A RESOLUTION OF THE LYNWOOD CITY COUNCIL SUPPORTING THE
ACTIONS OF OTHER CITIES IN LOS ANGELES AND ORANGE COUNTIES
IN CONDEMNING THE ON -GOING AERIAL SPRAYING OF THE CHEMICAL
SUBSTANCE MALATHION AND SUPPORTING ASSEMBLY BILL 2900
INTRODUCED BY ASSEMBLYMAN RICHARD POLANCO
WHEREAS, the California Department of Food and Agriculture
(CDFA) has conducted a campaign of aerial applications of
malathion; and
WHEREAS, the public has not been satisfied with the
claims made by the CDFA that malathion is non -toxic to humans and
safe; and whereas these claims have not diminished the concerns
and fears of Southern California residents; and
WHEREAS, the public mistrust of this eradication
program has increased due to new information from the medical
profession, and whereas poor notification procedures and poor
outreach to non - English speaking communities has intensified the
public's concerns; and
WHEREAS, the CDFA has yet to engage in other
available eradication methods, including volunteer stripping of
fruit trees, better public education about laws governing the
transport of fruit and better intervention of illegally
transported fruits; and
WHEREAS, the CDFA has made a cynical attempt to show
they are responding to the Medfly infestation by offering a
$10,000 reward for the apprehension of those who transport fruit
' which actually causes a medfly infestation; and
WHEREAS, Assemblyman Richard Polanco, the first state
legislator who opposed the malathion spraying, has introduced
Assembly Bill 2900 to halt the spraying and enact additional
eradication methods; and
WHEREAS, AB 2900 would take effect immediately,
NOW, THEREFORE, The City of Lynwood City Council
resolves as follows:
1. That it supports AB 2900 by Assemblyman Polanco and that
suitable copies of this resolution be forwarded to the Assembly
Committee on Environmental Safety and Toxic Materials as well as
the Assembly Committee and Agriculture and Water Resources; and
2. That the Lynwood City Council demand that the provisions of
the Food and Agriculture code section 5051 relating to Pest
Control be amended immmediately declaring an urgency in dealing
with the Medfly; and
3. That alternatives be sought in the use of aerial spraying of
Malathion be implemented because public outcry, health,
safety, and environmental reasons are essential component of
mankind; and
4. That any future eradication project shall involve this use
of nonpesticide alternatives; to use the least possible amount of
any pesticide and will not result in substantial risk or damage
to nontarget pests, insects, plants or animals or to the
environment; and

5. Resolved further that the City Clerk is directed by Council
to mail copies of this Resolution to the U.S. Department of
Agriculture, the California Department of Food and Agriculture,
the Los Angeles County Agriculture Commission, to Assemblyman
Richard Polanco and to the Assembly Committee on Environmental
Safety and Toxic Materials as well as the Assembly Committee and
Agriculture and Water Resources, to all City Mayors and Council
Persons of the affected areas of Orange and Los Angeles counties
and to the delegate members of the League of California Cities
and California Contract Cities.
