HomeMy Public PortalAbout92-132B (08-11-92)RESOLUTION NO. 92 -1326 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD OVERRULING PROTESTS, APPROVING AN AMENDED ENGINEER'S REPORT, ORDERING AN ASSESSMENT TO BE LEVIED AND COLLECTED IN ANNUAL INSTALLMENTS, AND ORDERING THE LEVY OF ASSESSMENTS FOR THE LYNWOOD LIGHTING ASSESSMENT DISTRICT FOR FISCAL YEAR 1992 -93 (Lynwood Lighting Assessment District) WHEREAS, the City Engineer of the City of Lynwood did, on July 21, 1992, file with the City Clerk, by resolution of the City Council (the "City Council ") of the City of Lynwood, a report (the "Engineer's Report ") relating to the maintenance and capital improvements to be conducted within the Lynwood Lighting Assessment District (the "District ") during fiscal year 1992 -93, said written report being in compliance with the Landscape and Lighting Act of 1972 (Part 2 of Division 15 of the Streets and Highways Code of the State of California) (the "Act "); WHEREAS, the City Council did, on July 21, 1992, hold a properly noticed public hearing for the hearing of protest or objections to the Engineer's Report and there being no protest or objections did adopt the Engineer's Report for the purpose of levying and collecting the annual assessment set forth in the Engineer's Report for the maintenance and capital improvements to be conducted within the District during fiscal year 1992 -93; WHEREAS, the City Council did, on July 21, 1992, adopt Resolution 92 -113 expressing its intent to amend the Engineer's Report to provide for an assessment to be levied and collected in annual installments over a period of 20 years, commencing with ' fiscal year 1992 -93 and ending with fiscal year 2011 -12, to pay the cost of certain capital improvements not included in the original Engineer's Report, which cost exceeds the amount which can be conveniently raised in a single assessment, and fixing the time and place for a hearing with respect thereto; WHEREAS, the City Engineer did prepare and file the amended Engineer's Report, a copy of which is attached hereto (the "Amended Engineer's Report "), and the City Clerk did publish notice of the public hearing on the adoption of the Amended Fngineer's Report and on the levy of assessments set forth therein; and WHEREAS, the City Council did, on the date hereof, hold the public hearing on the adoption of - zhe Amended Engineer's Report and on the levy of assessments set forth therein; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood as follows: Section 1. Each and all of the recitals set forth hereinabove are true and correct. Section 2. The protests submitted with respect to the Amended Engineer's Report, if any, are hereby overruled. ' Section 3 The Amended Engineer's Report, including the diagram of the District, the fiscal year 1992 -93 assessment with respect to the District, and the amounts of the annual installments to be levied and collected thereafter, to and including fiscal year 2011 -12, is hereby approved and confirmed and is incorporated herein by this reference as though fully set forth. Section 4. The cost of certain capital improvements described in the Amended Engineer's Report exceeds the amount which can be conveniently raised from a single assessment and it is hereby ordered that such cost be raised by an assessment to be levied and collected in annual installments over a period of 20 years, commencing with fiscal year 1992 -93 and ending with fiscal year 2011 -12. A general description cof such capital improvements, the estimated cost thereof, the number of annual installments and the fiscal years during which they are to be collected, and the amounts of such annual installments are sett forth in the Amended Engineer's Report. The City Engineer, in preparing engineer's reports with respect to the District for fiscal years 1993 -94 through 2011 -12, shall include in the assessment for each such year the amount of the annual installment fixed for such year as set forth in the Amended Engineer's Report. Section 5. The City Clerk is hereby authorized and directed to forthwith file a certified copy of the diagram of the District and the fiscal year 1992 -93 assessment with respect to the District with the County Auditor. Section 6. The City Clerk is hereby further authorized and directed to file a statement as described in Government Code Section 54900 with the County Assessor immediately after the adoption of this resolution. Section 7. This resolution shall take effect immediately upon its adoption. PASSED, APPROVED AND ADOPTED this 11 of ATTEST: Andrea L.
