HomeMy Public PortalAboutResolution 76-733 PC" 1 " 1 " " RESOLUTION NO. 76 -733 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN VARIANCE CASE NO, 76 -493 THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. That the Planning Commission does hereby find, determine and declare: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 9823 Garibaldi Avenue in said City, more particularly described as: A portion of Block "0 ", Santa Anita Land Company's tract, Map Book 6, page 137 of Maps in the Office of the County Recorder, County of Los Angeles, State of California. have heretofore filed an application for a zone variance to expand a legal nonconforming residential structure having less than the required rear yard setback: (b) That the Planning Commission conducted a duly noticed public hearing on such application, that said hearing was duly closed; and (c) That based upon the evidence adduced at said hearing, the Planning Commission files, and applicable staff reports, and each member of the Commission being familiar with the proposed site, said Commission determined that the facts required by Section 9201 of the Temple City Zoning Code were present, and, therefore, said variance should be granted. SECTION 2. That, for the reasons above set forth, said zone variance application hereinabove described is hereby granted subject to the following conditions: 1. That the development of the subject property shall be substantially in accordanceWidhth e plot plan marked Exhibit "A "; and 2. That all applicable City regulations shall be complied with; and 3. That effect unless and after the the variance; this variance shall expire and be of no exercised within a period of one year from date of adoption of resolution granting and 4. That the applicant shall file, or cause to be filed, with" the City Clerk, a document which the City may record, which shall acknowledge that the owner of the subject property is aware of and accepts the . conditions set forth in paragraphs 1 through 3 above, and that the subject property, regardless of any change in ownership, is bound by and subject to the provisions Resolution No. 76 -733 PC of the resolution granting the variance and the conditions contained therein. SECTION 3. The Secretary shall certify to the adoption of this Resolution. APPROVED and ADOPTED this 14th day of December, 1976.
