RESOLUTION OPPOSING S -2114 AND A -3317,
PROHIBITING AIUNICIl'AL REGISTRATION OF MULT- FAMILY DWELLINGS
WHEREAS, current law requires the owners of residential, rental property containing three or
more units to register with the state and provide information about the property including the
name and address of the owner, the name, address and telephone number of an emergency
contact, and the property's fuel provider; and
WHEREAS, S -2114 and A -3317 would preempt any municipal ordinance requiring registration
for multi - family dwellings, defined by statute as three or more units; and
WHEREAS, S-2114 and A -3317 eliminates duplication and redundancy in registration of certain
apartments; and
WHEREAS, such registration is neither redundant nor at cross - purposes with registration
conducted by the state, municipalities conduct these registrations for a multitude of reasons all
centering on the health, safety and welfare of their residents; and
WHEREAS, this discretion enables some municipalities to keep a timely inventory of multi-
family dwellings in the community and minimize the instances of overcrowding, this option
assists municipalities in effectively regulating the quality of housing in the community and should
not be preempted; and
WHEREAS, the statewide registration of owners of residential rental properties with the
Department of Community Affairs is a necessary and appropriate task for state government; and
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of
Carteret strongly opposes S -2114 and A -3317; and
BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to the Governor of
the State of New Jersey, Senator Joseph Vitale and Assemblymen John Wisniewski and Craig
Coughlin, members of the Senate Community and Urban Affairs Committee, the members of the
Assembly Housing and Local Government Committee, Assemblymen Jerry Green, David Rible,
Scott Rumana, and the New Jersey State League of Municipalities.
