A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD ADOPTING THE ENACTMENT
OF THE AMERICANS WITH DISABILITIES ACT
WHEREAS, the Americans With Disabilities Act (ADA) is
federal legislation passed on July 29, 1990 and becomes effective
in July 1992; and
WHEREAS, its primary focus is aimed at eliminating
discrimination against individuals with physical or mental
disabilities; and
' WHEREAS, the Act consists of five (5) titles: Title I
Employment, applies to discrimination against disabled persons in
employment; Title II Public Service, applies to all services,
programs and activities provided or made available by public
entities; Title III Public Accommodations, requires employers to
make reasonable accommodations to known disabilities unless such
accommodations would result in undue hardship for the organization;
Title IV Telecommunications, applies to auxiliary aids and services
for ensuring effective communication for individuals with
disabilities; Title V Miscellaneous provisions of the Act; and
WHEREAS, the Act requires employers to identify and
eliminate all practices and procedures which unfairly discriminate
against the disabled, post notices of ADA that are accessible to
employees and applicants, determine essential functions of jobs and
establish job - related job qualifications in meeting ADA
requirements; and
WHEREAS, the statute does not require employers to hire or
retain unqualified individuals or to undergo "undue hardship ",
which is defined as significant difficulty or expense in
accommodating a disabled individual; and
WHEREAS, the Act will be enforced by the Equal Employment
Opportunity Commission (EEOC) which will rely on the enforcement
provisions of title VII of the Civil Rights Act of 1964; and
WHEREAS, the City of Lynwood has demonstrated its
commitment and support of non - discrimination against the disabled,
having established written policies similar in scope.
NOW, THEREFORE, be it resolved that the City Council of the
City of Lynwood does hereby resolve as follows:
Section 1. That the City of Lynwood shall comply with the
enactment of the Americans With Disability Act by adopting said
Resolution.
Section 2. This Resolution shall become effective
immediately upon its adoption.
