Authorize staff to re-evaluate the Project scope and solicit new bids to complete the Folger Ranch House Remodel Project at La Honda Creek Open Space Preserve. SUMMARY The purpose of the Folger Ranch House Remodel and Water System Improvements Project (Project) is to establish the District's first coastside employee residence and provide an ongoing and after-hours presence for the former Driscoll Ranch area of La Honda Creek Open Space Preserve. The Project consists of code-required corrections, and basic habitability upgrades, including the development of a potable water system. The Project is divided into two phases. Phase I consists of the development of a potable water system (underway). The contract for Phase I was awarded on August 24, 2011 (see Report R-11-80); Phase II, the subject of this Board Report, is the ranch house remodel. After completing the Request for Bids process for Phase II, staff recommends rejecting all bids and soliciting new bids to complete the project. Staff requests the opportunity to explore potential Project cost reductions by re-evaluating the Project scope. DISCUSSION Background The Folger Ranch House is located in the former Driscoll Ranch area of La Honda Creek Open Space Preserve (Preserve), approximately four miles west of the Town of La Honda, on an unpaved ranch road north of La Honda Road (refer to Attachments 1 and 2). The purpose of the Project is to establish a District coastside employee residence and provide an after-hours presence at the former Driscoll Ranch area of the Preserve. In order to meet the October 15, 2011 grading deadline set by San Mateo County, the Project has been split into two phases. Phase I, which requires grading work, consists of water system improvements to provide potable water to the residence. The contract for Phase I was awarded August 24, 2011, and construction R-11-97 Page 2 is currently underway. Phase II, which does not require grading, consists of the Folger Ranch House remodel. The house remodel include basic habitability improvements, including: replacement of the existing roof, interior and exterior repainting; replacement or refurbishing of existing flooring; structural improvements; stabilization of an existing chimney and fireplace; installation of a heating system; plumbing and electrical system upgrades; code-related corrections; purchase and installation of appliances, fixtures, and cabinetry; and replacement of doors and windows, as necessary. Additionally, the contract will require 50% of waste material to be diverted from the land fill. Project History Prior to purchasing the former Driscoll Ranch property, the Real Property Committee met on November 16, 2005, to tour the structures and surrounding lands. As part of this tour, the possibility of designating a structure as a ranger residence was discussed. This possibility was later memorialized in the draft La Honda Master Plan, which calls out the Folger Ranch residence as future employee housing given its strategic location. Subsequently, the Folger Ranch House Improvements Project was included as a key project during the FY2008-09 Action Plan. During this time, staff prepared a cost analysis to compare the cost of remodeling the existing residence versus demolishing the residence and installing a manufactured home. Remodeling the residence was deemed as the less expensive option, setting the course for the remodel project. On March 24, 2010, the District awarded a contract to Page & Turnbull, Inc. for $82,500 for architectural and engineering services. On August 24, 2011, the District awarded a contract to Pacific Underground Services for$43,020 to construct the water system improvements. Staff anticipates the total cost of the project to be approximately $363,000. The District spent approximately $55,000 during FY2010-11 on design and engineering services (provided by an architect, mechanical engineer, structural engineer, electrical engineer, civil engineer, geotechnical engineer, and a surveyor). The remaining $308,000 will be spent during FY2011- 12 on permitting, design and engineering services, construction of the water system and house remodel, and construction oversight. Bidding Process The bidding process for Phase II commenced on August 12, 2011. Bid packages were sent to three (3) contractors and five (5) local builders' exchanges. A legal notice was posted in the Half Moon Bay Review and San Mateo County Times and an Invitation to Bid was posted on the District website. A mandatory pre-bid meeting was held on August 25, 2011, and was attended by eight (8) contractors. PUBLIC NOTICE All legal notice requirements of the California Environmental Quality Act(CEQA) have been met, in addition to public noticing requirements of the Brown Act. CEQA COMPLIANCE I The District adopted the Mitigated Negative Declaration and Mitigation Monitoring Program for Phase I and Phase Il of the Project on August 24, 2011 (see Report 11-80 and Resolution 11-29), which determined that the Project would have no significant or cumulative effects because of implementation and adherence to mitigation measures that will prevent substantial impacts to environmental resources. It was also determined that implementation of the Project would not result in direct and indirect substantial adverse impacts or significant risk to human beings. Authorize the General Manager to execute a professional services agreement with the executive search firm of Peckham and McKenney for Recruitment of a District General Counsel in an amount not to exceed $17,500 and expenses not to exceed $7,000. 2. Assign the Board Appointee Evaluation Ad Hoc Committee to work with Peckham and McKenney and to return to the Board with a proposed recruitment process, timeline, and draft candidate profile for Board review and approval. SUMMARY The Board of Directors tasked the Board Appointee Evaluation Ad Hoc Committee with the initial steps of a recruitment process for a successor to the District's General Counsel as a result of her retirement announcement. The Ad Hoc Committee has completed these tasks and is recommending that the Board authorize retention of the executive search firm of Peckham and McKenney due, among other factors, to the firm's excellent references, recent success in placing public agency attorneys, and familiarity with the District including placement of the current General Manager. These factors may also help expedite the recruitment process. The Ad Hoc Committee is recommending further that it be assigned to work with Peckham and McKenney to develop a proposed recruitment process, timeline, and draft ideal candidate profile for Board review and approval at its meeting of October 12, 2011. DISCUSSION At the Board's meeting of August 24, 2011, the Board assigned the task of developing and recommending a General Counsel recruitment plan to the Board Appointee Evaluation Ad Hoc Committee (see Report No. R-11-90) and the Board directed the Board Appointee Evaluation Ad Hoc Committee (Committee)to undertake the initial steps of the plan. The Board directed the Committee to identify qualified search firms and send out a Request for Proposal to these firms. The Board directed the Committee to interview responsive search firms and i R-11-99 Page 2 return to the Board for its approval of a recommended search firm from among the top three finalists. Thereafter, with Board approval, the Committee will work with the firm and return to the Board at its next meeting with a proposed search and selection process and timeline for Board approval. To help expedite the process, the Committee is also requesting that it be tasked with returning with a draft "ideal candidate profile" for Board review and approval. The Committee met on September 2, 2011, to identify qualified executive search firms. The Committee reviewed and approved the Request for Proposal to be sent to these firms. Finally, the Committee agreed upon a timeframe for receipt of proposals, Committee review of the proposals, and proposed dates for interviews of the top three firms. An invitation for proposals was sent out to seven firms on September 7, 2011, with proposals due on September 15, 2011. The Committee asked each interviewee questions which covered the following general topics: 1. District knowledge: What do you know about Midpeninsula Regional Open Space District? Since an open space special district differs from a typical city or county government agency, what changes, if any, would you make in your approach in finding candidates for us? 2. Board participatio : How would you involve the Board in the recruitment process? What process would you use to assist the Board in arriving at a consensus regarding the most desired characteristics? 3. Staff participation: What methods have you used to include senior management in the recruitment process? 4. Interim problem: Sometimes a replacement person lasts only a short time when coming in after a long-term incumbent. How would the recruiter work with us so that this risk is minimized? What experience has the recruiter had with this issue? 5. Time frame: Our goal is to have the candidate's acceptance by January 1, 2012. How would the recruiter suggest we best proceed? 6. Searching for hidden candidates: What process is used to discover and recruit potential candidates who may be quite satisfied with their current position and are not considering a change? What success has been found in this endeavor? R-11-99 Page 3 7. Size of the firm: How large is the firm? What resources are available? How important is THIS search in the firm's workload and schedule? 8. Staff: How many clients will the assigned recruiter be working with at the same time? Who additionally will be working on our position? 9. Interview questions: Will you also be suggesting questions that we may ask candidate finalists? 10. District Staff: How might you involve the General Manager and senior management in the interview of finalists? 11. Ability to Meet Timeline: If your firm is selected, the Board will meet on September 28, 2011, to award the contract. The selected firm will be notified on September 29, 2011. If selected, would you be available to meet with the Board's recruitment subcommittee the week of October 3, 2011, to develop a recruitment and selection process and timeline? 12. Ability to Meet Timeline: The District Board will be meeting on October 12, 2011 to receive the recommended recruitment approach. Will you be able to provide your written recommendation to the committee for a recruitment and selection process by October 5, 2011 in order for the Board to consider this at its meeting of October 12,2011? With this written interview process, and reference checks on all three firms, the Committee felt it had sufficient information to make a recommendation. While the Committee felt any of these three firms would have provided acceptable service to the Board, the Committee found the Peckham and McKenney (Peckham) firm to be the most qualified firm for this search. The difference in estimated costs was within $1,000 and the Committee felt while cost certainly is a factor, this difference in cost was acceptable given the firm's qualifications (see below). The Committee concluded, given all factors, that this firm would provide superior and responsive services to the Board during a compressed timeline for recruitment compared to the other firms. Bobbi Peckham will be the principal handling the recruitment. Ms. Peckham has conducted three recruitments for the District, including the General Manager's recruitment in which she worked closely with the Board. The Committee felt that the knowledge, familiarity and good fit with the Board she has already demonstrated were important factors. She will have a superior ability to get up to speed. Lastly, her reference check elicited responses that were superior to those received for the other firms. If the Board approves selection of this firm, the Committee will work with the firm and return to the Board at its October 12 meeting with a proposed search and selection process and timeline for Board review and approval. The additional task assigned to the Ad Hoc Committee was to review and assemble key District documents pertinent to the recruitment for use by the selected recruiter, including review of the R-11-99 Page 4 present General Counsel's job description, and structure and functions of the position. That process is ongoing. In addition, once the recruiter is on board the recruiter's input will assist in completion of this task. FISCAL IMPACT The $17,500 cost of the recruitment plus a not to exceed figure of$7,000 for expenses such as brochure preparation was not included in the FY2011-12 budget. The Board will be requested to authorize additional funds for this purpose at the time of midyear budget adjustment. SUMMARY This Board Report seeks authorization for staff to apply for a matching rant in the amount of P ppy gg $25'7,000 from the California Department of Parks and Recreations Habitat Conservation Fund Program (HCF) to fund the first phase of the Alpine Pond project. The purpose of the proposed Alpine Pond Habitat and Interpretive Enhancement Project is to promote the conservation and recovery of California red-legged frog, San Francisco garter snake, western pond turtle, and other native aquatic wildlife species at Alpine Pond, while at the same time improving the visitor experience and educational value of the pond. Currently, the educational, aesthetic, and ecological functions served by Alpine Pond are impaired by the dense growth of cattails ringing the pond and the presence of non-native predatory fish. The project goals are to improve habitat for native wildlife by eradicating predatory fish, and improve public access and educational opportunities through construction of a boardwalk and associated interpretive exhibits. DISCUSSION In April 2068, the Board retained Wetlands and Water Resources (WWR)to develop management alternatives for Alpine Pond (Report R-08-62). In August 2008, the Board directed staff to develop an implementation plan for WWR's recommended management options, which include a one-time pond draining to extirpate non-native fish, localized control of cattails in select areas, and installation of a boardwalk and blind system to enhance interpretive opportunities while protecting wildlife refuge areas (Report R-08-96). The landscape architecture firm Restoration Design Group (RDG) was retained in January 2010 to design the boardwalk and interpretive improvements (Report R-10-10). Preliminary design concepts were vetted in March 2010 by the Use and Management Committee and the preferred design was fully R-11-98 Page 2 developed into plans and specifications. During this process, District staff, with the assistance of the Project Committee, developed a pond drainage plan. Both aspects of the project are fully described in the Alpine Pond Habitat and Interpretive Enhancement Plan. The anticipated cost of the entire project (implementation of all phases), if approved by the Board, excluding environmental review(to be performed by District staff), is estimated to be approximately $750,000. The HCF Program allocates approximately $2 million per year to the California Department of Parks and Recreation for grants to cities, counties, and districts to fund projects that: provide nature interpretation and other non-capital outlay programs to bring urban residents into park and wildlife areas; protect fish, wildlife and native plant resources; and acquire or develop wildlife corridors and trails. Projects, including land acquisition, trail rehabilitation, and new trail construction, are eligible for funding. The grant program requires a non-state, dollar-for-dollar match. Eligible match sources include local, federal, or private funds, or donated materials and services. The total project cost for Phase I is estimated at $514,000 and staff is requesting $257,000 (50% contribution) through the HCF Grant Program. If awarded, the grant would fund the following specific actions at Alpine Pond: Pond dewatering and associated biological mitigation and monitoring Restoring, resurfacing, and improving drainage along portions of the existing perimeter trail, removing a maintenance-prone trail segment, and restoring natural drainage patterns and native habitat • Constructing up to 400 linear feet of an Americans with Disability Act compliant boardwalk (including replacing existing decking at the Daniels Nature Center), a covered viewing platform, a picnic area, and an informal outdoor classroom FISCAL IMPACT A proposed adjustment to the Midyear Budget for FY2011-12 will include $20,000 (a decrease from the original $100,000 budget)to fund work through the end of this fiscal year(CEQA process, grant application submittals). The original budget amount would have funded the preparation of a bid package, which has been delayed due to an unfunded, separate and prior grant application. The HCF grant program is expected to announce its grant recipients in July 2012. If HCF grant funds are awarded to the Project, District staff will proceed with obtaining Board approval of the project, and preparing a bid package next fiscal year that incorporates the entire project scope; if grant funds are not awarded, the proposed project and bid package would be much reduced to include only basic, primary elements to keep project costs manageable. HCF grant monies must be disbursed by 2019 and would reimburse project expenses incurred beyond FY201 0-11. PUBLIC NOTICE Public notice of this Agenda Item was provided per the Brown Act. Schilling Lake is formed by a 200-foot-long, un- engineered earthen dam first constructed in the late 1800s by pioneering lumberman Dennis Martin, and enhanced in 1910 by Augustus Schilling. In 2007,a dam engineer presented staff with concerns regarding the integrity of the earthen dam, most notably due to the presence of 17 large trees actively growing on the dam crest. This concern prompted staff to complete a downstream inundation study for the lake in the event of a dam failure to better inform the development of long-term management recommendations. The inundation study and geotechnical analysis of the dam showed that a dam failure at the current lake volume would pose no risk of downstream flooding at any residences, other structures, or road/stream crossing between Schilling Lake and Searsville Lake. Options for long-term management of Schilling Lake were then assessed and presented to the Use and Management Committee at a public meeting held onsite at Schilling Lake on March 19, 2010. The options considered included tree removal, duckweed removal, cattail removal,and long-term monitoring of the dam, all of which were approved by the Committee at that meeting. The Board approved the Committee's recommendation on April 28, 2010, and directed staff to remove all redwood trees growing on the earthen dam,and prevent them from resprouting in the future. Subsequently in 2010, District staff hired a professional arborist to provide guidance on how to remove the trees without impacting or damaging the earthen dam. 'The arborist recommended removal of all nine (9)coast redwood trees on the dam and pruning of other remaining trees. Redwood trees do not respond well to pruning, and have large root systems which can cause damage to the dam, particularly if a tree should fall as a result of windthrow. In 2011,tree removal contractors requested the removal of two additional trees,one(1)madrone and one(1)coast live oak,to facilitate the safe removal of the redwoods. Tree removal work is scheduled from October 17-20, 2011. Residents within 300 feet of the Preserve have been notified of the work. To protect visitor safety, the area around the dam will be closed while work is underway. The contractors will salvage approximately 75%of the harvestable timber and deliver logs to the Skyline Field Office,where staff will mill them into lumber and utilize for future projects. The pond repair and restoration projects will also improve habitat conditions for the federally endangered San Francisco garter snake,which feeds on the frogs, and increase water access and availability for grazing cattle. The ponds are located within critical California red-legged frog habitat and contain an existing population of the frogs. Failing berms,non-functioning spillways, and problems with sedimentation have contributed to the decline of these ponds. The repair and restoration work will result in improved water quality and availability for livestock and other wildlife,alleviating the need for animals to travel long distances for water. "These stock pond restoration projects are in direct support of successful habitat enhancement and continued agricultural grazing on the San Mateo coast,"said Julie Andersen, District Resource Planner and project manager. The project includes replacing invasive weeds with native wetland plants and conducting ongoing biological monitoring for a minimum of three years. One of the largest ponds in the preserve was restored in the summer of 2010. Subsequent monitoring of the restored pond found successfully breeding California red-legged frogs. Preserve El Corte de Madera Creek Location Lawrence Creek Trail Apr 02 An off-duty ranger heard a large tree fall,and screaming from the parking lot area. He responded to the Rangers: 5 IR 1 IF077 area and a woman said she had left her car and started walking across the parking lot when she heard and saw the tree failing and hitting three vehicles parked underneath.There were no injuries. The ranger called additional staff to assist with securing the area and removing the tree.The ranger obtained contact information from the owners of the three vehicles that were damaged. Two vehicles were towed away,and one was driven from the scene. Preserve Fremont Older Location Prospect Road/Parking Lot Apr 03 A ranger was notified by dispatch that a cyclist was requesting a ride out of the preserve after a fall. One Rangers: 1 AR I IF081 subject was riding her bike down the trail at approximately 5-10 miles per hour when her front tire went into a rut. She lost her balance and fell on her left side landing on her knee and hip. She did not hit her head and remained conscious after the fall. At first she declined medical care,and a ranger gave her a ride to her vehicle where she met with her riding partners. At that time she changed her mind and asked for fire and medics to be called so she could get a ride to the emergency room. AMR transported her to El Camino Hospital. The District was notified through Mountain View dispatch Police: 5 and a search of Devils Canyon was conducted that evening into the late night with no results. The search continued on into the next morning when San Mateo County,Contra Costa County and Alameda County SAR units joined the search. Later in the morning a resident in the area called Dispatch to say that the lost woman had shown up at his house. A search team responded to the residence,confirmed the identify and evaluated her. She was taken by District staff to meet with the rest of her party. The woman had spent the night in the Devils Canyon area. Preserve Long Ridge Location Devils Canyon area Apr 10 A hasty search was carried out by District staff for two overdue hikers. It was after sunset and the Rangers: 5 IR 11S079 temperature was in the upper 30's. Both subjects were found uninjured on the Harkins Ridge Trail, about 500'below Harkins cutover,and were reunited with their friends. �r Preserve Purisima Creek Redwoods Location Harkins Ridge Trail Apr 11 A report of a possible marijuana grow site was received by the San Mateo County Narcotics Task Force, Rangers: 1 IR IIS086 who conducted an investigation. When the Sherriffs Office and District staff arrived at the location, Police: 1 which is below the first series of waterfalls on Peters Creek,several feet of plastic irrigation line crossing the undesignated trail were found. The lines were followed to several relatively level meadow areas where cultivation had taken place, most likely the previous year. The Narcotics Task Force estimated that approximately 1,200 plants had been harvested. The water lines were then cut into several pieces and taken out of the canyon, but several thousand feet of line remain along with refuse from the cultivation operation. A female was shaking and hysterical. A male that had been unconscious had regained consciousness. They had both ingested a marijuana brownie. The victims were transported by ground ambulance. Preserve Off District Lands-Skyline Location Hwy. 35 near 16350 Skyline Blvd. Apr 16 One subject said he was riding downhill at a moderate speed when he went over the handle bars of his Rangers: 3 AR 11F093 bike. He said he never lost consciousness but he had pain in his right shoulder and left hand. He also had abrasions on his forearms and both knees. After being evaluated and treated by rangers and responding agencies the subject was transported to El Camino Hospital. Preserve Fremont Older Location Apr 16 District staff responded to a report of a dog vs.dog attack at the preserve. An unleashed dog attacked a Rangers: 3 IR 11S081 leashed dog on the Spring Ridge Trail. Staff made contact with the handler(not owner)of the police: 1 aggressive dog(now on leash)and she stated that her dog had attacked another dog.The dog had blood on its face. She had agreed with the owner of the injured dog to pay any vet bills associated with the attack. She also stated that the aggressive dog was a rescue and that the owner was planning on aggression training. The owner of the injured dog stated that he was nipped while trying to separate the two dogs and his dog was probably going to lose part of the ear. The suspect continued running down the hill without saying anything. Preserve Russian Ridge Location Mindego Residence May 04 A male jogger who is the subject of a District Safety BOL,spat on a ranger while the ranger, and another Rangers: 4 IR 11F111 ranger were detaining an unrelated party. When ordered to stop,the suspect taunted the rangers,and Police: 3 stated he would spit in a ranger's ear every time he saw one and also stated he would punch a ranger. Law enforcement was called but was unable to locate the individual either on the trails or at his last known residence. The report was written for Battery on a Peace Officer as well as Resist/Obstruct/Delay a peace officer and taken to Santa Clara County D.A.office. A warrant has been issued for the suspects arrest. Preserve St.Joseph's Hill Location May 06 At Bear Creek Stables a visitor reported hearing and seeing unauthorized vehicles in the preserve. Rangers: 4 IR 1IF115 Rangers and a deputy checked the preserve but did not locate any vehicles.The following day a ranger Police: 1 followed vehicle tracks to a neighbor's residence.The ranger verbally warned the father of juveniles that they could not operate motor vehicles on District Lands. Preserve Bear Creek Redwoods Location Gate BC01 area May 07 While on patrol District rangers observed four vehicles driving an estimated 25 MPH in the preserve Rangers: 4 IR I IS100 parking lots. As the four vehicles entered the parking lot they cut off a vehicle which was leaving, causing the driver to slam on his brakes. One of the entering vehicles lost control and slid sideways in the equestrian lot. A second vehicle drove around the loop at the end of the equestrian lot and spun a 180 degree turn. These two drivers were cited for reckless driving and released. The other two drivers were given verbal warnings for reckless driving and released. Preserve Skyline Ridge Location From entrance to preserve down to the equestrian lot May 10 A witness reported seeing three to five males inside the closed area within the preserve. Sheriff Deputy Rangers: 2 IR 1 IF120 assistance was requested by the rangers. The subjects were able to elude the rangers and the Police: 2 responding Santa Clara County Sheriff Deputies. Fresh graffiti was found in one building. Since the incident, more graffiti has been appearing on the interiors and exteriors of the buildings. Preserve Bear Creek Redwoods Location Alma College Buildings May 12 A vehicle,traveling southbound on Highway 35,spun out of control hitting a tree. The vehicle Rangers: 3 MA I IS101 overturned and came to rest on its roof in the northbound lane. The driver was not wearing a seatbelt, and was unconscious. He was extricated from the vehicle,and flown out by medical helicopter. In addition,they were Rangers: 2 IR 1IF125 in possession of a bb,air soft,and cap guns. One juvenile received a written warning,the rest were Police: 2 verbally warned. Parents of all the juveniles were contacted. The principal of a local high school was also contacted as the juveniles stated that they were filming a reenactment of a World War 11 baffle for a class,that all of the students were assigned to make a film,and were being graded on accuracy and authenticity. Preserve Rancho San Antonio County Park Location Deer Meadow Trail May 18 While on patrol in a preserve parking lot,a ranger came upon five piles of house remodeling debris and Rangers: 2 IR I 1F130 trash that had been dumped. The parking lot was secured and maintenance was notified of the situation. Some materials were tested for hazardous waste, but none was found.The materials were then removed and disposed of properly. Preserve Ravenswood Location Bay Road Parking Lot May19 Six steers were found in the Preserve outside of the cattle grazing area. The grazing contractor Rangers: 4 IR II5104 responded and returned all six to their grazing area with the assistance of District staff. Preserve Skyline Ridge Location Parking lot driveway May 26 A vehicle accident,with a fatality and multiple injured parties,occurred in the Russian Ridge Preserve. Rangers: 7 IR II5109 The accident took place in the Mindego Hill area involving a District Contract Crew that was preparing to spray the area for noxious weeds. District Staff were first on scene. All victims were triaged and transported as needed(some by helicopter)for further medical care at Stanford Hospital. The victim said that she knew the owner of the dog,who had been hiking down the trail when the dog broke away from it's leash and rushed at her. The victim gave further information,stating that she fell, rolled across a switchback,and scraped up her arm. She tried to report the incident to animal control and the San Mateo Sheriff Department.
