RESOLUTION NO. 89 -70
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD AUTHORIZING THE INCREASE
OF LIQUIDATED DAMAGES FROM TEN DOLLARS
PER DAY FOR FIFTY DOLLARS PER DAY FOR
CONTRACTORS PERFORMING RESIDENTIAL
' REHABILITATION CONSTRUCTION
WHEREAS, the City of Lynwood operates a Residential
Rehabilitation program to facilitate the maintenance of decent,
safe and sanitary housing stock; and
WHEREAS, the City of Lynwood desires to ensure that all
rehabilitation work is completed in a timely fashion; and
WHEREAS, rehabilitation construction contracts require
contractors to pay liquidated damages in the sum of $10 per day
for unexcusable delays in completing said work; and
WHEREAS, Rehabilitation Program staff has determined that
this amount is not sufficient to encourage completion of
rehabilitation work in a timely fashion.
NOW, THEREFORE, the City Council of the City of Lynwood
does hereby find, order, determine and resolve as follows:
SECTION I. Paragraph 18., page 6 of the Lynwood
Rehabilitation Program, Construction Contract is hereby
' ' ocdified to increase liquidated damages to Fifty Dollars ($50)
per day.
SECTION 2. This resolution shall become effective
immediately upon adoption.
PASSED, APPROVED and ADOPTED this 18th day of April
1989.
