A RESOLUTION OF THE LYNWOOD CITY COUNCIL SUPPORTING THE
ACTIONS OF OTHER CITIES IN LOS ANGELES AND ORANGE COUNTIES
IN CONDEMNING THE ON -GOING AERIAL SPRAYING OF THE CHEMICAL
SUBSTANCE MALATHION AND SUPPORTING SENATE BILL 1823
INTRODUCED BY SENATOR ART TORRES.
WHEREAS, The frequency of aerial spraying of malathion
Insecticide over the City of Lynwood and selected areas of the
Los Angeles and Orange Counties has increased dramatically as
State and County Department of Agriculture officials attempt to
eliminate the presence of the Medfly, and
WHEREAS, The increase in aerial spraying necessitates
an official determination regarding the questionable long -term
health and environmental effects resulting from repeated
application of malathion over the City of Lynwood; and
WHEREAS, Because of the existing state law preempts
local regulation of the use of economic poisons, thereby severely
restricting the ability of local government bodies to responsibly
protect the health, safety and welfare of their city residents
from the dangers of malathion; and
WHEREAS, Existing state law provides inadequate time
and opportunity for local governments to challenge the decision
of the California Department of Food and Agriculture, U.S.
Department of Agriculture and the Los Angeles County Agriculture
Commission with respect to the use of Malathion, Pest Eradication
Projects and alternative measures which are currently available;
and
' WHEREAS, Cities throughout Los Angeles and Orange
Counties have repeatedly voiced their concerns regarding the
safety of the continued aerial spraying of Malathion;
NOW, THEREFORE, The City of Lynwood City Council
resolves as follows:
1. That the Lynwood City Council demand that the provisions of
the Food and Agriculture code section 5051 relating to Pest
control be amended immmediately declaring an urgency in dealing
with the Medfly.
2. That the Lynw000d City Council strongly supports and
encourages the passage of Senate Bill 1823 by Senator Art Torres
relative to the use of the chemical substance known as Malathion
and urges the Senate Committee on Toxics and Public Safety
Management to support Senate Bill 1823. ,
3. That alternatives be sought in the use of aerial spraying of
Malathion be implemented because public outcry, health,
safety, and environmental reasons are essential component of
mankind.
' 4. That any future eradication project shall involve this use
of nonpesticide alternatives; to use the least possible amount of

any pesticide and will not result l isubstantial risk o to
to nontarget pests, insects, p nts
environment.

5. Resolved further that the City Clerk is directed by Council
to mail copies of this Resolution to the U.S. Department of
Agriculture, the California Department of Food and Agriculture,
the Los Angeles County Agriculture Commission, to Senator Art
Torres and Committee Senate Members of the Toxics and Public
Safety Management, to all City Mayors and Council Persons of the
affected areas of Orange and Los Angeles counties and to the
delegate members of the League of California Cities and
California Contract Cities.
