Hall. ;!

INFORMAL CALENDAR
Bill 93-121, sponsored by Councilman Haake, entitled:
AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI,
BY ADDING A NEW SECTION 29-30 PERTAINING TO INSTALLATION OF AND
REIMBURSEMENT FOR BACKWATER VALVES.
Councilman Haake requested that Bill 93-121 be removed from the Informal Calendar.
Councilmen Green and Wrigley distributed copies of an amendment which they were
proposing. Councilman Green moved to amend Bill 93-121 as follows, seconded by
councilman Wrigley:
Amend section 1 by adding a new part 3 to Section 29-30 entitled "Backwater Valves
Installation Rebate Program"to read as follows:
3. Owners of residential property within the City who qualify for and participate
In the rebate program described in Section 29-30.1 shall be exempt from the
requirement that backwater valves be Installed so that access Is provided to
the working parts for service and repair as specified under Section P-1005.4
of the BOCA Plumbing Code as previously adopted by the City.

After discussion, Councilman Wrigley moved to amend the amendment as follows,
second by Councilman Green:

After a lengthy discussion, Councilman Wrigley stated he wished to withdraw his
amendment to the amendment, and Councilman Green stated he wished to withdraw
his second.
Councilmen Green and Wrigley both stated their concern regarding cost of access, and
felt the cost of the rebate should be increased.
Councilman Wrigley then moved to amend the amendment Increase the amount of
money paid by $100 to cover nominal costs In the placement of the tile, second by
Councilman Green, for discussion purposes, and called for point of order stating that
Mr. Wrigley's proposed amendment was to the original amendment, and that he now
wished to withdraw that original amendment, Councilman Wrigley withdrew his second
to the original amendment; Councilman Wrigley removed his amendment to the
amendment, and Councilman Green removed his second.
Councilman Green moved that the $200 rebate be Increased to $300, second by
Councilman Wrigley,
Councilman NIlges moved to amend the amendment to re-evaluate the rebate program
one year after the date of Its passage, second by councilman Bertel, and the
amendment to the amendment was approved.
The amendment was then approved, as amended, with Councilman Bemskoetter voting
nay.#'
Bill 93-121 was then read for the third time by title, and passed, as amended, by the

RESOLUTIONS:
RS93-29, Financial Support for Senior Nutrition Council, sponsored by Councilman
Nilges. Councilman Wrigley moved for approval, second by Councilman Green, and
approved.
RS93-31, Establishment of an Ad Hoc Charter Review Committee, sponsored by
Councilmen Benton and Bertel. Councilman Nilges moved to amend the Resolution as
follows, second by Councilman Wrigley:
"Amend Resolution RS93-31 by striking the language In Section 2, and adding the
following.
2. That the membership on this Ad Hoc Committee shall be limited to
Individuals who served on the 1985 Charter Commission, five (5) City
Council members, comprised of the senior councilman from each ward,
provided, however, If said councilman declines said appointment, then the
other councilman from that ward shall serve on the committee, and the
mayor.
...and by striking the language In Section 3, and adding the following:
3. That the Ad Hoc Committee shall elect from among Its members, co-
chairmen, one being from the 1985 Charter Commission and one from the
City council membership appointed to the committee, and such other ogicem
as it deems appropriate,
The motion to amend was approved by the following roll-call vote:

UNFINISHED BUSINESS
Councilman Bertel stated that one of her constituents had contacted her to ask the status of
the discussion regarding Lincoln University Homecoming activities, and she referred the
question to Chief Kempker and Councilman Halsey. Chief Kempker stated that the committee
had divided Into subcommittees, and the particular subcommittee he was a member of would
meet on January 11, and the whole committee would meet on January 20 at 12:00 noon.
Chief Kempker stated he would send the Council a memo updating them on the meetings.
Councilman Halsey Invited members of the Council and citizens of Jefferson City to attend the
meetings and encouraged their input.

NEW BUSINESS
Councilman Wrigley left the Council Chambers prior to the discussion of New Business due to I
a conflict of interest. Councilmen Benton and Halsey also left the Council Chambers at this I
time. City Administrator Dave Johnston explained the City of Springfield's request for
Jefferson City's participation in the Amicus Brief in Use Tax Case currently before the Supreme
Court. Councilman Green moved to approve the City's participation, second by Councilman !'
Nilges, and approved.
ADJOURNMENT
There being no further business, Councilman Green moved to adjourn, second by
Councilman Bertel, and approved. The meeting was adjourned at 9:30 p.m.
