AN ORDINANCE OF THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, PALM BEACH
COUNTY, FLORIDA, AMENDING THE OFFICIAL
ZONING ORDINANCE OF THE TOWN, ORDINANCE'
NO. 83 -1, SO AS TO PROVIDE FOR AN
INCREASE IN THE APPLICABLE FEES FOR
SPECIAL EXCEPTIONS AND VARIANCES;
PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; PROVIDING AND EFFECTIVE
DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. Ordinance 83 -1, of the Official Zoning
Ordinance of the Town of Gulf Stream, is hereby amended
at Section XIII, Board of Adjustments, Paragraph I, so as
to read as follows:
"I. Filing Fee
1. A filing fee of One Hundred
Dollars ($100.00) shall accompany
each request for the purpose
of covering the cost of
investigations, modifications
and other operations incidental
to the consideration of the
matter by the Board of
Adjustment. The sums thus
collected by the Board at the
time of application filing shall
be deposited with the Town and
placed in the general fund.
2. The applicant shall also pay
any additional costs incurred
by the Town for processing the
application or hearing and
deciding upon the request.
Said additional costs shall
be paid to the Town by the
applicant prior to the issuance
of a certificate of occupancy
for any development on the
property for which the variance
or special exception was granted,
provided, however, that said
variance or special exception
-request was approved."
Section 2. If any provision of this Ordinance or the
application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this
Ordinance which can be given effect without the invalid
provisions or applications and to this end the provisions
of this Ordinance are hereby declared severable.
Section 3. This Ordinance shall be codified and made
a part of the Official Zoning Ordinance of the Town of Gulf
Stream, Palm Beach County, Florida.
Section 4. This Ordinance shall take effect immediately
upon its passage and approval, as provided by law.
