A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD ESTABLISHING A SERVICE
CHARGE FOR RELEASE OF STORED AND /OR
IMPOUNDED VEHICLES.
WHEREAS, the Los Angeles County Sheriff's Deputies
and civilian parking control officers are involved in impounding
about 2,900 vehicles each year from City streets; and
WHEREAS, these vehicles are impounded for various
reasons, including, but not limited to, failure to pay parking
citations, abandoned vehicles, and the arrest of the vehicle
operator; and
WHEREAS, the City incurs costs in handling of
vehicle impounds in the form of labor for the officer's time and
administrative expenses in document handling, and releasing
vehicles from impound.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
LYNWOOD DOES RESOLVE AS FOLLOWS:
SECTION 1: That the City Council does hereby
establish the fee for any stored or impounded vehicle to be $50.
The fee may be annually adjusted, but in.no instance shall it
exceed reasonable costs involved with providing the service.
SECTION 2: The Cost Recovery Program imposes a fee
for the release of a stored or impounded vehicle under the
following conditions:
1.
The vehicle was abandoned on a public
right -of -way;
2.
The vehicle was not registered for more than
one year;
3.
The vehicle was creating a hazard;
4.
The vehicle was blocking a driveway and there
was no other immediate remedy available;
5.
The vehicle has more than five outstanding
parking tickets;
G.
The vehicle was being operated by an unlicensed
driver; this would also include drivers whose
driving privilege has been suspended;
7.
The owner /operator was arrested and it was not
practical to legally park and lock the vehicle; or
8.
The vehicle was used in a crime.
Fees are not intended to be charged for the recovery of stolen
vehicles and /or vehicles disabled as a result of a traffic
collision.
SECTION 3: This resolution shall take effect
immediately upon its adoption.
PASSED, APPROVED AND ADOPTED this 7th day of
April 1992
