CALL TO ORDER The meeting was called to order on the above captioned date by Vice Chairperson Araujo at 6:09 p.m., in the Lynwood City Hall Council Chamber, 11330 Bullis Road, Lynwood, CA. B. FLAG SALUTE The Flag Salute was led by Commissioner Williams. All those present participated. C. ROLL CALL Vice Chairperson Araujo requested roll call; staff complied as follows: PRESENT: Chairperson Alford Commissioner Chavira Commissioner Franklin Commissioner Primmer Commissioner Williams Commissioner Araujo ABSENT: Commissioner Byrd STAFF: Annette Clark, HCD Manager Chandra Handley, Minutes Clerk Don Adams, Sr. Rehab. Specialist D. CERTIFICATION OF AGENDA POSTING Staff informed the Commission that the Agenda was posted per the Brown Act. E. APPROVAL OF MINUTES Motion was made by Commissioner Chavira, seconded by Commissioner Primmer to approve the minutes of June 7, 1995. Motion carried unanimously. F. NEW BUSINESS LOAN REVIEW COMMITTEE: Case #95 -01 - The applicant requested approval of an Emergency Grant in the amount of $3,000. Commissioner Franklin asked Mr. Adams if there was any additional income. Mr. Adams stated that the household has only one source of income as listed on the Evaluation form. P Commissioner Franklin stated that there is a Co- Applicant listed, however there is no income for that person. Mr. Adams stated that the applicant submitted a letter stating that only one income is received in the household, but there are two names on title. Commissioner Araujo stated that the homeowners signatures were not on the paperwork. Mr. Adams stated that the homeowners were not available for signatures prior to the meeting. 1 Y] 0 0 Commissioner Araujo also stated that failure to obtain the homeowners signatures on the work write up could cause a problem, because technically the work was not approved by the homeowners. Commissioner Alford suggested that the request be carried over to the next meeting pending submittal of additional income, and both signatures of the homeowners approving the proposed work. Commissioner Franklin made a motion to carry over item #95- 01, seconded by Commissioner Chavira. Commissioners Franklin, Chavira, and Alford voted yes. Commissioners Araujo, Primmer and Williams voted no. An alternate motion was made by Commissioner Araujo to carry over item #95 -01 pending the necessary corrections, both signatures of the homeowners, and additional income if any. Commissioner Franklin seconded. Motion carried unanimously with the exception of Commissioner Primmer. Commissioner Alford stated that more time and effort should be applied to the Loan Review Packages prior to the meeting to assure all necessary signatures are received and typing errors are corrected. Case #95 -02 - The homeowner requested approval of an Emergency Grant in the amount of $3,000. Commissioner Franklin stated that in reviewing the debts of the applicants, as listed on the evaluations form, not much income remains after the mortgage and other fixed monthly expenses. Therefore, it is possible that the applicants did not submit proof of all income. Mr. Adams stated that he could only make an income evaluation from what was received from the homeowners. Commissioner Araujo stated that the pictures submitted to the Commission were pictures of the interior of the house, however the work write up states that the roof and the inoperable roof mounted heating system were to be repaired. Therefore, pictures of the roof should have been taken in order to provide visual proof of the deteriorated roof. Mr. Adams stated that he was unable to take photos of the roof, because a ladder was not accessible to him. Commissioner Franklin asked if the Code currently allowed roof mounted heating system. Mr. Adams stated that the Code currently does not allow that type of system, however the system was placed in years ago and the inside heater was taken out to accommodate the forced air system. Commissioner Franklin asked if the heating system should be brought inside as specified by the Code. Mr. Adams replied that the funding is limited and that type of repair would be excessive. Commissioner Araujo asked if removed in order to repair the the procedure is to repair system. the heating system would be roof. Mr. Adams replied that the roof around the heating Commissioner Franklin asked if the homeowner would receive a guarantee that the roof would not leak. Mr. Adams stated that it is the responsibility of the Contractor to provide the homeowner with a one year guarantee for the work performed and 5 year guarantee for the materials. E i4 0 0 Commissioner Franklin also stated that in her opinion it would be more efficient to repair the inoperable heating system first, then repair the roof. Mr. Adams stated that the procedure for repairing the roof and the heating system is the responsibility of the Contractor. His (Mr. Adams), responsibility is to make sure that the job is done as per the specifications and the City of Lynwood Code. The contractor can use his own discretion in the steps needed to complete the job, however the main purpose is that the heating system is working and the roof is repaired correctly. Commissioner Araujo stated that the responsibility of the Commission is to ensure that the contractor is aware that the specifications are being reviewed to avoid any complaints from the homeowner. The commission has received numerous complaints from homeowners who are unhappy with the quality of the work and it is continually being brought to the commissions attention the unsatisfactory work provided by contractors in the City. Commissioner Araujo made a motion to carry over item #95 -02 pending necessary corrections, and request that Mr. Adams obtain additional unreported income. Seconded by Commissioner Franklin. Motion carried unanimously. Case #95 -03 - The applicant request approval of a Deferred Payment Loan in the amount of $30,000. Commissioner Araujo referred to the evaluation form which states that the applicant is 74 years old, and receives Social Security pension. It is also listed that there are 8 people in the household, but no income is reported for the other household members. Is there additional income that was not reported? Mr. Adams stated that there is a combination of 5 children and 2 adults living in the household, all of whom are unemployed. Commissioner Franklin asked for the ages of the additional family members. Mr. Adams stated that there is a daughter who is 37, and another daughter who is 31 years old. Commissioner Franklin stated that the adults in the household may receive AFDC, which is not reported on the evaluation form. Commissioner Franklin made a motion to carry over item #95 -03 pending submittal of additional income. Seconded by Commissioner Araujo. Motion carried unanimously. Case # 95 -04 - The applicant request approval of a Deferred Payment Loan in the amount of $20,000. Mr. Adams explained that this case is one of illegal conversions which are to be converted back to the original use. He stated that the house consist of an illegal garage and a den which was converted into a kitchen, and used as separate living quarters for additional income. Commissioner Araujo asked if the Commission would be permitted to visit the property after construction is complete. Ms. Clark stated that the City would have to obtain permission from the homeowner, before scheduling a visit. 9 Commissioner Franklin stated that the evaluation form list an income of $490.00 per month and the mortgage payment is $289.69 per month in addition to other monthly expenses. Is there any additional income not reported? Mr. Adams requested that the Commission review the Tax returns as proof of income. He stated that the commission is reviewing the income status of the homeowners excessively. Commissioner Alford stated that all cases would be reviewed and if necessary carried over if the proper information is not received. Commissioner Araujo made a motion to approve the Deferred Payment Loan in the amount of $20,000. Seconded by Commissioner Franklin. Motion carried unanimously. G. STAFF ORALS Mr. Adams stated that if the Commission disapproves of the evaluation process, then he would like to meet and discuss suggestions or comments individually or as a group. He stated that he would like for the Commission to feel comfortable with the application packages. Since the work is coming from the Rehab Division all comments should be discussed with him (Mr. Adams) and'no one else. Mr. Adams stated that he does not want to submit applications to the Commission that are unacceptable. A great amount of time and effort is put into the work by him and the homeowners, who really need the work done. It is very important for the applications to be approved. Commissioner Franklin asked; "What is the time limit, from the time the homeowner submits an application until the time it is submitted to the Loan Review Committee ?" Mr. Adams replied that the process could be thirty days up to seven or eight months. It depends on his workload. Mr. Adams stated that he is the only person in the division and his workload is heavy. In addition to Rehabilitation, he has acquired other duties which are equally important. However, when an application comes before the Commission it is ready to proceed with construction. It is not ready to be held over. Commissioner Franklin stated that over that period of time circumstances could change. Is there a reevaluation done to find out if the applicant is still qualified to participate in the Rehab. program. Mr. Adams stated that if the application is over six months old, the information would be reevaluated before submittal to the Commission. Commissioner Franklin stated that two months ago, applications were submitted for review. At that time the Commission would review the cases and would depend'on the recommendations. However, after approving the cases, an additional review was made and discrepancies were noted. At that time it was determined that the Commission was not asking enough questions, before making a decision. Mr. Adams suggested that he could talk to the Commission before the meeting to decide if the applications are satisfactory or to make any corrections necessary to make sure that the cases will be approved when presented to the board. 4 ri 0 Commissioner Alford stated that if the Commission agreed to meet before a meeting it would be no need to have a regularly scheduled meeting. In addition, if a application is questionable it will be carried over until the next meeting pending any information necessary. The function of the Commission is not to attend the meeting and approve every application submitted. There are guidelines to be followed. Commissioner Alford also stated that he was astounded that Mr. Adams submitted paperwork without the homeowners signatures. Any institution dealing with similar matters would not submit paperwork to a board or committee for. approval without the homeowners signatures. Mr. Adams stated that he agrees with Commissioner Alford, however it is his intention to achieve a repour with the commission in order to achieve direct communication. He stated that if he could communicate with the Commission prior to the meeting it would be beneficial to the applicant, and the commission will not have to spend two hours asking what is this and that. Commissioner Franklin stated that the purpose of the meeting is to discuss the items together as'one body. She stated that other information discussed during the meeting may assist her in making a decision. Commissioner Araujo stated that it is not implied that Mr. Adams is not doing his job, however the Commission is trying to avoid any repercussions that may arise later. She stated _ that there may be people who are approved by the Commission, but are not satisfied with the contractor or the work. Therefore, the Commission will take the time to scrutinize and review the paperwork as deemed necessary. Mr. Adams replied that when dealing with contractors once the project is approved and the account set up, what happens on the construction site is beyond his control. Commissioner Araujo stated that it was requested in the past, after receiving numerous complaints from citizens, that Mr. Adams try to talk to the homeowners and respond to any questions they may have about their project and assure that the homeowners are satisfied with the work. As a result the Commission found it necessary to ask more questions and discuss the cases in detail. Mr. Adams stated that it may be necessary to talk prior to a one hour meeting. Commissioner Araujo also stated that in the past the Commission has scheduled two meetings a month. If Mr. Adams needs to schedule another meeting, to review carry over cases, it is permitted after receiving clearance from the Chairperson. Therefore, the communication should be between the Chairperson and Mr. Adams. Mr. Adams asked for a date and time that the Commissioners would like to visit a completed project as requested. It was determined that the Commission would visit on July 19, 1995 at 5:00 p.m. H. BOARD ORALS Commissioner Franklin stated that she has received inquiries from those Child Care Providers who requested funding for fiscal year 1995 -96, regarding approval of the funding. 61 .Ms. Clark stated that the request for funding for the Child Care Providers is still being considered by City Council. Once City council has made a decision, those applicants will be contacted as to the results. I. ADJOURNMENT: After brief discussion, Commissioner Primmer made a motion to adjourn to the next regularly scheduled meeting, seconded by Commissioner Franklin. Motion carried unanimously.
