A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TEMPLE CITY CLARIFYING AN AMBI-
GUITY AND PROPOSING AN AMENDMENT TO THE SIGN
CODE OF THIS CITY.
THE PLANNING COMMISSI.ON OF THE CITY OF TEMPLE CITY DOES
RESOLVE:
SECTION 1. The Planning Commission determines'as follows:
Background:
The City Attorney has indicated that there is an ambiguity
with regards to the intended prohibition against outdoor adver-
tising structures in the C -2 and C -3 zones.
The following sections are involved:
1. On p. 64 of the Zoning Code, the Sign Ordinance speci-
fically excludes any reference to outdoor advertising
structures.
2. On p. 88, outdoor advertising structures are specifi-
cally prohibited in the C -1 zone.
3. On p. 100A, outdoor advertising structures are speci-
fically allowed in the M -1 zone.
4. On p. 91C, the reference to outdoor advertising signs
for the C -2 zone is referred back to p. 64 which states
that there is no intent to cover them, thus leaving C -2
in an ambiguous situation.
5. On p. 90E, in the C -2 zone, the only reference to signs
is to those signs adjacent to R -1 property, and there
appears to be no outright prohibition. On the other
hand, since M -1 zone is the first zone in which outdoor
advertising structures is allowed, the proper interpre-
tation should be that it is prohibited in the other zones.
Recommendations:
Forturnately, p. 21 of the Zoning Code allows the Planning
Commission to resolve any such ambiguity and it is recommended
that the ambiguity be resolved by finding that outdoor advertising
structures are prohibited in C -2 and C -3 zones. •
SECTION 2. Accordingly, it is determined that outdoor
advertising structures are prohibited in the C -2 and C -3 zones.
SECTION 3. The Sign Ordinance of this City is recommended
for amendment on p. 64 of the Zoning Code to show the effect of
this.
SECTION 4. The Secretary of the Planning Commission shall cer-
tify to the adoption of this resolution.
