A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING
THE EXPENDITURE OF FUNDS FROM THE UNITED
STATES DEPARTMENT OF JUSTICE EQUITABLE
SHARING PROGRAM FOR THE PURCHASE OF A
DEPARTMENT -WIDE ACTIVE KILLER RESPONSE
TRAINING PROGRAM AND RELATED AMMUNITION;
PROVIDING FOR WAIVER OF COMPETITIVE BIDDING;
PROVIDING FOR AUTHORIZATION; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Village of Key Biscayne (the "Village") Council, desires to authorize and
provide for the purchase of professional services and related ammunition for purposes of training
the Village Police Department (the "Department") in active -killer situations (the "Program"); and
WHEREAS, the Program will ensure that all members of the Department have basic to
intermediate skills necessary to enhance their ability to save more lives and safeguard themselves
in active killer situations; and
WHEREAS, the Department has identified Direct Action Industries LLC ("DAI") as the sole
locally sourced provider of such an active killer training program; and
WHEREAS, the Program provided by DAI qualifies as an expense which would be paid by
funds from the United States Department of Justice Equitable Sharing Program (the "Federal Sharing
Program"); and
WHEREAS, the Village desires to authorize an amount not to exceed $30,426.00 from the
Federal Sharing Program to purchase the Program as detailed by the proposals attached hereto as
Exhibits "A" (DAI Training Quote) and "B" (Cost of Ammunition); and
WHEREAS, the Federal Sharing Program currently has ample funds resulting from assets
seized during joint investigations involving the Department and federal law enforcement agencies;
and
WHEREAS, pursuant to Section 2-85 of the Village Code of Ordinances (the "Village
Code"), the Village Council has determined that it is impractical to apply competitive bidding
procedures to purchase the Program and desires to waive such procedures; and
WHEREAS, the Village Council finds that this Resolution is in the best interest of the
Village.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY
BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. The recitals stated above are hereby adopted, confirmed
and incorporated herein.
Section 2. Purchase of Program Authorized; Specification of Funds. That the
purchase of the Program from DAI as described herein is approved and authorized, subject to the
condition that the cost of the Program shall not exceed $30,426.00. The funding source for
purchasing the Program shall be from the Federal Sharing Program.
Section 3. Waiver of Competitive Bidding. That pursuant to Section 2-85 of the
Village Code, competitive bidding procedures are waived for the purchase of the Program.
Section 4. village manager Authorized. The Village Manager is authorized to execute
a purchase order, consistent with the proposals attached hereto as Exhibits "A" and "B" for the
purchase of the Program at a cost not to exceed $30,426.00.

Section 5. Effective Date. This Resolution shall be effective immediately upon
adoption.
