A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD APPROVING THE ENGINEER'S REPORT ON THE
LANDSCAPE MAINTENANCE DISTRICT DECLARING ITS
INTENTION TO ORDER THE LEVYING OF ANNUAL ASSESSMENTS
WITHIN SAID CITY PURSUANT TO THE "LANDSCAPING AND
LIGHTING ACT OF 1972 ", AS AMENDED, (COMMENCING WITH
STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ.,):
DESCRIBING THE DISTRICT TO BE BENEFITED AND TO BE
ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF: FIXING
THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS
TO THE LEVY OF ASSESSMENTS FOR THE FISCAL YEAR 1992 -93
AND FIXING THE TIME AND PLACE OF THE REGULAR MEETING TO
HEAR PROTESTS AND OBJECTIONS TO THE ASSESSMENT OF THE
ANNUAL INSTALLMENT.

WHEREAS, the City Engineer of the City of Lynwood did,
on the 2nd day of June, 1992, file with the City Clerk, as ordered
by Resolution No. 92 -93 of the City Council of the City of
Lynwood, adopted on April 7, 1992, a report relating to the
service necessary to maintain and improve all parks and landscaped
areas within public right -of -way and City -owned properties in the
City of Lynwood, said written report being in compliance with
Chapter 1, Section 22500 et seq., of the Streets and Highways Code
of the State of California.
WHEREAS, a public hearing on this matter was set for
June 16, 1992.
WHEREAS, the public hearing notice was not published on
time by the newspaper, as required by law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lynwood that:
Section 1. Said report by the City Engineer is hereby
approved and adopted as filed.
Section 2. That the public-, and safety require
and it is the intention of the City Council of the City of Lynwood
to levy and collect assessments for furnishing the service
necessary to maintain and improve all public landscaped areas
compromising 29.5 acres of parkland, the Civic Center complex, six
baseball diamonds, two fire stations, six water wells, 3 street
islands, 3.8 acres of median islands and approximately 8,000
parkway trees in the City of Lynwood within the district described
in Section 3 hereof and to be known as "Landscape Maintenance
District of the City of Lynwood." Reference is hereby made to
Diagram No. 1992 -L and Specifications No. 1992 -L on file in the
office of the City Clerk of said City and Plan No. 1992 -L to be on
file with the Director of Public Works.
Section 3. That the exterior boundary of the district
to be benefited therefrom and to be assessed to pay the costs and
expenses thereof to be known as said assessment district is
described as follows:
Those properties lying within the City limits of the
City of Lynwood. Reference is hereby made to the Engineer's
Report on file with the City Clerk. All publicly owned properties
are assessment exempt.
Section 4. That the said contemplated improvement shall
be had and taken under the provisions of Division 15, Part 2 of
the Streets and Highways Code, cited as the "Landscaping and
Lighting Act of 1972, as amended ".
Section 5. Notice is hereby given that the Public
Hearing is to be continued to the meeting of July 7, 1992,'at the
hour of 7:30 p.m., in the Council Chambers of City Hall, 11330
Bullis Road, Lynwood, California, for the hearing of protests or
objections by the City Council. Any and all persons having any
protest or objections to said proposed maintenance, the extent of
said assessment district, or the levy of the proposed assessment
may appear before the City Council at said hearing and show cause
why said maintenance should not be carried out and the proposed
assessment and diagram confirmed, all in accordance with said
Resolution of Intent and Report. Prior to the conclusion of the
hearing, any interested person may,file a written protest with the
City Clerk, or, having previously filed a protest, may file a
written withdrawal of protest. A written protest shall state all
grounds of objections. A protest by a property owner shall
contain a description sufficient to identify the property owned by
him. All interested persons shall be afforded the opportunity to
hear and be heard. 'The City Council shall consider all o'r'al
statements and written protests or communications made or filed by
any interest person.
Section 6. The City Clerk is hereby directed to cause
notice of the passage of this Resolution to be given at the time
and place in the form and manner provide by law.
Section 7. This resolution shall take effect
immediately upon its adoption.
