Also participating remotely : Ryan Bennett , Town Planner and Lynn St . Cyr , Senior Department Assistant. The Chair read the Notification : "Pursuant to Governor Baker's March 12, 2020 Order Suspending Certain Provisions of the Open Meeting Law and his March 15 and March 23, 2020 Orders imposing strict limits on the number of people that may gather in one place, this meeting will be conducted via remote participation to the greatest extent possible. Specific information and the general guidelines for remote participation by members of the public and/or parties with a right and/or requirement to attend this meeting maybe found on the Town 's website at www. brewster-ma . gov. For this meeting, members of the public who wish to listen to the audio broadcast may do so via the Town of Brewster website at httoolliivestream. brewster-ma . gov or on Channel 18. No in-person attendance of members of the public will be permitted, but every effort will be made to ensure the public can adequately access the proceedings in real time via technological means. The Town has established specific email addresses for each board and committee that will be meeting remotely so that residents can send their comments in writing either before or during the meeting. For this meeting, please send comments to planninpboardmeeting(abrewster- ma. gov. Hillis- Dineen thanked the Board and staff for their efforts during her year as Planning Board Chair. Motion by Hillis -Dineen to Nominate Paul Wallace for Chair. Second by Taylor. Vote : Degen -aye , Taylor-aye , Hoffmann -aye , Barrett-aye , Wallace -aye , Chatelain -abstained , Hillis -Dineen -aye . Vote : 6 -0 -1 . Wallace led the meeting as Chair. I Motion by Hoffmann to Nominate Charlotte Degen for Vice Chair. Second by Barrett . Vote : Barrett-aye , Chatelain -abstained , Degen -aye , Hillis - Dineen -aye , Hoffmann -aye , Taylor-aye , and Wallace-aye . Vote : 6 -0 - 1 . Motion by Degen to Nominate Kari Hoffmann for Clerk . Second by Barrett . Vote : Barrett-aye, Chatelain " abstained , Degen -aye, Hillis - Dineen -aye , Hoffmann -aye , Taylor-aye , and Wallace-aye . Vote : 6 -04 . i The Board reviewed and discussed other committees and Boards in which they participate . Members will remain in their current roles including Hillis- Dineen , Brewster Municipal Affordable Housing Trust, Paul Wallace , Vision Planning Committee , Charlotte Degen , Liaison to Select Board , Roberta Barrett, Water Quality Review Committee , Kari Hoffmann , 3 Vision Planning Committee , and Elizabeth Taylor, Community Preservation Committee and Open Space Committee . The Board discussed an alternate for the Water Quality Review Committee and decided to have discuss the role further once j a new member was appointed . I Ned Chatelain thanked the Board and staff and stepped down as a member of the Planning Board to take on his new role as a member of the Select Board . Chatelain left the remote meeting at 7 : 13 pm . 7 : 14 PM PUBLIC HEARING Special Permit Subdivision Application #2020 -08 : Applicant : Town of Brewster Open Space Committee . Owner: Phyllis J . Field and Joanne M . Kelley , Representative : Donald T . Poole of Outermost Land Survey , Inc . for property located at 106 McGuerty Road and shown on Assessor's Map 94 , Lot 82 in the Residential Low Density ( R- L ) and Residential Rural ( R- R ) zoning districts . The Applicant proposes to subdivide one lot into two lots pursuant to Natural PB Minutes 06/24/2020 Page 1 of 3 i Resource Protection Design , Section 69 , of the Brewster zoning bylaw and the Town of Brewster Subdivision Rules and Regulations Chapter 290 . The Applicant requests a waiver from Section 71 of the Brewster zoning bylaw requiring a development impact statement and natural resource analysis . Documents : • 04/21 /20 Natural Resources Protection Design Plan of Land • 05/ 13/20 Planning Board Application with letter request for waivers • 06/ 19/20 Department Review Comments • Definitive Subdivision Checklist Donald Poole participated remotely on behalf of the Applicant, Town of Brewster Open Space Committee . The Owners of the property , Phyllis Field and Joanne Kelley also participated remotely . Motion by Taylor to Open the Public Hearing on Special Permit Subdivision Application #2020 -08 . Second by Degen . Vote : Barrett-aye , Degen -aye, Hillis -Dineen -aye , Hoffmann -aye , Taylor-aye , and Wallace -aye . Vote : 6 =0 -0 . Poole reviewed the plan submitted to the Board . Poole explained that the lot is part of a 1962 subdivision plan . The lot is being subdivided and approximately 10 . 5 acres is being conveyed to the Town of Brewster Open Space Committee . The building lot ( Lot 1 ) is 1 . 38 acres , has 70 . 53 ' of frontage , and will remain a conforming lot under Natural Resource Protection Design bylaw. Lot 1 contains a house . Lot 2 will not be a buildable lot as it lacks sufficient frontage . Taylor stated that she is familiar with the project as Chair of the Open Space Committee . The sale of the property will be before Town Meeting in the Fall . Taylor asked for the Board ' s support to approve the application . Hoffmann asked for clarification on the requests for waivers . Bennett stated that the Applicant requested a waiver of filing fees which will be handled by the Select Board . Hoffmann referenced the letter dated March 5 , 2020 . The Board discussed #4 which should read " as no new units or lots are proposed . . . " Hoffmann stated that the reference in #5 should be to Section 179- 71 for the net acreage calculation . Hoffmann confirmed with the Applicant that there was a building on Lot 1 . Degen sought clarification on the locus . Degen confirmed with the Applicant that there was a building on Lot I . Poole stated that the plan will be updated to include the building currently located on Lot 1 and re-submitted for the Board ' s signature . Hoffmann read the department review comments into the record . Phyllis Field , Owner of 106 McGuerty Road thanked the Board for their review of this application . Field noted that the land has been in the family since 1965 and is used in the summer by the family . Poole noted that while doing survey work on the property he noticed that the trails are used and enjoyed by the public and thanked the owners . I Hoffmann confirmed with Poole that the mylar will be updated to include the building on Lot 1 . Bennett also stated that a signature block for the Town Clerk was requested . Degen asked there were wetlands on the property and Poole responded that no wetlands are present on the property . Poole also stated that there are no rock walls on the property , j Joanne Kelley , Owner of 106 McGuerty Road , thanked the Board and asked whether a new home could be built on Lot 1 in the future . Poole stated that the intent of the plan was to have the building lot remain as conforming under the current zoning bylaw. Bennett noted that for zoning purposes , the Lot 1 will maintain buildability , but Title V requirements will dictate what can be built on the lot. i Motion by Hoffmann to Close the Public Hearing on Special Permit Subdivision Application #2020 -08 . Second by Taylor. Vote : Barrett -aye , Degen -aye , Hillis -Dineen -aye , Hoffmann -aye , Taylor-aye , and Wallace -aye . Vote : 6 -0 -0 . 1 3 Motion by Hoffmann to Approve Special Permit Subdivision Application #2020 -08 with Requested Waivers , as discussed and amended . Second by Taylor. Vote : Vote 6 =0 -0 . j 7 : 32 PM PLANNING DISCUSSION CONTINUED Approval of Meeting Minutes : June 10 , 2020 . The Board reviewed the June 10 , 2020 meeting minutes . Motion by Degen to Approve June 10 , 2020 Meeting Minutes , as amended . Second by Taylor. Vote : Barrett-aye , Degen -aye, Hillis -Dineen -aye , Hoffmann -aye , Taylor- j aye , and Wallace -abstained . The Board discussed their meeting format and that meetings will remain virtual , at least through August. Motion by Hillis -Dineen to adjourn . Second by Barrett .
