HomeMy Public PortalAbout2018-10-24 McCall Area Code UpdateTO: McCall Area Planning & Zoning Commission, McCall City Council, Valley County Board of Commissioners FROM: Michelle Groenevelt, AICP, Community & Economic Development Director SUBJECT: McCall Area Code Update DATE: October 24, 2018 ____________________________________________________________________________ This memo is intended to provide you with a status update of the City’s work to update our Code to implement the policies in the McCall Area Comprehensive Plan. Background In 2017 Logan Simpson, the City’s consultant, performed a review of City of McCall Code Titles 2, 3, and 9 as outlined in their contract. They collected public comments in input from the design and building community and general public throughout the McCall in Motion process and held several workshops specifically on the code updates. (Attached is a summary ‘What we’ve heard so far’ form Logan Simpson). A proposed re-organization and draft code was submitted to staff. It was determined that the body of work completed by Logan Simpson could be categorized into the following topic areas. This would allow for a more understandable and incremental approach for the Planning and Zoning Commission review process and ultimately review by the City Council and the Board of Commissioners. Staff presented this approach to City Council in April 2018 and received the go ahead to begin. Topics Major topic areas for the Code Update include the following: Non-conforming uses, structure and lots chapter Design and development standards/form based for the Central Business District Landscaping standards/tree preservation/fire wise Industrial/Airport zone standards update Shoreline/Scenic code update Promote local housing codes Codify Design Guidelines and streamline process Goal An effective land use code that addresses three aspects: Compliance with state statutory authorities and case law; Consistency with Comprehensive Plan, Transportation Master Plan, and other Master Plan goals and policies; and Resources required for effective implementation (also includes streamlining and simplification when possible) Comparative Analysis to be included as part of the process While the McCall Area is a unique place that may warrant local policies and regulations to accomplish the vision of the community, it can be helpful to benchmark certain regulations, policies, and processes to other similar communities. Typically, we look to other mountain town communities in Idaho and in the intermountain west, either emerging or developed, to see how McCall compares and/or as a resource for solutions. The following is the list of communities generally used for comparison and/or resources: Sandpoint, ID; Ketchum, ID; Hailey, ID; Durango, CO; Crested Butte, CO; Whitefish, MT; Park City, UT; Sisters, OR; and Jackson, WY. Technical/Project Management Assistance Originally, it was anticipated that Logan Simpson would have the Code Update completed for consideration at the time of adoption or slightly after the adoption of the McCall Area Comprehensive Plan. When this did not occur, the task of preparing the Code Update became an in-house project for City staff. The change in strategy was presented to City Council in April 2018. Code Updates in Process The following work is underway: Industrial Zone related codes: Approved by City Council in September 2018 and the summary will be on the November 8 City Council meeting and then published for 30 days. A public hearing before the County Commissioners on the ordinance will be on Monday, October 29. Non-conforming Chapter: Several work sessions with the McCall Area Planning and Zoning Commission were completed, brought to design community for review and comments and are now under legal review by the city attorney White Peterson. Given the complexity of this Chapter, it will be scheduled for additional work sessions with the Planning and Zoning Commission. Airport Zone: This Chapter was mostly developed by a working subcommittee in 2008-2009. The McCall Airport Advisory Committee (AAC) then picked up the draft and worked with the Airport Manager and CED Director on reviewing a draft this fall. This draft code is scheduled for the November 6 P&Z meeting (Draft is attached.) The City Council or County Commissioners are welcome to attend the P&Z meeting. Management of the Code Update process moving forward After attending several sessions on Code Rewrites/Updates at the Idaho American Planning Association (APA) conference in October 2018, it became apparent to staff that the Code Update process will benefit from having an experienced consultant facilitate and manage the process with the assistance from City staff. Therefore, Diane Kushlan who has a wealth of experience working on similar projects, has been asked to manage the McCall Area Code Update process. It is anticipated that a contract for services with a scope of work and timeline will be developed for the December 13 City Council meeting. The McCall Area Comprehensive Plan provides the framework and policy guidance for the update. She will use the public input collected, build on the work that has already been completed, and work with staff, the commissions and governing boards on the Code Update.
