ORDINANCE DESIGNATING THE CARTERET ECONOMIC
DEVELOPMENT CORPORATION (C.E.D.C.) AS THE
ZONE DEVELOPMENT CORPORATION FOR THE BOROUGH
OF CARTERET TO ENABLE THE C.E.D.C. TO
IMPLEMENT THE ENTERPRISE ZONE DEVELOPMENT
PLAN ON BEHALF OF THE BOROUGH
WHEREAS, on August 15, 1983, the "New Jersey Urban
Enterprise Zones Act" (the "Act"), P.L. 1983, C303, was
szgned into law providing for the creation of urban
enterprise zones within the State of New Jersey; and the act
was amended in January 1994 to allow for ten additional
zones; and
WHEREAS, the State of New Jersey designated the Borough
of Carteret as qualified to participate in the Urban
Enterprise Zone Program on January 11, 1995; and
WHEREAS, to be eligible for the benefits of the Act, a
qualified municipality may create a zone development
corporation to implement the Enterprise Zone Program; and
WHEREAS, the Act authorizes the Governing Body of any
qualifying raunicipality may, by ordinance, create a
non-profit corporation pursuant to the provisions of Title 15
of the revised statute to act as the Zone Development
Corporation of the municipality; and
WHERE~S, any Zone Development Corporation so created
shall include in its Board of Directors, representatives of
the government of the qualifying municipality, members of the
business community thereof, and representatives of community ..
organizations in the municipality, and the total membership
of the Board of Directors shall be broadly representative of
businesses and communities within the municipality; and
WHEREAS, the Mayor of the Borough of Carteret shall
appoint a five (5) member Board of Trustees for the C.E.D.C.
who are representative of community interest on matters
relating to Enterprise Zone Program activity.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF
THE BOROUGH OF CARTERET:
SECTION 1: The Carteret Economic Development Corporation
be designated as the "Zone Development
Corporation" for the Borough of Carteret.
SECTION 2: The Board of Trustees shall consist of five
(5) members, all of whom shall be appointed
by the Mayor. All members of the Board shall
serve on a non-salaried basis. Each member
must be a resident of the Borough of Carteret
or have a bona fide business within the
Borough.
SECTION 3: The first scheduled meeting shall be called
at the discretion of the Chairperson. The
Zone Development Corporation shall provide
the Borough of Carteret (through the Board of
Trustees) with all plans and proposals under
review by the Zone Development Corporation
prior to any submissions of same to any
federal, state or municipal agency.
SECTION 4: It shall be the responsibility of the Zone
Development officer (who shall be a municipal
employee holding the Civil Service title of
Coordinator of State and Federal Aid) with
review and comments of the Board of Trustees,
to ensure that all provisions of the
Enterprise Zone Act (P.L. 1983, Ch303) are
adhered to during the life of a zone
designation.
SECTION 5: This ordinance shall take effect immediately
after passage.
