RESOLUTION #25-2015
A RESOLUTION APPROVING THE IMPROVEMENTS AGREEMENT FOR THE HOMEWOOD
SUITES HOTEL AT 132 NORTH MAIN STREET INCLUDING ACCEPTANCE OF CASH -IN -LIEU. FOR
THE CONSTRUCTION OF IMPROVEMENTS TO THE SANITARY SEWER CONVEYANCE SYSTEM
WHEREAS, Mr. Justin Mabey of East VH Moab, LLC, with offices at 1001 Cypress Creek Road, #203 Cedar
Park, TX 78613, as the "Owner" of record of a 1.49 acres parcel of land located in the C-3 (Central Commercial
Zone) at 132 North Main Street, Moab, Utah, has applied for the approval of a commercial site plan on said
property; and
WHEREAS, Owner is proposing to construct a 96 room Homewood Suites Hotel and parking as permitted in Moab
Municipal Code (MMC) Chapter 17.24; and
WHEREAS, Owner provided the City of Moab with the necessary documents, plans and drawings to complete the
application for review of the commercial site plan as required in Code Chapter 17.09.660; and
WHEREAS, the City of Moab Engineering and Public Works Departments, through a study of the sanitary sewer
system conveyance system, determined that the impacts of said hotel project on the sanitary sewer necessitated
mitigation; and
WHEREAS, Owner has voluntarily proposed that a cash -in -lieu of construction is a preferred means to proceed
with the development and will submit payment upon approval of Resolution #25-2015; and
WHEREAS, the Applicant provided the City with the necessary documents, plans, drawings and Improvements
Agreement to proceed with the approved project; and
NOW, THEREFORE, be it resolved by the Moab City Council, that adoption of Resolution #25-2015, hereby
approves the submitted Improvements Agreement for the Homewood Suites Hotel at 132 North Main Street and the
Council directs the Mayor to sign the Agreement.
PASSED AND APPROVED in open Council by a majority vote of the Goveming Body of Moab
City Council on June 23, 2015.
