HomeMy Public PortalAboutOrd. 1650ORDINANCE NO. 1650 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTION 14 OF CHAPTER 14 OF THE LYNWOOD MUNICIPAL CODE REGARDING FATS, OILS AND GREASE MANAGEMENT AND DISCHARGE CONTROL WHEREAS, the City of Lynwood ( "City ") enacted Ordinance No 1636 regulating wastewater and /or waste discharge within the City under Lynwood Municipal Code Chapter 14 -14, and WHEREAS, staff has discovered that Ordinance No 1636 contained errors and /or mistakes that require corrections, and WHEREAS, the City Council now finds this Ordinance necessary to make those technical corrections. NOW THEREFORE, THE CITY COUNCIL OF THE CITY DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Subsection 14 -14 1D of the Lynwood Municipal Code is hereby amended by replacing "Articles 1 -20" with "Articles 1 -8 ", but with all other provisions of Subsection 14 -14 1 D remaining unmodified and in full force and effect. Section 2. Subsection 14 -14.2C of the Lynwood Municipal Code is hereby amended at item 11 by replacing "Food Service Establishment ( "FSE ") Facilities defined in California Uniform Retail Food Facility Law (CURFFL) Health & Safety Code § 113785" with "Food Service Establishment ( "FSE ") Food facilities defined in California Uniform Retail Food Facility Law (CURFFL) Health & Safety Code § 114094 ", but with. all other provisions of 14 -14.2C remaining unmodified and in full force and effect. Section 3. Subsection 14- 14.27B of the Lynwood Municipal Code is hereby amended by replacing "Chapter 1 04" with "Chapter 1 5 ", but with all other provisions of Subsection 14- 14.278 remaining unmodified and in full force and effect. Section 4. Except as expressly modified pursuant to this ordinance, all other provisions of Chapter 14 -4 shall remain unmodified and in full force and effect. Section 5. If any section, subsection, clause or phrase of this ordinance is for any reason, held to be unconstitutional, or otherwise invalid, such decision shall not affect the validity of the remaining sections of this ordinance 'The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 6. The City Clerk shall certify to the passage and adoption of this ordinance, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted This ordinance shall be in full force and effect thirty (30) days after its final passage and adoption, and within fifteen (15) days after its final passage, the City Clerk shall cause it to be published in a newspaper of general circulation. First read at a regular meeting of the City Council held on the 7th day of Februar7• 2012 and adopted and ordered published at a regular meeting of said Council on 215 day of February, 2012.
