HomeMy Public PortalAbout92-027 (02-18-92)RESOLUTION NO. 92 -27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE SCHEDULE FOR COMPLIANCE AND ADOPTION OF THE CITY'S HOUSING ELEMENT WHEREAS, the City of Lynwood has been designated as an entitlement jurisdiction with a formula allocation for funds under the HOME Investment Partnership in Affordable Housing Program (HOME) which is administered by the U.S. Department of Housing and Urban Development (HUD) which exceed $500,000 but is less than $750,000; and WHEREAS, in order to actually receive funds directly from HUD and be designated as a Participating Jurisdiction, the City of Lynwood must supplement its formula allocation to at least $750,000; and WHEREAS, the State of California, Department of Housing and Community Development (HCD) has agreed to authorize HUD to transfer from the State's formula allocation of HOME funds to entitlement jurisdictions the amount necessary to reach the $750,000 threshold provided such jurisdictions have adopted housing element which is in substantive compliance with state law or will agree to a specific schedule to bring its housing element into substantive compliance with state law; and WHEREAS, all jurisdictions in the State of California are required, pursuant to Article 10.6 of Chapter 3 of Division 1 of Title 7 of the Government Code (commencing with Section 65580), to have an adopted housing element in compliance with state law; and WHEREAS, the City of Lynwood to be a Participating Jurisdiction receiving its funds directly from HUD but does not have an adopted housing element in substantive compliance with state law; NOW, THEREFORE, the City Council of the City of Lynwood does hereby find, determine, order and resolve as follows: SECTION 1. the City of Lynwood hereby agrees to take all actions necessary to complete the process to adopt is housing element, including but not limited, (as necessary: submitting a draft of such element to HCD by April 10, 1992; receiving, reviewing and addressing any comments received from HCD; formally adopting a housing element by June 17, 1992; and submitting a copy of the adopted housing to HCD); SECTION 2. The City of Lynwood acknowledges that HCD's authorization to HUD for the transference of HOME funds is expressly conditioned upon the City of Lynwood's commitment to the complying with the state's housing element laws, and ' acceptance by HUD of all other programmatic items necessary to secure designation by HUD as a Participation Jurisdiction.
