HomeMy Public PortalAboutResolution 75-642 PC 9151- 9153 Las Tunas Drive CUP 75-451" 1 " 1 " 1 RESOLUTION NO, 75 -642 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A CONDITIONAL USE PERMIT IN ONE CONDITIONAL USE PERMIT CASE NO, 75-451 THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1e That the Planning Commission does hereby find, determine and declare as follows: (1) That the owner of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 9151 -53 Las Tunas Drive in said City, more particularly described as: Portion of Lot 13, Tract No 5905, Map Book 72, page 91 of Maps in the Office of the County Recorder, County of Los Angeles, State of California has heretofore filed an application for a conditional use permit to expand an existing bar - restaurant and to provide live entertainment; and (2) That the Planning Commission conducted a duly noticed public hearing on such application, that said hearing was duly closed; and (3) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each member of the Commission being familiar with the proposed site, said Commission deter- mined that the facts required by Section 9203 of the Temple City Zoning Code were present, and, therefore, the conditional use permit should be granted, except as to the request for live entertainment. SECTION 2. That the conditional use permit herein described be and the same is hereby granted subject to the following conditions: 1. That a new Exhibit "A" shall be submitted to show the correct property dimensions and the development of the property shall conform to said Exhibit; and 2. That a minimum combined total of 12 on -and off site parking spaces shall at all times be provided for said use, which spaces shall be improved in accordance with City standards and shall provide identification signs in a manner approved by the Planning Director; and 3. That documentation shall be provided which states that the applicant has access and use rights to the 6 (six) parking spaces across the street at the northwest corner of Loma Avenue and Las Tunas Drive and shall be furnished in a form satisfactory to the City Attorney; and 1 1 is 1 Resolution No. 75 ®642 PC 4. That the sale and /or consumption of alcoholic beverages on the premises shall be limited to beer and wine only; and 5, That one street tree be provided and planted on Las Tunas Drive as required by the City; and 6, That the proposed expansion shall conform to the existing Building and Fire Department regulations; and 7, That no live musical or theatrical entertainment shall be permitted; and 8, That all applicable City regulations shall be com- plied with; and 9. That this conditional use permit shall expire and be of no effect unless exercised within a period of one year from and after the date of adoption of resolution granting the conditional use permit; and 10. That the applicant shall file, or cause to be filed, with the City Clerk, a document which the City may record, which shall acknowledge that the owner of the subject property is aware of and accepts the conditions set forth in paragraphs 1 through 9 above, and that the subject property, regardless of any change in ownership, is bound by and subject to the provisions of the resolution granting the conditional use permit and the conditions contained therein. SECTION 3, The Secretary shall certify to the adoption of this Resolution, APPROVED and ADOPTED this 22id day of July, 1975. I hereby certify that the foregoing.
