HomeMy Public PortalAbout2012.002 - LSA (02-21-12)RESOLUTION NO. 2012.002 A RESOLUTION OF THE CITY OF LYNWOOD AS SUCCESSOR AGENCY TO THE LYNWOOD REDEVELOPMENT AGENCY ADOPTING A DRAFT RECOGNIZED OBLIGATION PAYMENT SCHEDULE WHEREAS, on December 29, 2011, the California Supreme Court issued its opinion in the case California Redevelopment Association, et a/. v Ana Matosantos, etc, et al, Case No S196861, and upheld the validity of Assembly Billxl 26 ( "AB1x 26 ") and invalidated Assembly Billxl 27 and extended certain deadlines in ABx1 26, and WHEREAS, the Court's decision results in the implementation of ABx1 26 which dissolves all the redevelopment agencies in.the State of California as of February 1, 2012, and WHEREAS, the City elected to serve as the Successor Agency to the Lynwood Redevelopment Agency and elected to have the Lynwood Housing Authority serve as the Successor Agency to the housing assets and functions previously performed by the Lynwood. Redevelopment Agency; and WHEREAS, ABx1 26 also requires successor agencies to prepare, by March 1, 2012, a draft Recognized Obligation Payment Schedule, and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD AS SUCCESSOR TO THE BOARD OF THE LYNWOOD REDEVELOPMENT AGENCY DOES HEREBY RESOLVE AS FOLLOWS. Section 1. Recitals The Recitals set forth above are true and correct and incorporated herein by reference Section 2. Approval to Adopt a Draft Recognized Obligation Payment Schedule The City as Successor to the Lynwood Redevelopment Agency hereby approves and adopts a Recognized Obligation Payment Schedule, in substantially the form attached hereto as. Exhibit A pursuant to Health & Safety Code Section 34177, and authorizes staff to make format changes as necessary Section 3. The City Clerk shall certify to the adoption of this Resolution Section 4. The City Clerk or designee shall post this Resolution and the Recognized Obligation Payment Schedule on the City's website and provide notice of the adoption of the Recognized Obligation Payment Schedule to the County Auditor-Controller and the State Department of Finance PASSED, APPROVED AND ADOPTED this 21" day of February, 2012.
