HomeMy Public PortalAbout2005-01-28 Special Meeting2 .8 COUNCIL MINUTES SPECIAL MEETING - JANUARY 28, 2005 A Special Meeting of the Bal Harbour Village Council was held on Friday, January 28, 2005, in the Council Chambers, at Bal Harbour Village Hall. The meeting was called to order at 10:50 a.m. by Mayor Roth. Those present were: Also present: Mayor Seymour "Sy" Roth Assistant Mayor Peg E. Gorson Councilman James E. Boggess Alfred J. Treppeda, Village Manager Ellisa L. Horvath, Acting Village Clerk Richard J. Weiss, Village Attorney Absent: Councilman Howard J. Berlin Councilman Joel S. Jacobi As a quorum was determined to be present, the meeting commenced. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Mr. Weiss. 3. ORDINANCE FIRST READING: An ordinance was read, by title, by the Village Clerk, amending the Code for no early voting, as follows: AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING THE VILLAGE CODE BY AMENDING CAPTER 8 "ELECTIONS", BY CREATING SECTION 8-10 "NO EARLY VOTING"; EXEMPTING VILLAGE COUNCIL ELECTIONS FROM THE PROVISIONS OF SECTION 101.657, FLORIDA STATUTES, CONCERNING EARLY VOTING; PROVIDING FOR SEVERABIITY; PROVIDING FOR INCLUSION IN CODE; AND PROVIDING FOR EFFECTIVE DATE. Mayor Roth opened the public hearing. There being no comments, Mayor Roth closed the public hearing. A motion was offered by Councilman Boggess and seconded by Assistant Mayor Corson to approve this Ordinance on first reading. The motion carried with the vote as follows: Mayor Roth aye; Assistant Mayor Corson aye; Councihnan Berlin absent; Councilman Boggess aye; Councilman Jacobi absent. 4. OTHER BUSINESS: Mr. Treppeda reported that the Village has the permits for the 96th Street Landscaping Project. He read minutes from a 2002 Council meeting and reported that the last direction from the Council was not to do Surfside's portion (south side of 96th Street). Mr. Treppeda advised that he can put out to bid for the entire 96th Street and for just the center and Bal Harbour's side. Councilman Boggess doesn't think that Bal Harbour has any intentions of doing the south side. Mayor Roth reported that he attended a meeting with Stan Whitman, Randy Whitman, Mayor Isaac Special Council Meeting 01/28/2005 1 219 Salver (Bay Harbor), Mayor Tim Wills (Surfside), Cliff Schulman (Attorney - Greenberg), and Steve Cypen (Surfside Attorney). He advised that Mayor Wills verbally said that he would be involved and would pay for his side of the Street. Mr. Weiss thinks that is meaningful, but not binding. He suggested that Mr. Treppeda bid the entire project with the Surfside piece, but have the Bal Harbour portion as a separate piece. Mr. Treppeda advised that he can put it out to bid, with an alternate for the Surfside portion, so it can easily be taken out. He reported that Jeff Smolansky (Surfside Town Manager) is checking with the Council, to see what they want to do. Mr. Weiss suggested that Mr. Treppeda also write a follow-up letter to Mr. Smolansky, regarding the Mayor's meeting, to make it formal. Mr. Weiss suggested that the letter also discuss coordinating traffic issues with them, in relation to the project. He also suggested that Mayor Roth call Mayor Wills and suggest that the managers communicate with each other and advise him of the letter, so it won't be a surprise. It was the consensus of the Council to go forward with the bids and not to start the project until after April 15th. 5. ADJOURN: There being no further business to come before the Council, a motion was offered by Assistant Mayor Gorson and seconded by Councilman Boggess to adjourn.
