HomeMy Public PortalAbout92-018 (02-04-92)RESOLUTION NO. 92 -18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ELIMINATING THE WATER USER'S EXEMPTION PORTION OF THE UTILITY USER'S TAX AND ESTABLISHING A SCHEDULE IMPOSING THE TAX AND IMPLEMENTATION OF SAME, WHEREAS, On October 25, 1990 the City Council determined that the Citv is facing a current budget crisis which could necessitate a reduction in fire service, maintenance of the streets sidewalks, alleys, streets and other property open to the public as well as other community service vital to the preservation of the Public peace, health and safety; and WHEREAS, in recognition of the budget crisis the City Council on October 25, 1990 adopted Ordinance No. 1352 whereby utility users taxes were imposed in order to prevent reductions in the aforementioned services; and WHEREAS, the City Council, in adopting Ordinance No. 1352 determined that the Utility Users Tax exemption on water usage would be reviewed beginning January 1, 1992 and that a decision would be made at that time as to whether or not the exemption would be continued, and WHEREAS, it has been determined that the Utility User's Tax is vital to the continued financial health of the City of Lynwood and that elimination of the exemption for water usage is necessary and in the public interest, and ' NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood, California, as follows SECTION 1. ELIMINATION OF SPECIAL EXEMPTION FOR WATER USAGE. The Utility User's Tax exemption for water users which was allowed for a one year period by Section 4 of Resolution NO. 90 -191 is hereby eliminated. Section 6 -5.9: Water Users Tax of Ordinance No. 1352 is hereby ordered to become effective commencing February 1, 1992. SECTTON 2. SCHEDULE FOR IMPLEMENTATION The Water User's Tax imposed by Section 6 -5.9: Water Users Tax of Ordinance No. 1352 shall go into effect pursuant to the following schedule For the period February 1, 1992 to December 31, 1992, the Water User's Tax Under Ordinance No 1352 shall be imposed at the rate of six percent (6 %) of the charges made for such utility usage as covered by said ordinance except for any exemptions made by Resolution. This initial six percent (6 %) rate shall be referred to end known as the Base Rate for Water User's Tax. Thereafter, the` base rate for Water User's Tax will be increased ' annually pursuant to the following table until the total tax rate is equal to ten percent (10 %) as authorized by ordinance No 1352. The City Manager or his designee is authorized to proceed in accordance with this resolution upon its adoption. SECTTON 1.
