HomeMy Public PortalAboutM 2012-02-21 - CCf LYNWOOD CITY COUNCIL REGULAR MEETING February 21, 2012 The City Council of the City of Lynwood met in a regular meeting in the Council Chambers, 11330 Bullis Road on the above date at 5 11 p.m. Mayor Morton presiding Council Members, Rodriguez, Santillan -Beas, Alatorre and Morton were present. Council Member Castro was absent. Also present were City Manager Haley, City Attorney Galante, City Clerk Quinonez and City Treasurer Hernandez. City Clerk Quinonez announced that the Agenda had been duly posted in accordance with the Brown Act. Item #6. PRESENTATIONS /PROCLAMATIONS • 106 Anniversary of Rotary International Proclamation The City Council presented a proclamation to Lynwood Rotary President Victor Gomez. • Sheriff Captain Joseph M. Gooden — Update on Law Enforcement Issues Lieutenant Chavez reported a slight increase in burglaries. He reported on the effectiveness of the Traffic Safety Bureau. He reported on the eleven individuals detained for loitering in the City Park. Upon questioning from Mayor Pro Tern Alatorre, he stated that there was a deputy dedicated to large truck patrol about seven years ago and that he would provide the City with more details. Upon questioning from Council Member'Santillan -Beas, he stated that the takedown robberies that occurred on Woodlawn where being investigated by the Crimes Unit. Lastly, he reported that the City of Lynwood K9 program would be highlighted at the California Contract Cities Conference s City Council Members Reporting on Meetings. Attended (Gov Code Section 53232.3(D)) Mayor Pro Tern Alatorre reported attending the Water Replenishment District meeting and the Vida Sana event in Lynwood Mayor Morton reported attending the Vida Sana event and the Inauguration of Pastor Nisan Stewart at Greater Emmanuel Temple Church The City Clerk spoke about the inauguration event. Item #7. COUNCIL RECESS TO CITY OF LYNWOOD AS THE SUCCESSOR AGENCY TO THE LYNWOOD REDEVELOPMENT AGENCY 5 34 p.m. LYNWOOD HOUSING AUTHORITY 5 48 p.m. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) PUBLIC ORAL COMMUNICATIONS Frank P Calderon commented on employee recognition and advised the council to recognize employees when 'possible. He also commented on his neighbor sandblasting without proper covering. Lastly, he stated that the Mayor prolonged the meeting unnecessarily He provided a copy of his comment to the Council. Alicia Alvarez asked the Council to refrain from telling community members that she has an attorney because she does not. She commented on wanting records that.perfain to her son's death in Lynwood.' Pearline Calderon recommended that staff coverage of the 'Annex front desk be staggered so that residents can be attended to Additionally, she asked if the name of the Lynwood trolley was changed. Antonio Munguia commented on the problem with illegal vendors on Imperial and Long Beach Blvd. He also thanked all City commissioners for volunteering their time to the community Salvador Hurtado asked why a special permit from the Council was needed to open his business in the City of Lynwood. He stated that his business is a religious business. Lorene Reed invited everyone to attend the Senior Center activities. Paulette Bradley commented on the Senior Center trip to Allensworth. She also invited everyone to Open Mid Night at the Senior Center CONSENT CALENDAR It was moved by Council Member Rodriguez, seconded by Mayor Morton, to approve the consent calendar and receive and file staff reports. APPROVAL OF THE WARRANT REGISTER RESOLUTION NO. 2012.034 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ALLOWING AND APPROVING THE DEMANDS AND WARRANTS THEREFORE Item #10. Mayor Pro Tern Alatorre pulled Item #10 — CONSIDERATION OF CONSULTANT TO PROVIDE GRANT WRITING SERVICES Mayor Pro Tern Alatorre stated that he was concerned with awarding the contract and not receiving enough grant revenue City Attorney Fred Galante stated that he added a clause to the draft contract stating that the City can cancel the contract with or without cause without paying the full contract. It was moved by Mayor Pro Tern Alatorre to bring the item back with changes for consideration. It was subsequently moved by Council Member Santillan -Beal, and seconded by Council Member Rodriguez, to open the item up for an RFP AYES COUNCIL MEMBERS RODRIGUEZ, AND SANTILLAN -BEAS NOES COUNCIL MEMBERS ALATORRE, AND MORTON ABSTAIN: NONE ABSENT COUNCIL MEMBER CASTRO It was moved by Mayor Pro, Tern Alatorre, seconded by Mayor Morton to bring the item back with clarifications. City Attorney Fred Galante clarified that with Council direction, the item would not have to come back to another council meeting. Mayor Pro Tern Alatorre clarified his motion to approve the item with a date restriction of six months. He explained that if the grant writer did not produce grants within the six months, then the contract would be terminated. City Manager Roger Haley stated that staff could provide the Council with a progress report every two months. AYES. Council .Member Santillan -Beas pulled Item #12 - SPECIAL PERMIT APPLICATION — 11254 ATLANTIC AVENUE HAITIAN 'FELIX BONTANICA Council Member Santillan -Bbas asked if the new applicant is the same owner of the last business that had a fire emergency Director of Development Services Jonathon Colin stated that it is not the same owner but that staff recommendation is to deny the request. It was moved by Council, Member Santillan -Beas, seconded by Council Member Rodriguez, to approve staff recommendation and deny the request for a special permit. Item #13. CONSTRUCTION CONTRACT AWARD IMPERIAL. HIGHWAY MEDIAN ISLAND FENCE IMPROVEMENT PROJECT, PROJECT NO 4011 67 916 RESOLUTION NO. 2012.036 ENTITLED: • RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, AWARDING • CONTRACT TO ENCORRE SERVICES, INC AS THE LOWEST RESPONSIBLE BIDDER IN THE AMOUNT OF $54,800 00 FOR THE IMPERIAL HWY MEDIAN ISLAND .FENCE IMPROVEMENT PROJECT, PROJECT NUMBER 4011 67 916 AND AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT AGREEMENT Item #14. UPDATED MEMORANDUM OF UNDERSTANDING (MOU) WITH MANAGEMENT BARGAINING GROUP (MBG) THROUGH JUNE 30, 2012 City Manager Roger Haley'and Human Resources Director Alfredo Lopez introduced the item regarding the ;updated Memorandum of Understanding (MqU) with Management Bargaining Group (MBG) through June 30, 2012. After discussion by Council, it was moved by Mayor Morton, seconded _by Council Member Rodriguez, to approve the staff recommendation to adopt the following resolutions. RESOLUTION NO. 2012.039 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADOPTING A COMPREHENSIVE MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CITY AND THE MANAGEMENT BARGAINING GROUP WHICH SETS FORTH ALL WAGES, HOURS, AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT RESOLUTION NO. 2012.040 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD FOR EMPLOYER PAID MEMBER CONTRIBUTIONS FOR MANAGEMENT EMPLOYEES ' RESOLUTION NO. 2012.041 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD FOR EMPLOYER PAID MEMBER CONTRIBUTIONS FOR ELECTED. OFFICIALS AYES COUNCIL MEMBER RODRIGUEZ, SANTILLAN -BEAS, ALATORRE AND MORTON NOES NONE ABSTAIN NONE ABSENT' COUNCIL MEMBER CASTRO CITY COUNCIL ORAL AND WRITTEN COMMUNICATION Council Member Santillan -Bess thanked the Code Enforcement Department for handling the illegal vendor problem. Council Member Rodriguez thanked everyone for attending the meeting and reminded them that council meetings are every first and third Tuesday of the month. He thanked staff and the Sheriff's department for doing good work, in particular, removing the loitering men from the park kiosks. Mayor Pro Tern Alatorre asked staff to look into a vacant property on 10738 San Jose Ave. He asked that an item be added to the next council meeting agenda to -move council meetings to 6pm. He asked that the faded writing on the Lynwood Breeze buses be fixed He announced that the Board of Equalization would be holding a free tax filing at California State Dominguez Hills. He thanked everyone for attending the meeting He stated that cell phone use is not appropriate during the council meetings and would like to bring this item back to the city council agenda. Mayor Morton thanked everyone for attending the meeting. He explained why he wanted to hire a grant writer for the City He commended the Sheriff's Department for W doing a fantastic job and he commended staff for handling the illegal street vendors He stated that he appreciated everyone who submitted a commissioners application, as well as all of the City's volunteers because the City is expected to do more with less. CLOSED SESSION City Attorney Fred Galante stated that there was an additional closed'session`item that the City learned about after the posting of the agenda that needed .to be added to the - closed session agenda. He stated that the item was considering real property negotiation and the entity would be Kudco Diversified LLC and the City of Lynwood. It was moved by Council Member Santillan -Bess, seconded by Mayor Pro Ten Alatorre to add the item to the City Council Closed Session Agenda. NONE ABSTAIN: NONE ABSENT COUNCIL MEMBER CASTRO City Attorney Fred Galante announced that the Council would recess to discuss three closed session items on the City Council agenda and one closed session item on the Lynwood Successor Agency agenda. The Council recessed to closed session at 6:55 p.m. The City Council reconvened at 8:13 p.m. City Attorney Fred Galante stated that the Council met in closed session and with respect to the following matters: Item #19. Kudco Diversified LLC and City of Lynwood To discuss price and terms of potential acquisition. The Council provided direction and no reportable action was taken.
