HomeMy Public PortalAbout89-192 (10-03-89)RESOLUTION NO. 89 -192 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING AMENDMENTS TO THE CURRENT'PERSONNEL RULES AND REGULATIONS OF THE CITY OF LYNWOOD SPECIFICALLY DESIGNATED TO ALLOW HOURLY EMPLOYEES WHO HAVE ATTAINED PERS ELIGIBILITY TO COMPETE IN PROMOTIONAL EXAMINATIONS WHEREAS, the designated representative of the City of Lynwood has satisfied the meet and confer provisions of the Myers - Milias -Brown Act; and WHEREAS, all three recognized bargaining units in the City of Lynwood support and encourage the ability of hourly employees who have attained PERS eligibility to compete in promotional examinations; and WHEREAS, the City believes that it is in its best interest to amend the current Personnel Rules and Regulations in order to allow hourly employees who have attained PERS eligibility to compete in promotional examinations; NOW, THEREFORE, the City Council of the City of Lynwood does hereby find, determine, order and resolve as follows: Section 1. That Rule 1B, Section 17 of the Personnel Rules is amended to read as follows: "Promotional Examination ": An examination for a particular class, admission to the examination being limited to regular employees in the classified service and hourly employees who have attained PERS eligibility. Section 2. That Rule 1B, Section 23, is amended to read as follows: "Hourly Employees ": Employees paid on hourly basis where necessary because of the nature of the work. No hourly or seasonal worker shall work more than 35 hours in any week, and compensation shall be on a straight time basis. Hourly employees have no civil service status, vacation, sick leave or holiday privileges unless specifically identified in an appropriate memorandum of agreement. Section 3. That Rule VII, Section 2 is amended to read as follows: "Open Competitive Examinations ": Open examinations shall be conducted for all entrance positions in all departments and in all newly created positions unless it is determined by the Board that there are classified or hourly employees who have met PERS eligibility who meet the requirements as prescribed in the specifications for the position for which the examination is to be held. However, in the event that the Personnel Officer has determined to fill a position through lateral entry pursuant to Section 3 of Rule IX, a lateral entry examination, if such is deemed necessary by the appointing authorities, shall be administered in lieu of an open competitive examination. An open or lateral examination for the rank of Fire Captain may be conducted, waiving the requirement for City of Lynwood experience, and an eligibility list established accordingly, if the results of a promotional examination do not provide an acceptable promotional list and a Captain vacancy occurs prior to the next regularly scheduled promotional examination. Examinations for all departments heads may also be open if it has been previously determined by a 4/5 vote of the City Council that such examination shall be open. Section 4. That Rule IX, Section 5 is amended to read as follows: "Temporary Appointments ": In the absence of appropriate employment lists, a temporary appointment may be made by the appointing authority of a classified employee or hourly employee who has attained PERS eligibility, who meets the minimum training and experience qualifications for the position. An employment list ' shall be established within six (6) months for any permanent position filled by temporary appointment for more than thirty (30) days. When a temporary appointment is to be extended, the Council shall direct the City Clerk to record such action in the minutes of the meeting of the Council. The Personnel Officer shall notify the Board of any temporary appointment and any extension thereof. No special credit shall be allowed in meeting any qualification or in the giving of any test or the establishment of any employment or promotional lists, for service rendered under a temporary appointment. Section 5. That Rule XIII, Section 2 is amended to read as follows: "Promotion ": In so far as practicable and consistent with the best interests of the service, all vacancies in the classified service shall be filled by promotion within classified service and /or hourly employees who have attained PERS eligibility, after a promotional examination has been given and a promotional list established. 6..1 Section 6.
