ADJOURNMENT - TO NEXT REGULAR MEETING ON JULY 8 1996 0 COMMUNITY CABLE ACCESS ADVISORY COMMISSION MINUTES OF THE MAY 13, 1996 MEETING The regular meeting of the Community Cable Access Advisory Commission of the City of Lynwood was held May 13, 1996, at the Lynwood Cable Studio. (The Agenda was duly posted as prescribed by the Brown Act.) Commissioner Bill Lewis called the meeting to order at 5.30 P.M. Commissioners in attendance were Ethel Pacheco, Bill Lewis, Ada McZeal, Bill Cunningham and A. Ann Fields was absent. Staff present were Johonna Jacobs - Howard, Ron Roberson and Serena Coulson. Commissioner McZeal motioned to approve the minutes of the April 8, 1996, meeting. Commissioner Cunningham seconded the motion. Correction to April 8, 1996 minutes of CCAAC Meeting I. Scheduled Matters, Section A. Discussion on Cable Franchise Agreement Added correction: Page 3, paragraph 3, line 4, that states; Than after that it would be either $57,713 or 5% of the gross annual revenue. Instead it should read; Then after that it would be either $57,713 or 5% of the gross annual revenue. I. INFORMATIONAL ITEMS A. Commissioner Lewis stated that due to his job schedule he will have to leave early and will turn the meeting over to Co- chairperson Ethel Pacheco Commissioner Lewis stated that the minutes are getting longer and it seems that there has been some trouble with the preparation of the minutes from some of the previous meetings. He suggested that it may help in preparing the minutes by not taking from the tape word for word quotes he suggested to summarize the discussions. Commissioner McZeal stated that one of the things that was discussed and agreed on the April 8, meeting was that we would not put the discussions on tape, but after the discussion is finished we would state what we would like to go on tape and to be put into the minutes. Commissioner Lewis asked how are the minutes recorded in the City Council meeting. Staff person Howard stated, by note taking and tape recording everything to indicate what has been stated, but they are not prepared word for word. Commissioner Lewis asked Staff person Howard if she would ask the minutes clerk for the CCAAC to do the same. Staff person Howard stated that this is the problem. Because of the technical information of the Cable Franchise Agreement it is difficult to know what to record and what not to record. Commissioner McZeal stated that the Cable Franchise Agreement is a one 0 • COMMUNITY CABLE ACCESS ADVISORY COMMISSION MINUTES OF THE MAY 13, 1996 MEETING time issue, she also stated that it is important to record all the details of the discussion. Staff person Howard stated that we are recording all of the discussion regarding the Cable Franchise Agreement, but we are paraphrasing at the end of each discussion so that the minutes clerk will know what to include in the minutes. II. SCHEDULED MATTERS A. Election of Officers Commissioner Lewis suggested to postpone agenda (Item A.) the Election of Officers until all the Commissioners are present and move on to agenda (Item B.) the Cable Franchise Agreement if there are no objections. Staff person Howard asked Commissioner Lewis if the agenda could be reordered so that the Lynwood Showcase could be viewed first. She stated due to the fact that Staff person Roberson has put in long hours he has requested to be excused after the viewing. Commissioner McZeal motioned to reorder the agenda seconded by Commissioner Cunningham. B. Preview of Lynwood Showcase #79 The viewing of Lynwood Showcase #79 included the following program segments: Earthquake Preparedness by William Cunningham/Historian Anti- Graffiti/Coloring Book Mana Restaurant/Mixer Circus Vargas Commissioner Cunningham stated that the Lynwood Showcase was very good. Commissioner Pacheco stated that the Lynwood Showcase was well done also. Commissioner Lewis stated that in the opening of the Lynwood Showcase he was wondering if there is a way to put up current graphics. He stated to the Commission that this is just something to consider He also stated that it might be better to say Lynwood Showcase and use the current month and year Commissioner McZeal stated that this would be misleading, because some of the events are a month old. Commissioner Lewis stated that it would not be misleading because this is our Lynwood Showcase for the month. • 0 COMMUNITY CABLE ACCESS ADVISORY COMMISSION MINUTES OF THE MAY 13,1996 MEETING Commissioner Lewis asked if Public Service Announcements (PSA's) are a requirement and does staff keep count of how many times an individual PSA is ran. Staff person Roberson answered no. Commissioner Cunningham asked what are PSA's? Commissioner Lewis stated that PSA's are Public Service Announcements. Commissioner Lewis stated that he does not know the requirements for PSA's and how many times they must run, but there may -- be ways to get in more show time.- Commissioner Lewis also stated that it -- would be important to indicate where the file footage for the earthquake preparedness segment was located and also what year it was. He also stated that by holding the sound for the anti - graffiti segment longer and by continuing the music in the closing, would hold the attention of the viewers. Commissioner Lewis turned the meeting over to the Co- chairperson Commissioner Pacheco. He stated that he had to return to work. Commissioner McZeal stated that on the introduction of the Lynwood Showcase in the Circus Vargas segment it is losing focus on the section with the tigers. Staff person Howard stated to Staff person Roberson that the Earthquake segment it should indicate where the file footage was obtained. C. Discussion on Cable Franchise Agreement Commissioner Lewis stated that he read through the minutes for the April 8, CCAAC meeting. He stated that is appears that some progress has been made in the review of the Cable Franchise Agreement. He stated that the Commission is going in the right direction, but we are going about it the wrong way He stated in the respect that there is already a really good agreement in place. Basically, what we need to do is not go over the Cable Franchise Agreement section by section, but take the substance of the agreement and that is to protect the public. Summarize it and then come up with a statement. He also stated that if we go through the Cable Franchise Agreement step by step we should highlight each section that we would like to see not only in the agreement; but also enforced. He stated that it is not up the CCAAC to draft the entire Cable Franchise Agreement, he stated what the City Manager is asking us to do is to give input on what we would like to see in the Cable Franchise Agreement. Commissioner McZeal stated that what we've done is highlight those sections that we want to discuss and to be enforced. She stated that we have gone over the general contract already Commission Lewis stated that all we can do is ask that our recommendations be considered as a part of the upcoming Cable Franchise Agreement. E u COMMUNITY CABLE ACCESS ADVISORY COMMISSION MINUTES OF THE MAY 13, 1996 MEETING Commissioner McZeal stated that most of the Cable Franchise Agreement was covered in the April 8, CCAAC meeting. She asked Staff person Howard, what do you recommend we cover? Staff person Howard stated that she would like to bring the Commissioners up -to -date on some of the information she was able to find in her research. She stated that the Commission had requested of her to find the missing pages of the Cable Franchise Agreement, because there were some pages missing; pages 9 through 15 She stated that she did not find the missing pages. She stated that she went to the City Clerk's Office and found information regarding the Cable Franchise Agreement, indicating that there should be a board established, an incorporated board, such as Lynwood Information Inc., but that board was to consist of people from the community -at- larger Staff person Howard read a section of the Cable Franchise Agreement to the Commissioners. Section 9, Support For Local Programming: and it reads: The City Council hereby finds and determines that the public interest in community access programming and local program development necessitates the utilization of a nonprofit corporation to be designated by Grantor to fund and oversee community access programming and local program development, and other reasonably related programs and functions. The City Council further finds and determines that the use of such a nonprofit corporation funded in whole or in part by Grantee will allow funding decisions to be made in the best interest of the public, taking into account developing needs and technological advances. Staff person Howard stated that the Grantee is the City and instead of filling the board with the community -at -large they chose themselves to be on the board of directors. She stated that this was established in 1987, it was done by resolution. Commissioner Cunningham asked, does it say a fee was established? Staff person Howard stated that fees were not established here, but the board of directors established the CCAAC to oversee public access. Commissioner Cunningham asked Staff person Howard where does the stipend that the Commissioners receive come from and does the City have a special account set up to pay the Commissioners. Staff person Howard stated that the stipend comes from the Lynwood Information Inc., account, not the City She stated that any service or function under Lynwood Media Services Department is included in the Lynwood Information Inc., budget. Staff person Howard stated that she has been receiving calls from the residents of the City of Lynwood regarding the senior citizens discounts for their cable services. She stated that this is one of the items that will be added to the list for negotiation. Commissioner McZeal stated to Staff person Howard that another thing she was to research is the comparison of Lynwood's franchise fees to those of other cities. Staff person Howard stated 0 0 COMMUNITY CABLE ACCESS ADVISORY COMMISSION MINUTES OF THE MAY 13, 1996 MEETING that she can tell the Commission what Lynwood gets regarding franchise fees, but not compared to other cities. Commissioner McZeal asked Staff person Howard to research some of the more affluent communities to see what they are getting compared to what Lynwood is getting and the comparison of their fees to what Continental Cable is charging the community of Lynwood. Staff person Howard asked, do you mean their basic service fees? Commissioner McZeal answered yes; and also the types of services that we have been discussing regarding the Cable Franchise Agreement. She also stated that if Continental Cable is across the state they should be able to provide all the cities equally Staff person Howard stated that the franchise fees are approximately $21,000 quarterly we have been receiving of the gross which is 5 percent of the cable fees this year Commissioner McZeal asked what is the amount that Lynwood Information Inc., receives. Staff person Howard stated that Lynwood Information Inc., does not get the franchise fee payment, she stated that we get whatever general fund dollars the City give us. Commissioner McZeal stated according to the Cable Franchise Agreement, she thought that it asked for five percent of the revenue from the community Staff person Howard stated that the total amount of money that Continental Cable collects from the City is 16 million. Commissioner McZeal asked and out of that what does Lynwood Information Inc., get. Staff person Howard stated out of that we get more than $80,000 dollars or the total annual amount of the five percentage of franchise fees. She stated what the City gives us is a little over $100,000 dollars, but that is not just cable alone that is for all functions of Lynwood Media Services.
