Also Present: Community Development Director, Tony Lashbrook; Public Works DirectodTown Engineer, Dan Wilkins; Chief of Police, Scott Berry; Town Planner, Duane Hall; Town Manager, Steve Wright; and Town Clerk, Judy Price. PLEDGE OF ALLEGIANCE- Led by Charlie Ingalls. PUBLIC COMMENT Pat Davison, Field Director for CABPRO (California Association of Business and Property Resource Owners): · Thanked Council for use of the Council Chambers for the Candidate Forums. · Thanked AlexTerrazas, Assistant to the Town Manager, for assistance with the forums. · Announced the rebroadcast schedule on Channel 6, from 7:00 p.m.-9:00 p.m. for the Forums: © Council Candidates, Monday o Airport District Candidates, Tuesday o Special District Candidates, Wednesday o A Marathon of all three on October 31, 2004 beginning at 12:00 p.m. George Robertson, Deerfield Drive resident, stated Rick Dondro of Placer County has offered free transportation from Donner Creek Mobile Home Park to as far as the bus depot (to facilitate transportation of pedestrians through the "Mousehole"). In addition the bus stop will be moved closer to the entrance to the Park. Mr. Robertson stated Alex Terrazas (Assistant to the Town Manager) is working on return tickets. Mr. Robertson announced a meeting at 6:30 today to pass out the bus schedules and explain how the system will work. Shelly Harris: · Thanked all the Truckee River Day Volunteers, stating 300 volunteers showed up and a lot of projects were completed. Council was represented at the event by Mayor Susman and Vice Mayor Threshie. Toxvn o~'Truckec Oclobe~ 21. 2004 Regular Pagc 1 5.2 Expressed concerns regarding the speed limit on Donner Pass Road at the Glenshire Intersection. Response: Mayor Susman stated he would pull Consent Item 6.8 to on behalf on Ms. Harris. Barbara Green, Nevada County Board Supervisor, requested Council agendize an item to request Nevada County join in the Amicus brief regarding the Martis Valley Plan. Ann Grogan stated October is Domestic Violence Awareness Month and requested Council agendize an item in the future to help prevent domestic violence in our community. Ms. Grogan related from personal experience the value of the information booklet distributed by Tahoe Women's Services "Reclaim a Life Free of Violence". Ms. Grogan suggested the Truckee Police distribute the booklet when responding to domestic violence calls. Ms. Grogan stated 20% of all violent crime in California is domestic violence crime. Response: Mayor Susman requested an item be agenized for Domestic Violence Awareness Month. Steve Wright, Town Manager, stated he and Scott Berry, Chief of Police, will work on efforts to begin distributing the booklets prior to the budget cycle review. PRESENTATIONS Scott Berry, Chief of Police, introduced new employee RosemaryO'Gorman, Executive Assistant. Dan Wilkins, Public Works Director/Town Engineer, introduced new employee Grant Kaye, Engineering Technician. Dan Johnston's presented to Mayor Susman, on behalf of Council, and to Chief Berry. Officer Dan Johnston presented a shadow box to Council in appreciation for their support of Operation Enduring Freedom. The box containing an American Flag that was flown over Bagram Air Base on September 11, 2003 (a symbol of home and country), a mission patch from Operation Enduring Freedom, aflag shoulder patch from Officer Johnston's uniform, a Global War on Terrorism Service Medal and two ribbons -the Global War on Terrorism service ribbon and Global War on Terrorism Expeditionary ribbon for overseas service. Officer Johnston presented a shadow box to Scott Berry, Chief of Police. The box contained an American Flag that was flown over Special Forces "A" Camp on the Pakistan boarder known as Camp Tillman (named in honor cfa NFL football player that served with the unit). The flag flew over the "A" Camp during an attack on the 8-man unit by 50 individuals, no injuries or deaths were sustained by "A" Camp while 12-deaths were sustained by the enemy. In addition to the flag the shadow box contained a mission patch from Special Operations Command in Afghanistan, a Special Forces Unit Patch, the Global War on Terrorism service medal, and the Global War on Terrorism Expedition service medal. Officer Johnston stated he recently returned from Afghanistan after a year of duty with the Army Special Forces. The presentations are in appreciation for the Town and Chief Berry's support during his tour of duty. Town or' Truckee October 21, 2004 Regular Page 2 Chief Berry stated that Officer Johnston received the Bronze Star with Valor during his service in Afghanistan. 5.3 Truckee River Operating Agreement 6.1 6.2 6.5 Tony Lashbrook, Community Development Director, stated the Truckee River Operating Agreement draft EIR-EIS (Environmental Impact Report- Environmental Impact Statement) is now available on CD. Originally this item was to develop comments on the draft EIR-EIS prior to the close of the comment period. The comment period has now been extended to December 30, 2004. The Truckee Basin Water Group continues to meet and developa strategy in terms of how best to comment on the draft EIR-EIS. The primary outstanding issues revolve around long term monitoring, requesting both resources and the process be in place to insure the accuracy of the assumptions made in the TROA, with some ability to address unforeseen changes. Mayor Susman noted a meeting at the Truckee Donner Parks & Recreation Center was attended by about 8-10 people. Additional publicity on the issue by Council and the press may increase participation for the next meeting. In the past comments have been made collectively by the Truckee Basin Water Group and additional comments separately from the Town of Truckee. Review of the current document witl dictate the proper comment method necessary. An update on this issue will be scheduled for the first Council meeting in December. Approve Treasurer's Report for the Quarter Ended September 30, 2004. Authorize the Town Manager to award the 2004 Glenshlre Drive Bridge Deck Sealing Project to Bay Line Concrete Cutting & Coring, Inc. in the not to exceed amount of $25,925. Authorize a budget transfer in the amount of $30,000 of Measure "A" money for this project, which includes an approximate 15%contingency, from CIP 60-03-18 (Donner Pass Bike Lane) to CIP 60-03-05 (Glenshire Bridge Deck Sealing). 'J ov,,n of'['l'uckec October 21,2004 Rcgulal Page 6.6 Authorize the Town Manager to award the 2004 Recessed Striping Project, CIP 60-03-13 to Linear Options, Inc. in the not to exceed amount of $35,475, Authorize a budget transfer of $21,000 from the 2004 Slurry Seal project, CIP 60-03-20, to the 2004 Recessed Striping Project, CIP 60-03-13. 6.7 Waive the second reading and adopt Ordinance No. 2004-06 approving Amendment No. 1 to the Old Greenwood Agreement. 6.9 Adopt Resolution No. 2004-42 approving the abandonment of the offer of dedication to the Town for a 35-foot wide private Access Easement on APN 44-410-40. 6.10 Adopt Resolution No. 2004-43 approving the partial abandonmentofa 10-foot Public Utility Easement on APN 17-381-11. 6.12 Adopt Resolution 2004-38 to authorize the Town Engineer to submit an Environmental Enhancement and Mitigation Program Grant for Landscaping the Interstate-80/State Route-89 roundabout project and authorize the Public Works Director/Town Engineer to execute all documents. 6~15 Authorize the Town Manager to execute a Professional Services Agreement with Universal Building Services for a two year agreement to provide janitorial services for Town Hall and the Riverview Corporation Yard, reject janitorial bids for the Depot and authorize the Town Manager to enter into a two year agreement for janitorial services for the Depot with Sierra Cleaning and Maintenance. 6.16 Adopt Resolution No. 2004-40 authorizing MBIA MuniServices Company to examine the Measure "A" sales and use tax records of the State Board of Equalization pertaining to Measure"A" sales and use taxes collected for the Town of Truckee by the State Board of Equalization. 6.3 Council waived the second readinq and adopted Ordinance No. 2004-08 updatinR Town Municipal Code Chapter 3.24 (Uniform Transient Occupancy Tax of the Town of Truckee). Charlie White thanked Council for making the suggested changes to the Ordinance and expressed concerns over section 3.24.060; it was not his intent that each operator and the operations tax information would be available to the public. After the Council discussion Mr White agreed to leave the Ordinance as it reads. Steve Wright, Town Manager, stated he and Dennis Crabb, Town Attorney consulted on the matter State Law mandates Transient Occupancy Tax records as public record. Council Discussion: The Ordinance is in compliance with State Law with regards to public records therefore the Ordinance would not require further change. It was moved by Council Member Owens, seconded by Council Member Florian and unanimously carried to waive the second reading and adopt Ordinance No. 2004-08 updating Town Municipal Code Chapter 3.24 (Uniform Transient Occupancy Tax of the Town of Truckee). Town o1' Truckee October 21, 2004 Regular Pagc 4 6.4 Council adopted Resolution 2004-46 in support of Measure H, Vice Mayor Threshie, stated the benefits of Measure H as: · Provide critical affordable education to our families. · Assist businesses by improving the quality of our workforce. · Expand earning potential of our workers. · Preserve the last critical green belt in Truckee - keeping over 50% of the property in a designated conservation easement. · Strengthening our community by expanding access to higher education to everyone. 6.8 It was moved by Vice MayorThreshie, seconded by Council Member Owens and unanimously carried to adopt Resolution 2004-46 in support of Measure H. Council waived the second readinq and adopted Ordinance 2004-10 in order to set or modify speed limits on Alder Drive, Joer.qer Drive, Brockway Road and Donner Pass Road. Dan Wilkins, Public Works Director/Town Engineer, addressed the area questioned by Shelly Harris during public comment- the section of Donner Pass Road from Glenshire Drive up to Highway 267. Mr. Wilkins explained the necessary steps to change the speed limit on the roadway to establish enforceable speed limits. Mr. Wilkins stated at this intersection an additional measure suggested to slow traffic along the roadway prior to the intersection would be to placing the "35 mph" sign about 100 or more yards up from the intersection. Council Discussion: Utilization of lit or flashing signs to draw attention to the speed transition. Potential use of "Slow Intersection" or "35 mph ahead" sign in advance of intersection to slow traffic. Although Council is setting the speed limit on this section of roadway with this ordinance Council is not reducing the speed in this area further than moving the 35 mph sign up the road prior to the intersection. Caltrans speed limits in this area were set with the experience data and the Caltrans speed surveys. Scott Berry, Chief of Police, supported Mr. Wilkins conclusions on setting an enforceable speed limit and placement of the 35 mph sign up the roadway from the intersection. The Town has added a left turn pocket to this intersection. Town of Truckcc ()ctober 2 l, 2004 Regular Page > To notify the public of the speed reduction on Alder Drive: · The Police message signboard will be used. · A press release will be issued. · School notification through a mailer. · A summary Ordinance will be posted in the local paper. A grace period for this speed reduction will be evaluated on a case-by-case basis. The Ordinance will not take effect for 30 days and noticing will begin within the 30 days. Mayor Susman opened item 6.8 to public comment. Shelly Harris, suggested: · Setting a speed limit at a lower speed for a test and then resurveying the area. · Surveying the area with no speed limit posted rather than a 45 mph speed sign. Response: Mr. Wilkins stated the Town is complying with the laws established by the state legislature. Cities are not allowed to arbitrarily set speed limits on arterial roadways. Juanita Schneider questioned the feasibility of a stoplight at this intersection. Response: Mr. Wilkins explained placing a stoplight at this intersection could potentially increase the risk of rear end accidents on Donner Pass Road due to the steep slope of the roadway. Mr. Wilkins stated long-term solutions for the intersection such as realigning Glenshire Drive and or adding a receiving lane to Donner Pass Road are currently being considered in conjunction with the Mill site and other developments. Shelly Harris expressed concerns that the alternatives will take too long to implement. Mayor Susman closed public comment. Council Direction: Post the 35 MPH sign as far up the roadway from the intersection as possible for legal enforcement. Staff will return to Council with a signage plan to assist in slowing traffic prior to the intersection. Resurvey the Donner Pass Road - Glenshire Road intersection area in the spring of 2005. It was moved by Vice Mayor Threshie, seconded by Council Member Ingalls and unanimously carried to waive the second reading and adopt Ordinance 2004-10 in order to set or modify speed limits on Alder Drive, Joerger Drive, Brockway Road and Donner Pass Road. Town of Truckcc Octobcr 21, 2004 Rcgular Page 6.11 Council authorized the Mayor to execute the Town Manaqer Interim Service Contract. Steve Wright, Town Manager, stated this item is to provide Town with interim Town Manager services (with Mr. Wright) from mid November (Mr. Wrights planned retirement date) until a new Town Manager can be selected. Mr. Wright had recommended the Council defer the recruiting process until the new Council is seated to provide them with participation in the selection process. Mr. Wright outlined the proposed process for selecting an executive search firm. Mayor Susman opened item 6.11 for public comment. Seeing none Mayor Susman closed public comment. It was moved by Council Member Florian, seconded by Council Member Owens and unanimously carried to authorize the Mayor to execute the Town Manager Interim Service Contract. 6.13 Council authorized staff to purchase Sodium Chloride from Carqill Salt at a cost of $67.40 per ton and authorized staff to purchase road sand from Teichert AR.clreRates at a cost of $8.50 per ton. Council Member Owens, complemented staff for the strategy employed for increased traction on Town Streets for the past three years. Mayor Susman opened item 6.13 for public comment. Seeing none Mayor Susman closed public comment. It was moved by Council Member Owens, seconded by Vice MayorThreshie and unanimously carried to authorize staffto purchase Sodium Chloride from Cargill Salt at a cost of $67.40 per ton and authorize staff to purchase road sand from Teichert Aggregates at a cost of $8.50 per ton. 6.14 Council adopted Resolution 2004-44 authorizinq the Assistant to the Town Mana.qer to apply for a reuse .qrant from the California Inteqrated Waste Manaqement Board. Council Member Ingalls, provided for the public information on the "TruckeeMax" program. The Citizens Waste Management Advisory Committee has been working on promotion of the program. The program is a web based materials exchange program targeting construction and demolition materials. The grant funding will be utilized to promote the program. Links to the website are located on the Town of Truckee website, www.ciwmb.ca.gov, www.calmax.com or www.truckeemax.com. Council Member Ingalls, thanked Alex Terrazas and Janet Mitchell for their efforts. Mayor Susman opened item 6.14 to public comment. Seeing none Mayor Susman closed public comment. It was moved by Council Member Ingalls, seconded by Vice MayorThreshie, '1 o'~,, n orTruckce ()ctobcl 21. 2004 Regular Page 7 and unanimously carried to adopted Resolution 2004-44 authorizing the Assistant to the Town Manager to apply for a reuse grant from the California Integrated Waste Management Board. 6.17 Council authorized the Town Enqineer to execute an encroachment permit with the Truckee Donner Public Utility District for the purposes of installinq a pump station on Richards Boulevard and a Water Tank on Donner Lake Road. Charlie White questioned why there was no illustration or description of the water tank proposed for Donner Lake Road. Dan Wilkins, Public Works Director/Town Engineer, restated the purpose for the item and introduced Ed Taylor, Tahoe Donner Public Utility District (TDPUD) Superintendent, to answer questions. Ed Taylor stated the time frame on the water tank is one to two years out and the pump station is an immediate situation. Mr. Taylor stated the TDPUD is seeking approval prior to undertaking the design work on the water tank. The pump station will be utilized for multiple water tanks (including the one proposed in the future). Mr. Wilkins illustrated the proposed site for the water tank. The TDPUD will be required to go through a CEQA (California Environmental Quality Act) Mitigated Negative Declaration process with public review prior to constructing the water tank. Mayor Susman opened item 6.14 to public comment. Seeing none Mayor Susman closed public comment. It was moved by Council Member Florian, seconded by Vice MayorThreshie and unanimously carried to authorize the Town Engineer to execute an encroachment permit with the Truckee Donner Public Utility District for the purposes of installing a pump station on Richards Boulevard and a Water Tank on Donner Lake Road. COUNCIL PRIORITIES Council adopted Resolution No. 2004-45 initiatinq amendments to the General Plan Land Use Map for the properties known as the PC-2 AIder Drive site and the Upper Mclver Dairy site. Duane Hall, Town Planner, stated Council directed staffto separate the adoption of the Housing Element of the General Plan to facilitate the amending of the current General Plan accordingly. This will speed the process on the Housing Element to bring the Town into compliance with housing mandates. Staff is recommending two changes to the Land Use Map for the PC-2 (Planned Community - 2) Alder Drive site and the Upper Mclver Dairy site be done concurrently with the Housing Element. These two sites are identified in the proposed draft of the Housing Element as important parcels that will be available to Town of Truckee ( )ctober 21, 2004 Regular Page 8 meet our affordable housing needs; however, they are currently not designated for affordable housing uses. From the workshops Council identified both sits as high- density residential development sites. Staff recommends that the Council initiate the General Plan amendment process to modify the land use designation of these sites so they can be considered concurrently with the Housing Element. These amendments will be addressed in the initial study/negative declaration being prepared for the Housing Element Update, and the amendment will be processed and considered in accordance with the Development Code including public hearings and public notification. It was moved by Council Member Owens, seconded by Council Member Ingalls, and unanimously carried to adopt Resolution No. 2004-45 initiating amendments to the General Plan Land Use Map for the properties known as the PC-2 Alder Drive site and the Upper Mclver Dairy site. COUNCIL REPORTS Council Member Ingalls · Attended Nevada County Solid and Hazardous Waste Commission (SHWC) October 7, 2004. The SHWC entertained a new board member appointed by Governor Schwarzenegger while touring the Nevada County landfill highlighting the composting project. Nevada County has not reached the 50% diversion rate, even with the innovative programs currently in use. Vice Mayor Threshie · Thanked group leaders individually for participation in Truckee River Day. Over 300 volunteers attended to work on 16 different projects. Alex Terrazas, the seniors and other interested parties have been working together to replace the funding with other sources including grant funding. · Announced November 2, 2004 as Election Day, urging citizens to vote. Election coverage will commence at Town Hall at 7:30 p.m. Council Member Owens · Announced LAFCO (Local Agency Formation Commission) reconfirmed the original approval of the Truckee Donner Public Utilities (TDPUD) broadband proposal after meeting three times with the LAFCO Broadband Subcommittee, Cebridge, SBC and TDPUD present. Cebridge has filed a law suite against LAFCO on the decision. 10.
