WHEREAS, Lieutenant James Connolly has requested that the Borough of Carteret
provide for legal defense in a Municipal Court proceeding instituted against him as a
result of the performance of his duties; and
)YHEREAS, pursuant to N.J.S.A. 40A:14 -155 and the Collective Bargaining Agreement,
the Borough is obligated to provide said legal counsel to police officers charged with a
criminal offense while in the performance of their duties; and
WHEREAS, pursuant to Ordinance 4 194 -59 the Mayor and Council of the Borough of
Carteret have established a rate to he paid to attorneys Erred to provide said defense at a
rate of 5125.00 per hour not to exceed 5500.00 for any case adjudicated by any municipal
court in the State of New Jersey; and
WHEREAS, the Chief Financial Officer has certified that funds are available for same;
and
WHEREAS, Lieutenant James Connolly has requested the legal representation of Darren
M. Gelber, of Wilentz, Goldman & Spitzer, PA.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough
of Carteret that the appointment of Darren M. Gelber to provide legal defense for
Lieutenant James Connelly is hereby approved; and
BE IT FURTHER RESOLVED that the ivlayor and Purchasing Agent are hereby
authorized to execute a contract for such services in a total amount not to exceed 5125.00
per attached invoice; and
