i The Regular Council Meeting of October 24, 1994, was called to order at 7:30 P.M.
with Mayor Louise Gardner presiding.
Prayer was offered by Rev. Gary Murrell, followed by the pledge of allegiance.

Mayor Gardner recognized Cub Scout Pack 105 from the Cedar Hills School District,
and introduced pack leaders Darrell Bopp and Jim Jenkins.
Ron Meyer, Executive Director of the Missouri Consolidated Health Plan, was present
to speak regarding the Plan. After Mr. Meyer's comments, and a time of questions and
answers from the Mayor and Council Members, Mayor Gardner asked that, if there
were no objections, the Council would consider Resolution RS94-30 at this time in the
meeting. There were no objections to consideration of the Resolution at this time.
Resolution RS94-0, City to join Missouri Consolidated Health Care Plan - Councilman
Nilges moved for adoption, seconded by Councilman Byrd, and approved.
The Consent Agenda consisted of the following items:

Councilman Green asked questions of Fire Chief Rennick regarding the process for `=
interviewing and selecting an Assistant Fire Chief, and if the person selected met all
the required criteria. Councilman Nilges requested that Item (e) be withheld from the
Consent Agenda until the Council Members can receive a written job description on this
position and consider the interview and selection process as now exists. Councilman `

Councilman Jackson spoke of his concerns, regarding bills 94-118, 119, 120, and
possibly 121 which were introduced tonight. He felt discussion of the Commission's
recommendations was appropriate, but that ordinances requiring the people to vote on
these issues would not be appropriate. Rather, that the people should take necessary
action if they believed the Council was not doing what it is supposed to do. a;;
Councilman Halsey also expressed his concerns because some of the items addressed
had been tabled and not removed from the table for any action.

Councilman Halsey began discussion of Bill 94-105, at which time Councilman Nilges
called for a point of order regarding discussion of a bill that was placed on the Informal >'_';`+,;',-,.'•.
Calendar. Chair ruled that it was appropriate to discuss the issue as relative to the
(Councilman Bertel left the Council chambers at this time). Councilman
Green then called for an appeal on the decision of the Chair on the point of order,
Mayor Gardner stated that the Council should vote on the decision of the Chair

Councilman Halsey moved that Bill 94-105 be brought up for discussion at this time, •�.:,,, ,. .. ,E
seconded by Councilman Haake. After discussion, Councilman Green asked Cityj � A" ;
Counselor Allen Garner for his advice regarding the procedure for removing a bill from
j the Informal Calendar by the Council as a whole. Mr. Garner stated that it requires a
i vote of eight Council members to bring a bill off the Informal Calendar. After further
discussion, Councilman Halsey moved that Bill 94-105 be brought off the Informal
Calendar for a vote at this time, seconded by Councilman Haake. Councilman Halsey `
requested that City Counselor Allen Garner retrieve the written city ordinance
pertaining to the number of Council votes to bring a bill off the Informal Calendar.
When Mr. Garner returned, he read to the Council Section 2-84, subpart (f), which
stated that it did require a vote of eight Council members to remove a bill from the
Informal Calendar if not removed by the bill's sponsor. Councilman Halsey then
requested that an opinion regarding Council members being added to a bill as sponsor
from the Council floor, and specifically asked if Council could add sponsors to or delete
sponsors from a bill?. City Counselor Allen Garner as follows:
"In general that would be true, On a bill that's on the Informal Calendar, you may get a
different answor• As has previously been pointed out, the sponsorship rules are not
specifically reduced to writing in any ordinance form. There are references to sponsors,
but there are no specific provisions as to how one becomes a sponsor or how one
romoves ones name from a sponsored bill. 1 would point out that the bill is on the
informal Calendar, and assuming that you decide that you can add one or more
sponsors, you then got to the question of what happens if the sponsors are split on .;.'
whether or not they want to bring up the bill."
Councilmen Halsey and Jackson then requested to be placed on Bill 94-105 as
` sponsors, and that the bill be brought off the Informal Calendar and that it be voted on
. at this time. Councilman Green then requested that he be added as a sponsor to Bill
'.� 94-105, as well as Councilman Haake. Mayor Gardner requested that each Council >�
member present be placed on the bill as a sponsor. The Council consented to her
request unanimously, Councilman Green stated he wished to place Bill 94-105 back
on the Informal Calendar. Councilman Halsey stated he wished to remove the Bill from ,
the Informal Calendar, and moved that the bill be voted on at this time, seconded by
Councilman Jackson, and approved.
