A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FOR AN
ABANDONMENT OF AN ACCESS EASEMENT ON 11851 SKISLOPE WAY
ASSESSOR'S PARCEL NUMBER ~ ~10-40

WHEREAS, the Town of Truckee has received an application from Thomas
Reinhart requesting approval to abandon any offer of dedication to the Town for a 35-foot
wide private Access Easement, along the southern property boundary of Lot 139, of Tahoe
Donner Unit No. 5, of Book 4 of Subdivisions at Page 36, in the Recorders Office of
Nevada County, California: and
WHEREAS, environmental review has been conducted in accordance with the
California Environmental Quality Act (CEQA) and the CEQA Guidelines and the Town
Council has determined the project will not have a significant impact on the environment
and is exempt from environmental review in accordance with Section 15061.b.3 of the
CEQA Guidelines; and
WHEREAS, the Community Development Director, Town Engineer, Public Works
Director, and Town Attorney have reviewed the proposed abandonment and find the
easement is no longer necessary for public purposes; and
WHEREAS, there are no public utility facilities located in the easement to be
abandoned and the Town has not received any objections to the proposed abandonment
from any public utility or special district; and
WHEREAS, the adjacent property owners of APN 44-410.41 were notified of the
request for abandonment and no comments were received; and
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TRUCKEE, the Town Council hereby abandons the offer of dedication of the
Access Easement, within Lot 139, of Tahoe Donner Unit No. 5, of Book 4 of Subdivisions
at Page 36, in the Recorders Office of Nevada County, California:
BE IT FURTHER RESOLVED that the Town Clerk is hereby authorized and
directed to record this resolution with the Nevada County Recorder's Office.
The foregoing Resolution was introduced at a Regular Meeting of the Truckcc Town
Council, held on the 21a day of October, 2004, by Council member Florian, who moved its
adoption, and which motion was duly seconded by Council member Ingalls and carried by
the following vote:

Council Member Florian, Ingalls, Owens, Vice Mayor Threshie and
Mayor Susman
