HomeMy Public PortalAbout91-173 (11-19-91)RESOLUTION NO. 91 -173 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO CONDUCT A PUBLIC HEARING TO ASCERTAIN WHETHER A NUISANCE IS BEING MAINTAINED ON CERTAIN REAL PROPERTY. WHEREAS, the City.Manager of the City of Lynwood has recommended that this City Council find that certain premises within the City of Lynwood may be maintained in such a way•as to constitute a nuisance; and WHEREAS, certain procedures are set forth in Chapter 3 -13 of the City Code of the City of Lynwood, pursuant to which nuisance may be abated; WHEREAS, the conditions on said property which may constitute a nuisance are: 1. Sub - standard structure due to: a. Inadequate foundation b. Excessive deflection of roof (overstressed rafters) c. Deteriorated roofing d. sub - standard electrical system e. sub - standard windows (Area including emergency exit requirements not complying with Uniform ' Building Code specifications) f. Deteriorated exterior sidings g. Excessive deflection of floor (overstressed floor joists) h. Sub - standard plumbing i. sub - standard rooms used for sleeping purpose (improper ventilation, lighting, emergency exits, floor area and general dimensions) 2. Inoperable vehicle parked in rear of dwelling 3. Abandoned and apparently inoperable truck with attached metal container in rear of site. NOW, THEREFORE, BE IT RESOLVED that the City Council of Lynwood does hereby resolve as follows: Section 1. Based upon the aforesaid recommendation of the City Manager, this Council hereby finds and determines that the following described property may presently be maintained in such manner as to constitute a nuisance. Such property is described as Lot 11 of Tract 6173, Page 08 generally known as 11410 California Avenue, City of Lynwood. Section 2. The method(s) by which said conditions could be abated include: 1. Demolish sub - standard building 2. Remove inoperable vehicle from the site 3. Remove truck and metal container from site Section 3 The owner of said property, P.R.U. Development Enterprise, Inc. and /or Charles L. Floyd may be ordered to take said steps in order to abate said nuisance pursuant to Chapter 11 -1.2 (b). b S BE IT FURTHER RESOLVED THAT THIS COUNCIL therefore declares its intention to conduct a public hearing, pursuant to Chapter 3 -13 of the City Code of Lynwood to ascertain whether the above described conditions constitute a public nuisance, the abatement of which is appropriate under public power of the City of Lynwood, and, THE CITY COUNCIL hereby fixes the hours of 7:30 p.m., December 17, 1991, as the time and the City Council Chambers, 11330 Bullis Road, as the place for said public hearing; and the City Clerk is authorized and directed to serve and post certi- fied copies of the resolution in the manner set forth in Chapter 3 -13.5 of the Lynwood City Code.
