HomeMy Public PortalAbout89-140 (08-01-89)RESOLUTION NO. 89_140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO CONDUCT A PUBLIC HEARING TO ASCERTAIN WHETHER A NUISANCE IS BEING MAINTAINED ON CERTAIN REAL PROPERTY. WHEREAS, the City Manager of the City of Lynwood ' has recommended that this City Council find that certain premises within the City of Lynwood may be maintained in such a way as to constitute a nuisance; and, WHEREAS, certain procedures are set forth in Chapter 21 of the City Code of the City of Lynwood, pursuant to which nuisance may be abated; WHEREAS, the conditions on said property which may constitute a nuisance are: 1. Junk, trash, and debris throughout site.- 2. Overgrown vegetation throughout site. 3. Abandoned house with attached garage being used by transients and children playing. 4. Both structures have been declared to be structural unsafe due to two (2) fires at the site and building age. 5. Site constitutes a fire hazard due to its ' current state of abandonment. 6. Site was posted "Unsafe for Human Occupancy" by the Fire Department and the Building Division. NOW, THEREFORE, BE IT RESOLVED that the City Council of Lynwood does hereby resolve as follows: Section 1. Based upon the aforesaid recommendation of the City Manager, this Council hereby finds and determines that the following described property may be presently be maintained in such a manner as to constitute a nuisance. Such property is described as Lot 19 of Tract 6191 Page 04 generally known as 3351 Elizabeth City of Lynwood. Section 2. The method(s) by which said conditions could be abated include: 1. Demolish unsafe house and garage structure. 2. Remove junk, trash and debris. 3. Remove excessive overgrown vegetation. ' BE IT FURTHER RESOLVED THAT THIS COUNCIL therefore declares its intention to conduct a public hearing, pursuant to Chapter 21 of the City Code of Lynwood to ascertain whether the above described conditions constitute a public nuisance, the abatement of which is appropriate under public power of the City of Lynwood, and, proposa:diskl THE CITY COUNCIL hereby fixes the hour of 7 :30 p.m., September 5, 1989, as the time and the City Council Chambers, 11330 Bullis Road, as the place for said public hearing; and the City Clerk is authorized and directed to serve and post certified copies of the resolution in the manner set forth in Section 21 -18 of the Lynwood City Code.
