AUTHORIZING THE REJECTION OF BIDS AND AUTHORIZING
CONTRACT NEGOTIATIONS FOR THE INDUSTRIAL ROAD DRAINAGE
CULVERT INVESTIGATION PROJECT
WHEREAS, the Borough of Carteret, (the `Borough ") has previously solicited and
received bids on two occasions for the Industrial Road Drainage Culvert Investigation
Project within the Borough; the second round of bids were received on May 29, 2013,
following the rejection of the first round of bids for the Project; and
WHEREAS, upon a review of said most recent bid submittals for the said Project the
Borough Engineer has determined that all of the submittals substantially exceed his
estimate for said work and funding available for said Project; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, that all of the bid submittals
received for the Industrial Road Drainage Culvert Investigation Project are hereby
rejected, and the return of all of the bidders' bid bonds is hereby directed, along with a
notification of die rejection of all bids.
BE IT FURTHER RESOLVED that the Borough Engineer and Borough Attorney are
hereby authorized to attempt to negotiate a contract for the Project in accordance with
provisions of the Public Contracts Law.

On Thursday, May 29, 2013, three (3) bids were received for the Industrial Road Drainage
Culvert Investigation project. Enclosed is a bid summary for the project. The following bids were
received:

The low bid received for the project was fi Adamsville Maintenance Inc., of 333 Roycefield
Road, Unit E, Hillsborough, New Jersey 08844. Adamsville Maintenance Inc. has provided a total
bid amount of $997,861.00.
As presented above, the low bid from Adamsville Maintenance Inc. is significantly above (more
than 15% greater than) the engineer's estimate and, therefore, is hereby deemed unacceptable.
Therefore, based on the bids received which are significantly above the engineer's estimate, it is
recommended the Borough reject the bids received and as this is the second time bids were received
in excess of our estimate, in accordance with N.J.S.A. 5:34 -1 et seq. (Local Public Contracts Law)
we recommend the Borough authorize negotiations with the bidders to "Value Engineer" the projecj c-
and negotiate a reasonable contract cost for same. l
