AN ORDINANCE OF THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, PALM BEACH
COUNTY, FLORIDA, AMENDING CHAPTER 4
OF THE CODE OF ORDINANCES OF THE TOW14
OF GULF STREAM SO AS TO PROVIDE AN
INCREASE IN BUILDING PERMIT FEES;
PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, as follows:
Section 1.
Chapter 4, Buildings and Building
Regulations, of the Code of Ordinances of the Town of Gulf
Stream, Florida, is hereby amended at Section 4 -3 to read
as follows:
"Sec. 4 -3. Issuance of permits; Inspections.
Palm Beach County serves as the Town's Building
Official and shall issue all building permits
for construction in the Town. The Town of Gulf
Stream shall charge a fee equal to thirty percent
(30 %) of the fee charged by the Building Department
of Palm Beach County for the issuance of Building
Permits and shall issue a Building Permit Receipt.
In no event shall said fee be less than Fifty
Dollars ($50.00). The Town Manager or the
contractor will request the County Building
Department for inspection for a given time and
date and the permit inspection card and plan shall
be on the construction site at all times and the
inspector on completion of his inspection will
mark the card as to acceptance and the date
thereon, or will note reasons for rejection.
Upon completion of the project and final
inspection, the inspector will report this to
the County Building Department, which shall then
issue the certificate of occupancy to the builder.
In the event that there is a change in the initial
plans as approved, the contractor shall be required
to file said plan change with the Town. The fee
payable to the Town for review of said change
in plans shall be Ten Dollars ($10.00).
In the event contractor wishes to either demolish
or move a building or structure located within
the Town, a permit must be obtained from the Town
of Gulf Stream and a fee of One Hundred Fifty
Dollars ($150.00) shall be paid to the Town for
receipt of said permit.
In the event a construction trailer is parked
within the Town of Gulf Stream a permit shall
be required therefore along with approval of the
Town Commission, and a permit fee in the amount
of One Hundred Dollars ($100.00) shall be paid
to the Town. The permit will be valid for a period
of six (6) months.
In the event that a person fails to obtain a
Building Permit where otherwise required within
the Town of Gulf Stream, the penalty fees
applicable by Palm Beach County in the amount
of four times the regular fee due Palm Beach County
shall be paid. In addition, there shall be paid
to the Town of Gulf Stream a fee in the amount
of thirty percent (30%) of the fee due to Palm
Beach County."
Section 2. If any provision of this Ordinance or the
application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this
Ordinance which can be given effect without the invalid
provisions or applications and to this end the provisions
of this Ordinance are hereby declared severable.
Section 3. This Ordinance shall be codified and made
a part of the Official Zoning Ordinance of the Town of Gulf
Stream, Palm Beach County, Florida.
Section 4. This Ordinance shall take effect immediately
upon its passage and approval, as provided by law.
