HomeMy Public PortalAbout89-195 (10-17-89)RESOLUTION NO. 89 -195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO VACATE AND ABANDON FOR PUBLIC PURPOSES THAT PORTION OF THE FIRST ALLEY WEST OF ATLANTIC AVENUE BETWEEN BREWSTER AVENUE AND CORTLAND STREET, AS SHOWN ON MAP OF TRACT NO. 8716, IN THE ' CITY OF LYNWOOD, COUNTY OF LOS ANGELES, MAP BOOK 145, PAGES 63 AND 64 OF MAPS IN THE OFFICE OF THE LOS ANGELES COUNTY RECORDER. The City Council of the City of Lynwood, California, hereby resolves and ordains as follows: Section 1 : That portion of first alley west of Atlantic Avenue, between Brewster Avenue and Cortland Street as shown on map of Tract No. 8716, in the City of Lynwood, in the County of Los Angeles, State of California, Map Book 145, Pages 63 and 64 of maps in the Office of the Los Angeles County Recorder. Said alley located within the corporate limits of the City of Lynwood, is unnecessary for present or prospective public purposes and that the public interest, necessity and convenience require, and the City Council of said City hereby declares its intention to vacate and abandon that portion of said alley. Section 2 : That said portion of alley, as above described, being in the City of Lynwood, is shown on the official map of the City of Lynwood, at the office of the City Clerk of said City, to which all parties interested are referred for particulars as to the proposed vacation and abandonment. Section 3 : That the City Council elects to proceed in said vacation and abandonment "under Section 8300 to 8324, inclusive, of the Streets and Highways Code of the State of California, as amended. Section 4 : The City Council of the City of Lynwood does hereby determine that the public convenience and necessity require that an easement be retained for construction and maintenance of utility lines within the limits of the alley vacation as described in Section 1. i Section 5 : That the City of Lynwood shall perform fence modifications as needed. Section 6 : That the City Clerk of the City of Lynwood is hereby directed to give and post, as required by law, notice of the passage of this Resolution of Intention, and give therein the legal description of said alley proposed to be vacated and abandoned, and specify the time and place of hearing of this Resolution of Intention, which is hereby fixed as follows: The hearing to be before the City Council of ' the City of Lynwood, at 11330 Bullis Road, in the City Council Chambers of the City Hall of said City of Lynwood, at the hour of 7:30 p.m. on December 5, 1989, at which time and place all persons interested may appear and object or protest to the proposed vacation and abandonment of said alley. If the City Council finds from the evidence submitted that the alley is unneces- sary for present or prospective use, it may make its order vacating all or part of the alley. Section 7: This resolution shall take effect immedi- ately upon its adoption. PASSED, APPROVED and ADOPTED this 17th day of October , 1989. ATTEST: ANDREA L.
